AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED
SWORN POSITIONS IN THE POLICE DEPARTMENT BY ADDING
FORTY-FIVE POSITIONS IN THE CLASSIFICATION OF POLICE
OFFICER EFFECTIVE SEPTEMBER 16, 2017; PROVIDING A
STATEMENT OF PURPOSE AND INTENT; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES
AND REPEAL CONFLICTING ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 143.021(a), Texas Local Government Code provides that a
municipality's governing body shall by ordinance (i) establish the classifications of police
officers and (ii) prescribe the number of positions in each classification; and
WHEREAS, on August 1, 2017, the City Council adopted Ordinance 22813-08-
2017, which established the Police Depat-tment's sworn personnel staffing levels, effective
July 22,2017, as follows:

WHEREAS, the Police Chief has requested that the City Council increase the
number of authorized positions within the existing classification of Police Officer by forty-
five (45) effective September 16, 2017, to accommodate the graduates of Academy Class
143 and thereafter prescribe the number of authorized positions in the Police Department
to conform with the proposed changes as set forth below in order to effect efficient
economy of the operations of the Police Depar�tment.
NOW, THEREFORE, SE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS:
SECTION l.
That, following the formal adoption of this ordinance, the following positions shall
be the only sworn positions in each classification (rank) authorized in the City of Fort
Worth Police Department effective September 16, 2017, until modified by subsequent
oi•dinance:

That the "Mayor and Council Communication" memorandum, which is presented
contemporaneously with this ordinance, is hereby expressly incorporated herein by
reference for further clarification and explanation of the putpose and intent of the City
Council in its adoption of this ordinance as well as the Depai�tment in its implementation.
SECTION 3.
That this ordinance shall be cumulative of all provisions of previous ordinances and
of the Code of the City of Fort Worth, Texas (2015), as amended, except where the
provisions of this ordinance are in direct conflict with the provisions of prior police staffing
ordinances for the Police Depai�tment and such Code, in which event conflicting provisions

of such ordinances and such code provisions are hereby repealed and this ordinance shall
be conti•olling.
SECTION 4.
That it is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of these ordinances are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining plu•ases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incoiporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 5.
That this ordinance shall be effective September 16, 2017, with respect to the
addition of forty-five (45) positions in the Police Officer classification, and it is so
ordained.

Adopt Ordinance Temporarily Increasing the Number of Authorized Positions in the Classification of Police
Officer in the Police Department by Forty-Five, Thereby Increasing the Total Number of Authorized Civil
Service Positions by Forty-Five (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance prescribing the number of
authorized sworn positions in each classification in the Police Department, temporarily increasing the
number of authorized positions in the classification of Police Officer by 45 effective September 16, 2017,
thereby increasing the total authorized civil service positions from 1,655 to 1,700 effective September 16,
2017; and effective until superseded by future ordinances.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) and the attached ordinance is to
temporarily increase the number of authorized positions in the classification of Police Officer in the Fort
Worth Police Department by a total of 45 in order to have sufficient Police Officer positions for all of the
graduates of Fort Worth Police Recruit Class 143, who are expected to graduate on September 15, 2017
and promote to Officer on September 16, 2017.
There are 45 recruits in Recruit Class 143. Projected Civil Service retirements and separations are
expected to result in vacancies, that will be short of the anticipated need in order to promote all graduated
recruits to Police Officers on September 16, 2017. Since these projections are not actuals, but are
estimates, the Police Department is requesting a temporary increase of 45 Officer positions in case the
Department does not realize these projected retirements and separations.
The need to add these positions is a result of the Department's not generally carrying vacancies. In an
effort to ensure that calls for service are met with optimum response times, the Police Department strives
to keep the number of Police Officer vacancies as close to zero as is reasonably possible. To accomplish
this goal, Academy classes are scheduled to correspond with projected vacancies, including retirements
and promotions. Recent promotional delays have affected the vacancy rate in the Officer classification. In
addition, Class 142 and Class 143 were spaced closer than normal to allow for the ramp up of the Sixth
Division. Because the necessary vacancies in the Police Officer classification will not be available to
accommodate all anticipated to graduate in Class 143, the Department is seeking to temporarily increase
the number of authorized positions in the classification of Police Officer.
On August 1, 2017, the City Council adopted its most recent authorized staffing ordinance for the Police
Department (Ordinance No. 22813-08-2017), which increased the total number of authorized positions in
the classification of Police Officer by 20, prescribing the total number of authorized positions for each
classification of sworn personnel and providing for a total of 1,655 civil service positions.

NOTE - The position changes at issue in this M&C and ordinance do not in any way affect the civil service
positions that were added with the receipt of the COPS Hiring Program Grant (M&C C-27135).
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that the funds are available in the current operating budget, as
appropriated, of the General Fund. The Police Department will have the responsibility to manage their
appropriations commensurate to not create a deficit position.
