FIRST AMENDMENT TO
CITY SECRETARY CONTRACT NO. 48170
THIS THIRD AMENDMENT to City Secretary Contract No. 48170 is entered into by
and between the City of Fort Worth ("City"), a home-rule municipality in the State of
Texas, acting through Fernando Costa, its duly authorized Assistant City Manager, and
TRC Environmental Corporation (TRC), a Connecticut corporation, registered to conduct
business in Texas ("Contractor"), acting through Jason Leik, P.E., its duly authorized
Program Manager.
WHEREAS, the City and TRC have entered into that certain agreement identified as City
Secretary Contract No. 48170 (also the "Contract") commencing on September 15, 2016
for asbestos and lead assessment and remediation services as authorized by Mayor and
Council Communication C-27904; and
WHEREAS, municipal contracts for services are exempt from the provisions of Chapter
252 of the Texas Local Government Code under the General Exemption provided for
procurements necessary to preserve or protect the public health or safety of a
municipality's residents; and
WHEREAS,the parties agree that all other conditions, terms, and pricing shall remain the
same as stated in City Secretary Contract No. 48170;
NOW, THEREFORE, for and in consideration of the mutual covenants contained herein,
and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged and confessed, the parties hereto agree as follows:
1. Additional Scope of Sevices to be Provided:
City Secretary Contract number 48170 is amended to include within the scope of services
the provision to provide third-party asbestos abatement consulting and project
management services as required by the Texas Department of State Health Services. All
asbestos abatement consulting and project management services shall be in conformance
with all applicable federal, state, and local laws and using best engineering, safety,
record-keeping, and management practices applicable.

other terms and conditions as stated in City Secretary Contract number 48170.
3. Miscellaneous:
All other definitions, terms, and conditions of City Secretary Contract number 48170
shall remain unchanged except as expressly set forth herein.

HEARING:
SUBJECT: Authorize Execution of a Professional Services Contract with TRC Environmental
Corporation in the Amount of$436,500.00 for Environmental, Engineering, and Industrial
Hygiene Consulting Services to Support the Environmental Capital Improvement Program
for Abatement of Asbestos-Containing Materials and Lead-Based Paint (ALL COUNCIL
DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of a Professional Services Contract
with TRC Environmental Corporation for environmental, engineering, and industrial hygiene
consulting services in support of environmental capital improvement projects that abate asbestos-
containing materials and lead-based paint in the amount of$436,500.00. (ENV 16-06 CIP-ACM/Pb)
DISCUSSION:
This Professional Services Contract provides environmental, engineering, and industrial hygiene
consulting resources to support projects within the Environmental Capital Improvement Plan (CIP) for
asbestos-containing material and lead-based paint abatement. Professional services will enhance
existing Staff resources to evaluate asbestos-containing materials and/or lead-based paint in and on
public properties located throughout the City. Fort Worth has a rich history, and unintended residual
environmental pollutants from past practices do exist within some structures in the built environment.
Abatement efforts must be taken by property owners and/or government agencies. Staff has
identified public projects that require lead-based paints and/or asbestos-containing materials to be
abated.
Third-party professional services are used to evaluate site conditions and to prepare any site-specific
subsequent abatement plans. Professional services provided under this contract will include the
design of strategic remediation activities at each project site in accordance with state and federal
environmental compliance to include the Clean Air Act (CAA); Clean Water Act(CWA); National
Emissions Standards for Hazardous Air Pollutants (NESHAP), Resource Conservation and Recovery
Act (RCRA), and Comprehensive Environmental Response, Compensation, and Liability Act
(CERCLA). This professional services contract is a new contract and has not been awarded in
previous years.
Capital projects which are supported by this professional services contract to begin in Fiscal Year
2016, in accordance with the Environmental CIP, include:
1. Planned Police West Division Office Asbestos Abatement Project
2. Former KXAS Police Building Asbestos Abatement Project
3. Will Rogers Coliseum Concourse Asbestos Abatement Project
4. Convention Center Arena Asbestos Abatement Project
5. Village Creek Water Reclamation Facility Centrifuge Asbestos and Lead Paint Abatement
Project
6. City Hall Annex and Gordon Swift Lead Paint and Asbestos Remediation Project

A Request for Qualifications (RFQ) for professional services to offer third-party evaluation and any
subsequent engineering plan design was advertised on March 9, 2016. Responses were submitted
by the following nine firms on April 14, 2016:

9. Vertex Companies, Inc.
The submittals from each of the nine firms were reviewed and rated, by committee, based on the
published weighted selection criteria. TRC Environmental Corporation was selected as the most
highly qualified respondent, based on demonstrated competence and qualifications provided in the
Statement of Qualifications (SOQ)to perform the services in accordance with Chapter 2254 of the
Texas Government Code.
These environmental and engineering services are one component of the overall project that includes
design, project management, remediation, inspection and contingencies.
Upon completion of the whole project there is no anticipated impact to the Environmental Protection
Fund operating budget.
M/WBE OFFICE: TRC Environmental Corporation is in compliance with the City's BIDE Ordinance by
committing to 32 percent SBE participation. The City's SBE goal on this project is 10 percent.
This contract serves the entire city.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds will be available in the current capital budget, as
appropriated, of the Environmental Protection Capital Project Fund.
