AMENDMENT NO. 3 STATE OF TEXAS S CITY SECRETARY CONTRACT NO.`rt�.�' (M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Kimley-Horn and Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 29706, (the Contract) which was authorized by the City Council by M&C C-20000 on the 23th day of March 2004 and subsequently revised by two previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Rehabilitation Contract LXX (70) WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the addition- al engineering services specified in M&C C-21208, adopted by the City Council on the 20th day of December 2005, and further amplified in a proposal letter dated August 22, 2005, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $66,260.00. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sun of $577,275.00. 3. All other provisions of the Contract which are not expressly amended herein shall remain in full force and effect. As part of the scope of services, a design survey was completed in August 2004. After survey work was completed, and during the design phase, Union Pacific performed significant construction for two additional tracks to their Fort Worth Centennial Rail Yard Facility in the vicinity of the Hulen Street Bridge. As a result, M-134R had to be redesigned to reflect new field information, requiring some realignment and adjustments to the profile. In order to provide the most up-to-date information for bidding and construction, the City instructed Kimley-Horn to re-survey the area altered by Union Pacific construction. Item 2 (M-439* Drainage Area Study) Due to requirements by the City's Transportation and Public Works Department, Kimley-Horn performed a drainage area study related to the impacts of removing the obstruction on the existing 48" sanitary sewer line point repairs (M-439*). Worth and TxDOT storm sewer system was not part of the original scope of services. Unit 3 Item 1 (Additional Units and Bidding Documents) • The City has requested Kimley-Horn to prepare the following bidding packages associated with Contract 70: o Bidding Package l - Unit I (M-134R* and M-439) o Bidding Package 2 - Unit II (M-199) o Bidding Package 3 - Unit III (M-134 and L-3782) o Bidding Package 4 - Unit IV (Remainder of sanitary sewer laterals included in Contract 70) ■ Note: since it appears that this bid set will not be released for bidding for some time, we will submit an amendment for this bidding package at a time closer to the time of bidding. • To achieve this, an additional bidding package will need to be added to the contract for Unit 3. Unit 4 Item 1 (L-991 Additional Services) The City has hired a separate consultant to design the rehabilitation of Birchman Road, located just north of L-991 (a 6" sewer line located in an alley between Birchman Road and Calmont Avenue). Included in this project is abandoning L-2576 (a 6" sewer line located in Birchman Road) and relocating services from L-2576 to L-991. Originally, our scope included only the rehabilitation of L-991 without relocating any services from L-2576. It was determined that four(4) lots will need to have their sanitary sewer services relocated from the front (L-2576) to the back (L-991). In order to relocate these services additional work is required beyond what was included in the original contract.. We, therefore, respectfully request an amendment to our contract to provide services related to resolving this issue as outlined in the following tasks. Scope of Services The scope of services for this amendment is divided into the following tasks: Unit 1 Item 1 (Re-survey and Re-design of M-134R*): $4,000 KHA 2,75 Survey $6,750 Total • Task 1 — Field investigation, re-survey, and re-design of M-134R within the Union Pacific Centennial Rail yard. Provide a topographic survey showing above ground features that varied from the original survey within the limits of Vickery Boulevard across the Union Pacific Rail yard to the Clear Fork of the Trinity River Crossing. • Task 2 —Design phase services including production of a plan and profile sheet with updated topographic and control information for the proposed utility improvements to reflect existing conditions as instructed by the City of Fort Worth. Item 2 (M-439* Drainage Basin Study): $26,500 • Task 1 — Data collection of the drainage area related to the storm drain system from the intersection of University Drive and Interstate 30, south to the University Drive Bridge at the Clear Fork of the Trinity River, and from Rogers Road west to the Clear Fork of the Trinity River includes: o Document research of record drawings of City of Fort Worth Utilities near the location of the drainage area. o Receive existing digital contour maps from the City of Fort Worth. o Obtain record drawings from Texas Department of Transportation (TxDOT) for the drainage area from Rosedale north to Interstate 30 and document findings. o Additional coordination with Union Pacific Railroad to determine requirements for long-tern by-pass pumping and access to rail yard. o Perform field investigation to verify existing utilities. o Perform field survey to determine finished floor elevations for existing buildings in the drainage area. a __ is C_ Klmley-Ii0fn Mr.Liam Conlon,August 22.2005r Page 4 I and Associates, Inc. • Task 2 -Review data to determine characteristics of existing drainage basin and perform field investigation to verify findings includes: o Compile data from City of Fort Worth and TxDOT to determine drainage basin history and current characteristics. o Prepare an exhibit summarizing findings. Prepare for and conduct meetings with City of Fort Worth employees in the Water Department, Department of Engineering, and Transportation/Public Works Department to discuss additional requirements. • Task 3 - Determination of possible impact of proposed work on M- 439* to the water surface elevation on University Drive includes: o Review drainage calculations for existing storm drain facilities including: ■ 42-inch storm drain pipe from the Trinity River to the west along the north side of the Union Pacific Railroad tracks until the underpass at University Drive. ■ 42-inch Rosedale Improvements project constructed by the TxDOT. ■ 30-inch storm drain on the east side of University Drive just south of Rosedale, designed by the City of Fort Worth. • 24-inch storm drain system constructed in conjunction with the University Park Village project on the west side of University Drive between Rosedale and Collinsworth. o Based on the review of existing storm drain facilities, perform a hydraulic analysis to determine the approximate pipe capacity of the 30-inch storm drain pipe on the east side of University Drive and the change in water surface elevation on University Drive as a result of the proposed construction included in Sanitary Sewer Contract 70 Unit 1. o Prepare plan view containing field survey data