HomeMy WebLinkAboutOrdinance 22866-09-2017 Ordinance No. 22866-09-2017 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF $369,507.00 IN THE SEWER BOND 2017A FUND, FROM AVAILABLE FUNDS, FOR STREET REHABILITATION ON OLD DECATUR ROAD FROM BAILEY BOSWELL ROAD TO BUSINESS HIGHWAY U.S. 287; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the amount of$369,507.00 in the Sewer Bond 2017A Fund, from available funds, for street rehabilitation on Old Decatur Road rom Bailey Boswell Road to Business Highway U.S. 287. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22394-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. COUNCIL ACTION:_Approved on 9/12/2017 - Ordinance No. 22866-09-20 DATE: Tuesday, September 12, 2017 REFERENCE NO.: **C-28371 LOG NAME: 60INTERLOCALWTC-OLD DECATUR ROAD SUBJECT: Authorize Execution of an Interlocal Agreement with Tarrant County with City Participation in the Amount of $369,507.00 for Street Rehabilitation on Old Decatur Road from Bailey Boswell Road to Business Highway U.S. 287 and Adopt Appropriation Ordinance (COUNCIL DISTRICT 7) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Bond 2017A Fund in the amount of$369,507.00; and 2. Authorize Execution of an Interlocal Agreement with Tarrant County with City participation in the amount of$369,507.00 for street rehabilitation on Old Decatur Road from Bailey Boswell Road to Business Highway U.S. 287 (City Project No. 002304). DISCUSSION: Via a construction contract with S.J. Louis Construction of Texas, Ltd, the Water Department recently completed the installation of a 48-inch water main on Old Decatur Road from Bailey Boswell Road to Business Highway U.S. 287. This portion of Old Decatur Road passes through the City of Fort Worth, the City of Saginaw and Tarrant County. The original plan was to conduct permanent asphalt paving repair to a 10 foot wide strip of the roadway underneath which the water main was installed. However, Tarrant County approached Staff about totally rehabilitating the roadway in lieu of permanent repairs, as part of an Interlocal Agreement between the City and the County. To this end, Tarrant County has agreed to enter into an Interlocal Agreement for the rehabilitation of Old Decatur Road from Bailey Boswell Road to Business Highway U.S. 287. Under the Agreement, Tarrant County will provide all necessary labor and equipment to perform this work and the City agrees to pay for the cost of materials and other incidentals. Construction for this project is to start in October 2017 and be completed in December 2017. This project will have no impact on the Water Department's Operating Budget when complete. The project is located in COUNCIL DISTRICT 7. This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the Logname: 60INTERLOCALWTC-OLD DECATUR ROAD Pagel of 2 attached appropriation ordinance, funds will be available in the Water& Sewer 2017A Bond Fund for this Interlocal agreement for the Northside II Phase II 48-inch Main Project. After this transfer, the balance of $4,138,621.00 will be available in the 2017A Water& Sewer Bond Fund.
