AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE AMOUNT OF $707,648.00 IN THE WATER CAPITAL PROJECTS FUND, FROM
AVAILABLE FUNDS, FOR THE LAKE WORTH WATER AND SANITARY SEWER
IMPROVEMENTS PROJECTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the
Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the amount
Lake Worth water and sanitary sewer improvement projects of $707,648.00 in the Water Capital Projects
Fund, from available funds, for the installation of water and sanitary sewer mains on several City streets.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 22394-09-2016 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Project Total in the Amount of$707,648.00 and Adopt Appropriation Ordinance (COUNCIL DISTRICTS 2

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Projects Fund in the amount of$707,648.00; and
2. Authorize the execution of an Engineering Agreement with Burgess & Niple, Inc., in the amount of
$547,648.00 for Lake Worth Water and Sanitary Sewer Improvements, (City Project No. 100962).
DISCUSSION:
On September 27, 2016, Mayor and Council Communication (M&C L-15954), the City Council authorized
the settlement of an annexation lawsuit entitled City of Fort Worth, Texas v. Town of Lakeside to include
payment of$175,000.00 to Town of Lakeside in exchange for its release of certain areas within its
Certificate of Convenience and Necessity (CCN) for providing water service. The CCN will be obtained in
19 months for property in Fort Worth City limits South of Lakeside. This M&C is to authorize the
preparation of plans and specifications for the installation of water and /or sanitary,sewer mains on the
following streets within the CCN as identified to serve Fort Worth residents and the replacement of
deteriorated water and/or sanitary sewer mains in the vicinity of the CCN area as indicated on the non-
CCN streets and easements below:

In addition to the contract amount, $160,000.00 (water: 80,000.00; sewer: $80,000.00) is required for
project management, real property acquisition, utility coordination and material testing.
This project will have no impact on the Water Department's operating budget when completed.
M/WBE OFFICE: Burgess & Niple, Inc., is in compliance with the City's BDE Ordinance by committing to
24 percent SBE participation. The City's SBE goal on this project is 10 percent.
Design of the areas impacted by the Lakeside settlement agreement will be completed in April 2018 with
construction to start in June. The design of the remaining areas will be completed by October 2018,
construction starting in January 2019, and being completed by January 2020.
The project is located in COUNCIL DISTRICTS 2 and 7.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Water Capital Fund and the Sewer Capital Projects Fund - Legacy. The Fiscal Year 2017 Water
Operating Fund Budget includes appropriations of$21,060,000.00 for the purpose of providing Pay-As-
You-Go funding for Water Capital Projects. After this transfer for Fiscal Year 2017, the balance will be
$80,608.00. The Fiscal Year 2017 Water Operating Budget includes appropriations of$31,636,073.00 for
the purpose of providing Pay-As-You-Go funding for Sewer Capital Projects. After this transfer for Fiscal
Year 2017, the balance will be $2,874,121.00.