and cross sections of University Drive every 100 feet from Interstate 30, south to the University Drive Bridge at the Clear Fork of the Trinity River. o Analyze change in water surface elevation on University Drive using Flowmaster software by Haestad Methods. • Task 4 - Prepare technical letter to evaluate the impacts of a 100-year rainfall event to the storm drainage system associated with the proposed M-439 sanitary sewer improvements. Unit 3 $14,200 KIIA 3,300 Reproduction Expenses $17,500 Total Item 1 (Additional Unit and Bidding Document): • Task 1 — Preparation of a bidding package as required by the City. o Included in this task is the design work required for preparing an additional bidding package including: preparing an additional set of construction plans and specifications, quality assurance and quality control, preparing engineer's opinion of probable construction cost, as well as additional submittal and approval time with City staff. • Task 2—Reproduction costs for the additional unit and set of bidding documents required by the City. o The City has instructed Kimley-Horn to prepare bidding and construction contract documents as described above. Bidding and contract documents will be prepared in accordance with the current scope of services for Contract 70 with the City of Fort Worth with the exception of conceptual plans. • Task 3 — Pre-construction assistance for the additional unit and set of bidding documents required by the City. o This task includes preparation and delivery of addenda to plan holders and responses to questions submitted to the DOE by prospective bidders. Also included is attending the scheduled pre-bid conference, assisting in reviewing the bids for completeness and accuracy, attending the project bid opening, developing bid tabulations in hard copy and electronic format, and submitting four (4)copies of the bid tabulation • Task 4 — Construction phase services for the additional unit and set of bidding documents required by the City. o The additional set of bidding documents will require additional construction services. Construction services will be provided in accordance with the current scope of services for Contract 70 with the City of Fort Worth with the exception of site visits provided for Unit 1. o Kimley-Horn will provide four (4) additional site visits for construction period observation for Unit 1, for a total of five (5). Due to the increased complexity of the project and notoriety of the location, we feel that additional site visits might be needed to insure that the contractor is complying with the Engineer's and the City's intent. Unit 4 $10,010 Expedited Survey (SAM, Inc.) 5,500 KHA $15,510 Total Item 1 (L-991 Additional Services) • Task 1 —At the request of the City, Baird, Hampton&Brown (BHB), the City's hired consultant for the Birchman Road project asked KHA to include the design for L-991 in the construction documents for Birchman Road. This request included relocating services from Birchman Road to L-991 that was not in the original scope of work. In order to meet the project schedule, an expedited survey had to be completed. • Task 2 — Identify and seek to obtain data for existing conditions that may impact the project including utilities and property ownership. • Task 3 — Perform private service line design for four (4) lots to be relocated from L-2576 to L-991 (not in original scope of work). o Visit site to locate services and coordinate with surveyor. o Evaluate relocation alternatives based on field survey and site visits. Re-design L-991 profile to accommodate relocated services. Prepare plan sheet for proposed sanitary sewer service realignments. Prepare opinion of probable construction cost. Coordinate with City and other consultant to include project in design of Birchman Road Project. We recommend that the City increase the budget by$66,260 for these additional services. Kimley-Horn will subcontract a portion of these services to S.A.M., Inc, a M/WBE subconsultant. The amount we will be subcontracting is $16,060. This represents an M/WBE participation percentage of 24.2% for these additional services. With these Additional Services, our revised contract amount will be $577,275. Authorize the transfer of $66,260.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$66,260.00 from available funds; and 3. Authorize the City Manager to execute Amendment No. 3 to City Secretary Contract No. 29706 with Kimley-Hom and Associates, Inc., in the amount of$66,260.00 for additional design, thereby increasing the contract amount to$577,275.00. DISCUSSION: On March 23, 2004, (M&C C-20000) the City Council authorized the City Manager to execute an engineering agreement with Kimley-Hom and Associates, Inc., in the amount of$408,450.00 for the design of Sanitary Sewer Rehabilitation Contract LXX (70). The agreement was subsequently revised by two amendments as follows: . Amendment No. 1 (M&C C-20334, October 12, 2004), in the amount of$62,629.50, provided for the necessary design to relocate an existing 30-inch sanitary sewer main to accommodate proposed rail line extension by Union Pacific Railroad at its Centennial rail yard facility as well as the rehabilitation of a sewer main located immediately downstream of the 30-inch sewer main. . Amendment No. 2 (M&C C-20486, January 1, 2005), in the amount of $39,935.50, provided for the necessary design to replace a severely deteriorated segment of sanitary sewer M-199R* located underneath the runway of the Naval Air Force Station (NAS) Fort Worth Joint Reserve Base. Amendment No. 3 will address the following: http://www.cfwnet.org/council_packet/Reports/mc_print.asp 12/20/2005 rage L of L After a majority of the initial design work was completed, it was determined that Union Pacific had made significant changes to the existing ground topography which required resurvey and redesign of the improvements proposed within the rail yard facility. The Transportation and Public Works Department has requested that a drainage area study be conducted to determine the exact capacity of an obstructing City and TxDOT storm drain system before allowing the disconnection of the storm drain system from an existing 48-inch sanitary sewer main on University Drive. Kimley-Hom and Associates, Inc., proposes to provide the necessary additional engineering services for a lump sum fee of$66,260.00. City staff considers this amount to be fair and reasonable. Kimley-Hom and Associates, Inc., is in compliance with the City's M/WBE Ordinance by committing to an additional 16% M/WBE participation on this amendment. The City's goal on this amendment is 16%. This project is located in COUNCIL DISTRICT 7, Mapsco 75R and 76N. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval and completion of recommendation 1, and the adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Sewer Capital Projects Fund.
