AMENDMENT No.1 TO CITY SECRETARY CONTRACT No. 47997 WHEREAS, the City of Fort Worth (CITY) and Dunaway Associates L.P. , (ENGINEER) made and entered into City Secretary Contract No. 47997, (the CONTRACT) which was administratively authorized by M&C 27806 on the 28 day of June , 2016 in the amount of $293, 763; and WHEREAS, the CONTRACT involves engineering services for the following project: RANDOL MILL RD IMPROVEMENTS (INTERSTATE 820 TO PRECINCT LINE RD) ; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated September 25, 2017, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $166,910. 00. (See Attached Funding Breakdown Sheet, Page -3-) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $166, 910. 00. 3 . City of Fort Worth Transportation & Public Works Department Infrastructure Design and Construction Group Fort Worth, Texas 76102 Reference: Task Order Contract-Amendment No. 1 Randol Mill Road Paving and Drainage Improvements Project City Project No. 100278 Ms. Ojeda: This letter constitutes formalization of your request for changes in the scope of the current contact and our request for supplemental authorization for Tasks outside the scope of services of the current contract and amendments. Dunaway will provide the following: SCOPE OF SERVICES The scope set forth herein defines the work to be performed by the ENGINEER in completing the project. Both the CITY and ENGINEER have clearly defined the work to be performed and address the needs of the Project according to objectives listed below: WORK TO BE PERFORMED Task 1. Project Management Task 2. Final Design 90% & 100% Task 3. Subsurface Utility Exploration (S.U.E.) Services TASK 1. PROJECT MANAGEMENT ENGINEER will manage the work outlined in this scope to ensure efficient and effective use of ENGINEER's and CITY's time and resources. ENGINEER will manage change, communicate effectively, coordinate internally and externally as needed, and proactively address issues with the CITY's Project Manager and others as necessary to make progress on the work. Anticipated project design timeline is 6 months. 1.1. Managing the Team • Lead, manage and direct design team activities. • Task and allocate team resources. • Communicate internally among team members. • Ensure quality control is practiced in performance of the work. Communications and Reporting • Attend a public meeting with Temple Baptist School staff to give status update on the project and construction schedule. Attend a public meeting with General Public to give a design status update prior to finalizing the project design. Prepare three (3) large hard copy exhibits for each part of the project and assist with City PowerPoint presentation slides. • Conduct and document additional bi-weekly project update meetings with CITY Project Manager. Prepare and submit bi-weekly status reports in the format provided by the TPW Department to the CITY Project Manager and post on Buzzsaw. • Conduct submittal review meetings with the CITY at the end of each design phase, and interim meeting with Water Department staff. ASSUMPTIONS • Two (2)additional public meetings will be held during final design phase. • Six (6) additional bi-weekly project status meetings and reports included. • Two (3) additional submittal review meetings included with City staff. DELIVERABLES A. Public Meeting Exhibits (3 Total) B. Bi-weekly status reports (6 Total) C. Meeting minutes with action items TASK 2. FINAL DESIGN (90 and 100 PERCENT) Final plans and cost estimate shall be submitted to CITY per the approved Project Schedule. 2.1. Development of Final Design Drawings shall include the following: • Revise Construction Plans to remove Old Randol Mill Rd segment since City could not obtain City right of way parcel during final design. Removed unnecessary paving sheets, revised the removal plans, pavement marking plans, street light and signage plans, cross sections, typical section sheets, easement map, and sheet index. • Split current project into Two (2) Separate Parts: Part 1 Left-Turn Lane Segment Only and Part 2 Roundabout plans for separate Task Order Construction Contracts. Create separate sets of plans with new cover sheets, sheet index, re- numbering of all sheets, split project sheet viewports and adjusted profiles in each set. • Revise Storm Drain Plan and Profiles for Culverts A and B extensions. Incorporated results of new offsite survey downstream near West Fork of Trinity River and upstream at Temple Baptist School for Culvert B. Added additional City