HomeMy WebLinkAboutResolution 3715-03-2009 A Resolution NO. 3715-03-2009 AUTHORIZING A PREFERENCE TO VENDORS THAT MEET OR EXCEED ANY STATE OR FEDERAL AIR-QUALITY STANDARD, INCLUDING VOLUNTARY STANDARDS WHEREAS, air pollution is a significant environmental issue that can threaten human health and negatively impact the ecological systems of the planet; and WHEREAS, the DFW region is classified as a moderate non-attainment area under the Environmental Protection Agency's eight-hour ozone standard; and WHEREAS, in order to improve air quality and meet state and federal regulations in the DFW region, air pollutants must be reduced; and WHEREAS, the air pollutants identified as NOx, volatile organic compounds (VOCs), particulate matter (PM), carbon dioxide (CO2), and carbon monoxide (CO) contribute to climate change and related environmental degradation; and WHEREAS, the sources of these air pollutants include vehicles, construction equipment, and stationary"point sources" such as large-scale process heaters, boilers, incinerators, metal production facilities, aggregate kilns, lime kilns, cement kilns, and any other point-source polluters identified by the North Central Texas Council of Governments (NCTCOG); and WHEREAS, Section 271.907 of the Local Government Code allows the City to give a preference to vendors that meet or exceed state and federal air-quality standards; and WHEREAS, the City of Fort Worth is committed to exercising environmental stewardship by developing and implementing policies to improve the health of its citizens and to ensure protection of the environment; and WHEREAS, on October 2, 2007, the City Council adopted Resolution No. 2536-10- 2007 assigning preferential-purchase priority for cement kilns with an emission rate of 1.7 pounds of NOx per ton of clinker or less; and WHEREAS, new standards for regulating the sources of air pollutants from cement kilns became effective in 2009; and ORT WORT RESOLUTION NO. 3715-03-2009 WHEREAS, the City Council deems it is in the City's best interest to revise its bid policy to comply with the new state standards, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: SECTION 1. The City Manager is hereby authorized to implement the purchasing preference specified in Texas Local Government Code Section 271.907 in order to improve the air quality in the City of Fort Worth and the DFW region. SECTION 2. Section 271.907 authorizes the City to give preference to a vendor that demonstrates that it meets or exceeds any state or federal air-quality standards, including voluntary standards; or requires that a vendor demonstrate that it meets or exceeds any state or federal air-quality standards, including voluntary standards. SECTION 3. The City Manager may apply the preference only if the cost to the City for the goods or services would not exceed 105 percent of the cost of the goods or services provided by a vendor that does not meet the standards. SECTION 4. By adopting this resolution the City Council shall repeal the policy adopted on October 2, 2008, by Resolution No. 3536-10-2007. APPROVED Adopted this I01 day of March, 2009.
