HomeMy WebLinkAboutResolution 2512A Resolution a~ No ~~t~ AUTHORIZING THE TRANSFER OF THE DFW RAILTRAN SYSTEM TO THE FORT WORTH TRANSPORTATION AUTHORITY AND DALLAS AREA RAPID TRANSIT WHEREAS the Cities of Fort Worth and, Dallas in 1984 acquired the Chicago Rock Island and Pacific Railroad line and WHEREAS the railroad line that connects the downtown business districts of both Cities was purchased in order to preserve it for future mass transit; and WHEREAS in 1984 the Cities established the DFW RAILTRAN System to manage the line and WHEREAS in 1989 Dallas Area Rapid Transit and the Fort Worth Transportation Authority (collectively the 'Transit Authorities') began planning for commuter rail service on the line and ,~ `WHEREAS in 1993 RAILTRAN renegotiated agreements with Burlington Northern Santa Fe Railroad and Union Pacific Railroad that allowed for the provision of ~ commuter rail service and ar, WHEREAS on December 31 1996 DART and the T began the first phase of commuter rail service on the RAILTRAN line between Irving and Dallas as Trinity Railway Express and WHEREAS ridership on the first phase of the commuter rail service has exceeded ridership forecasts and is extremely successful and WHEREAS the T has received full funding for the construction of the second phase of service and WHEREAS the Transit Authorities have demonstrated a commitment to the service and the ability to manage it; and WHEREAS the transfer of the Cities' interest in the line would facilitate more efficient operation and administration . = .~ . ~.~ ~-. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS 1 That the Cities of Fort Worth and Dallas shall transfer their interest in the RAILTRAN Corridor to the Transit Authorities by appropriate legal instrument approved as to form and legality by the City Attorney's offices 2 That the Transit Authorities interest should remain on an undivided basis 3 That in the event that the Transit Authorities should abandon the commuter rail service the Cities will have the option to regain their interest in the line 4 That the Cities shall always have the right to cross the RAILTRAN line with publicly-owned utilities at no cost. 5 That the Cities shall always have the right to use the fiber optics conduit currently in the RAILTRAN right-of-way for public use at no cost.