of Fort Worth,Texas Amendment#1 Page 2 of 6 surveyed areas to the plans and finalized modeling and design for Culvert A. Incorporate final hydraulics and design changes resulting from supplemental drainage model. • Revise Drainage Ditch Plan and Profiles at Roundabout to City selected storm event from supplemental drainage study results. • Additional Storm Drain Profiles for new Roundabout Culverts C & D based on new City Comments from the 60% review with City's sub-consultant. Culvert C to be replaced under Randol Mill Rd on east leg of Roundabout. Culvert D to be added at new driveway on NE quadrant of Roundabout within new drainage easement. • Add new design to replace existing 3'x2' Box Culvert w/ new 36" RCP at Culvert B, based on results of CCTV video and City instructions to replace it after 60% review had taken place. Replace 3'x2' box culvert in order to keep pipe the same size to match proposed 36-inch pipe up and downstream of the box location underneath Randol Mill Rd. • Revise 90% and 100% OPCC's resulting from splitting of plans and scope quantity changes previously listed into two (2) separate plan parts. 2.2 Design Budget—Carryover from 2014 Engineering Agreement that was cut short by City. Budget was cut from previous design contract and was told to be added to this Amendment#1 by City Project Manager. Effort was spent designing 60% plans, but was never able to be billed to the City from original contract. Moving this budget over allows for this effort to be billed for now. 2.3 CCTV Video and Report of existing 36-inch Culvert B needed to locate missing headwall. City instructed us to use exploration method to locate missing headwall, since survey field crews could not find the headwall in the field. A CCTV video was used to locate headwall and a report was provided to the City. Video was used by surveyor to help locate missing headwall and allow it be added to the construction plans. 2.4. Supplemental Drainage Reports - Supplemental HEC RAS Drainage Models will be prepared and analyzed for each major culvert and drainage system within the project limits as follows: • Culverts A& B locations— Model existing and proposed conditions through each existing culvert near Temple Baptist School. Review pre and post flow conditions and backwater elevations with each model. • Evaluate drainage capacity for Roundabout and adjacent drainage ditches. Model height of water over Randol Mill Rd and affects from upstream drainage crossing the road. • Prepare and submit Final Supplemental Drainage Study Reports to City for all 3 locations, and review with staff. ASSUMPTIONS • All storm water calculations shall conform to the 2015 CITY iSWM Criteria Manual for Site Development and Construction (iSWMM). All storm water design City of Fort Worth,Texas Amendment#1 Page 3 of 6 shall conform to iSWMM where possible, any deviations will be agreed upon between the CITY and the ENGINEER in writing and noted in the plans. • 3 sets of half-size and 2 sets of full-size plans will be delivered for the 90% and 100% design. • 5 sets of OPCC's will be delivered for the 90% and 100% design. • DWF files and PDFs created from design CAD drawings will be uploaded to the designated project folder in Buzzsaw. • All submitted documents and checklists will be uploaded to the designated project folder in Buzzsaw. • 85 Sheets per Part 1 and 2 will be assumed for 90% and 100% submittals to City, with a grand total of 170 sheets assumed. Final SUE Plan Drawings and Test Hole Reports E. Opinion of Probable Construction Cost (OPCC) TASK 3. SUBSURFACE UTILITY EXPLORATIION (S.U.E.) SERVICES 3.1 — Level B S.U.E. for Randol Mill Rd • Prepare final Level B S.U.E. sheets and DWG CAD files for entire project limits based on original project scope started prior to this contract. • Level B S.U.E. information will be incorporated into the project survey and construction plans to be used for final 90% and 100% design submittals for the project. 