HomeMy WebLinkAboutOrdinance 22788-06-2017Ordinance No. 22788-06-2017 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $200,000.00, SUBJECT TO APPROVAL OF GRANTAND RECEIPT OF FUNDS, FOR THE PURPOSE OF FUNDING THE ZOO CREEK — TRINITY RIVER OXBOW POLLUTION CONTROL PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $200,000.00, subject to approval of grant and receipt of funds, for the purpose of funding the Zoo Creek — Trinity River Oxbow Pollution Control Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 22393-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Authorize application for, and acceptance of, if awarded, a grant from the North Central Texas Council of Governments in an amount up to $200,000.00 for the engineering design for a water quality project for the reduction of bacteria, nutrients, sediment and other water pollutants in the vicinity of the Zoo Creek — Trinity River Oxbow within Forest Park; 2. Authorize the City Manager to execute all applicable grant contracts including renewals and amendments; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in an amount up to $200,000.00 upon receipt of the grant. DISCUSSION: The North Central Texas Council of Governments (NCTCOG) encourages applications for funds awarded through the NCTCOG Environmental Stewardship Grant Program. If awarded, funds provided through this program allow for the engineering design of a water pollution control project. The Code Compliance Department's Environmental Management Division and other department representatives have collaborated to prepare an application for the design of a project entitled the Zoo Creek—Trinity River Oxbow Pollution Control Project. Based on the grant program requirements, the project would focus on water quality improvements in Zoo Creek which ultimately discharges into the Trinity River. Surface water quality data suggest that water quality in the area can be improved through a design which naturally reduces pollutants and promotes safety for water recreation activities such as wading, swimming, and tubing. If awarded, the City of Fort Worth will solicit professional engineering services for the development of the specific project design. The proposed engineering design would modify the oxbow to allow for natural treatment to reduce pollutants, to offer outdoor education, and to support recreation in Forest Park. This grant has no matching requirement and indirect costs have not been included. This contract will be with a governmental entity, state agency or public institution of higher education: North Central Texas Council of Governments.
