HomeMy WebLinkAboutOrdinance 18293-09-2008Ordinance No. 18293-09-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND UP TO $750,000.00 SUBJECT TO RECEIPT OF A DISASTER RELIEF GRANT FROM THE DEPARTMENT OF HOMELAND SECURITY/FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA) FOR THE PURPOSE OF PROVIDING DISASTER RELIEF ASSISTANCE TO THE VICTIMS OF HURRICANE GUSTAV; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2007- 2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund up to $750,000.00 subject to receipt of a disaster relief grant from the Department of Homeland Security/Federal Emergency Management Agency (FEMA) for the purpose of providing disaster relief assistance to the victims of Hurricane Gustav. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager to apply for and accept, if awarded, a grant from the Department of Homeland Security, Federal Emergency Management Agency in the amount of $750,000.00 to provide disaster relief assistance to the victims of Hurricane Gustav seeking refuge in the City of Fort Worth; 2. Authorize anon-interest bearing inter-fund loan from the General Fund to the Grants Fund in the amount of $750,000.00 for interim financing of this grant project pending contract execution; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund up to $750,000.00, subject to receipt of the funds; and 4. Ratify expenditures and contracts related to the City's response to Hurricane Gustav in an amount not to exceed $750,000.00. DISCUSSION: On August 28, 2008, Governor Perry issued a disaster declaration for Texas and asked for Federal Emergency Assistance for Hurricane Gustav. On August 29, 2008, the Mayor signed a Declaration of Local Disaster for the City of Fort Worth in order to assist evacuees. Prior to landfall, Louisiana and Texas residents in the expected path of Hurricane Gustav were ordered to leave. Hurricane Gustav hit Louisiana September 1, 2008, and the Federal,, Government declared the resulting devastation a national disaster. The States of Texas and Louisiana requested that the City provide a variety of emergency resources to assist the evacuees. On September 2, 2008, the City Council approved a Resolution for Continuation of Local Disaster for the City of Fort Worth. The Department of Homeland Security, through the Federal Emergency Management Agency (FEMA), will make funding available for disaster response and relief to Hurricane Gustav evacuees seeking refuge in neighboring states and cities. The City provided assistance to these evacuees and is eligible to receive reimbursement from FEMA for eligible costs and expenses relating to assisting them, including but not limited to, costs and expenses for temporary shelter, security, medical support, food, water and other logistical needs.