3.2— Level B S.U.E. for Roundabout location • Prepare final Level B S.U.E. sheets for Roundabout limits and along Precinct Line Rd north of Randol Mill Rd. The Level B S.U.E. was added at this location since original S.U.E. scope from 2008 did not include a Roundabout. • Level B S.U.E. information will be incorporated into the project survey and construction plans to be used for final 90% and 100% design submittals for the project, and for coordination with existing franchise utility gas companies that are located at the Roundabout location. Required) • Prepare up to 15 (fifteen) Level A test holes for Randol Mill Rd and the proposed Roundabout limits and along Precinct Line Rd north of Randol Mill Rd. • Include all Level A test hole result information on all of the construction plan sheets per City Water Department's requirement. • Test Hole Data Report sheets will be provided for each located utility onsite including type of utility located, material, x, y horizontal coordinates including z elevation coordinate to top of buried utility. DELIVERABLES • Final SUE Plan Drawings and Level A Test Hole Reports ADDITIONAL SERVICES NOT INCLUDED IN THE EXISTING SCOPE OF SERVICES Additional Services not included in the existing Scope of Services — CITY and ENGINEER agree that the following services are beyond the Scope of Services described in the tasks above. However, ENGINEER can provide these services, if needed, upon the CITY's written request. Any additional amounts paid to the ENGINEER as a result of any material change to the Scope of the Project shall be agreed upon in writing by both parties before the services are performed. These additional services include the following: • Negotiation of easements or property acquisition. • FEMA floodplain modeling. • CDC Floodplain Permitting for Trinity River Basin. • Negotiation of Utility Relocations. • S.U.E. services beyond defined scope of this amendment. • Construction management and inspection services. Amendment#2 (Project#01809—Remaining Fee$201,430 Authorized w/Scope Change) • Scope options were evaluated from the previous study, but City requested a Roundabout be completed instead of a 3-way stop. • Amendment#2 and remaining fee was re-scoped and used get through 60%design. • Amendment#2 and Project#01809 was closed out by City and fee was reduced. Proiect#100278 Task Order Contract#1 (Proiect#100278—Fee$293,763 approved) • Task Order Contract#1 was setup to complete the current project scope and plans to 90%and 100% Design levels, Bid Phase and Construction Admin services. Task Order Contract#1—Amendment#1 (Proiect#100278—Fee$166,500) Proiect Management • Additional PM time was spent to attend separate submittal review meetings, bi- weekly project status meetings, and public meetings for the Roundabout and Left- Turn Lane segments after plan sets were split up. • Left-turn lane segment was setup as a separate Task Order Contract and additional PM time was needed to get Task Order prepared with Halff and the Fain Group in order to accelerate this part of the project to construction for summer 2017. Page 113 7/27/2017 Final Design • Additional time was needed to revise the plans and remove the Old Randol Mill Rd intersection design from the Left-Turn Lane plan set, due to the City not being able to secure the ROW parcel at this intersection. • Additional design time was needed to split up the plan sets into Roundabout and Left- Turn Lane segments and reorganize and trim the base files and clean up the sheets in both sets. • The original contract drainage study, scope and criteria were different and could not be used again for Left-Turn Lane nor the Roundabout design. • Culverts A& B were revised based on model results and Culvert A criteria was changed to go ahead and replace with a new 36" RCP after CCN results showed a changed in pipe type under Randol Mill Rd within the right of way. • Culverts C and D were added at the Roundabout after 60% comments received from Halff, and after original City PM instructions were to leave both culverts in place and just clean them out. • City TPW Drainage Staff changed criteria from 1-yr storm event in bar-ditches to be 2- year at the Roundabout after the 60% review, causing re-design and re-grading at Roundabout to provide more capacity. • Revisions to 90%and 100%OPCC's from changes to plans. • The original Amendment#2 design scope was to only extend existing culverts without any detailed drainage studies, with the goal of not making it worse than existing conditions, without using typical iSWM requirements. • Supplemental drainage modeling and reports were requested by City for all Culverts and the Roundabout. These were needed for the City's documentation and file. • City Park's department added landscaping design and comments at the 90% level for the Roundabout center island, and additional landscaping sheets are needed to incorporate their comments into the 100% Roundabout plans now. • City Water Department added approximately 550 LF of proposed 8-inch waterline to the contract to replace an existing 2-inch waterline along Old Randol Mill Rd, and an isolation valve and location map with one (1) proposed water plan sheet were added to the Left-Turn Lane plans at a 100% level. We had to hold a special meeting with Water Field Ops in order to hustle and get this last minute request into the 100%plans and Task Order with the Fain Group. • $14,802 of the Amendment#2 (#01809) design fee was cut out after design services were already completed, but were not allowed to invoice the City. SUE Services • $12,600 of SUE fee was cut from Amendment #2 (#01809) and added to this amendment for Final SUE sheets completed by the Rios Group during 90%design. Page 213 7/27/2017 • The Roundabout was added after original study phase and the original Level B S.U.E. efforts spent didn't cover the Roundabout limits north along Precinct Line Rd. This additional Level B S.U.E. was needed to cover the Roundabout and major gas lines that crossed the project limits. • After the 60% review in October 2016, the City Water Department starting enforcing Level A Test holes to be completed on all of their City owned water and sanitary sewer lines,and this revised scope included adding 15 new Level A Test Holes to the project. Workflow and LOE hours explanation for Proiect Manager and Project Engineer: Project Management Tasks 1.1.1— Hours are equal for one-on-one task delegation from PM to Project Engineer. 1.1.2 — PM time used for QC review of completed design changes to removal plans and drainage sheets. Authorize the execution of an Amendment No. 1, in an amount not to exceed of$170,000.00, to the Engineering Services Agreement, City Secretary No. 47997, with Dunaway and Associates, L.P., for the final design of Randol Mill Road from Stoneview Circle to east of Precinct Line Road including construction management services for a revised contract amount of$463,763.00; 2. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the Transportation Impact Fee Capital Legacy Fund in the amount of$160,093.85 from available funds; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Transportation Impact Fee Capital Fund in the amount of$79,906.15 from available funds. (CPN 100278) DISCUSSION: The 2014 Bond Program provides funding for improvements along Randol Mill Road from Precinct Line Road to Stoneview Circle. In addition, transportation impact fee revenue from Service Area M will be used to partially fund the construction of the improvements. These improvements include a roundabout at Precinct Line Road, reconstruction of the existing roadway to its ultimate 3-lane configuration between Loop 820 and east of Old Randol Mill Road and design of such improvements. On June 28, 2016, City Council approved Mayor and Council Communication (M&C) C-27806 authorizing execution of an engineering services Agreement, City Secretary No. 47997, with Dunaway and Associates to provide complete design plans for improvements to be delivered under the 2014 Bond Program. This Amendment will provide for additional professional engineering and construction phase services associated with scope changes as necessary to deliver the project in two construction phases. The changes included splitting the design plans in two phases: 1) Left-turn lane near the school and 2) Roundabout at Precinct Line Road. Additional work has to be performed as well for water/sewer utility relocation, sub surface utility engineering and additional drainage design to update the drainage report. Dunaway and Associates, L.P., proposes to perform these professional services in an amount not to exceed $170,000.00. Staff considers this fee to be fair and reasonable for the scope of services to be provided. Therefore Dunaway and Associates, L.P., remains in compliance with the City's M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company. In order to complete the construction during the summer months and in an expedited manner, the Fain Group was selected. A task order was executed to complete the work. A portion of this project will include 2014 Bond Funds. Available resources within the General Fund will be used to provide interim financing for these expenses until debt is issued. Once debt associated with this project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official intent to reimburse, that was adopted as part of the ordinance canvassing the bond election (Ordinance No. 21241-05-2014) and subsequent actions taken by the Mayor and City Council. This project is located in COUNCIL DISTRICT 4.
