AMENDMENT
TO CITY SECRETARY CONTRACT NO. 47600
STORMWATER FACILITY MAINTENANCE AGREEMENT
This AMENDMENT TO CITY SECRETARY CONTRACT NO. 47600,
STORMWATER FACILITY MAINTENANCE AGREEMENT is made and entered into by
and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County, Texas,
acting herein by and through its duly authorized City Manager or duly designated Assistant City
Manager, hereinafter referred to as the "City", and KROGER TEXAS L.P., acting by and
through Rick J. Landrum, Vice President of KRGP Inc., its general partner, hereinafter referred
to as"Landowner."
RECITALS
WHEREAS;the City of Fort Worth("City")and KROGER TEXAS L.P.made and entered
into City Secretary Contract No. 47600 (the "Agreement") to authorize the use of on-site
stormwater management facilities (the "Facility")to be constructed and maintained on a portion of
Landowner's property; and
WHEREAS, the Agreement was recorded with the property records of the Tarrant County
as document No.D216057564 which is one and the same as City Secretary Contract 47600.
WHEREAS, the Agreement contains exhibit(s) "A" and "B" that depict the location and
design specifications of the Facility; and
WHEREAS,it advisable to execute this Amendment to the Agreement to include exhibit(s)
"A-1" and "B-1" in the Agreement to depict an additional location being added to the original
agreement;and
NOW THEREFORE, City and Landowner, acting herein by and through their duly
authorized representatives,enter into the following that amends the Agreement:

1.
Exhibit A-1 is hereby added and attached hereto and incorporated herein to the Agreement,
consisting of a new description of an additional Facility.
2.
Exhibit B-1 is hereby added and attached hereto and incorporated herein to the Agreement,
consisting of design specifications of the additional Facility.
3.
This Amendment shall be filed with the City Secretary as an amendment to the Agreement
and also recorded among the land records of Tarrant County, Texas, and shall constitute a covenant
running with the land, and shall be binding on the Landowner, its administrators,executors, assigns,
heirs and any other successors in interests,including any property owners association.
4.
All other provisions of the Agreement which are not expressly amended herein shall remain
in full force and effect

County,Texas and being a portion of Lot 1 R, Block 1, Boswell Marketplace, an addition to the City of Fort Worth,Tarrant County,Texas
according to the plat thereof recorded in County Clerk's File No. D216277264, Plat Records,Tarrant County,Texas(P.R.T.C.T.),and
being all of the same Private Drainage Easement as dedicated by the plat of Boswell Marketplace, an addition to the City of Fort Worth,
Tarrant County,Texas according to the plat thereof recorded in County Clerk's File No. D216034100, P.R.T.C.T.,and being more
particularly described as follows:
BEGINNING at a 1/2 inch iron rod with red plastic cap stamped"WAI"found for the southwest corner of said Lot 1 R, Block 1 and being
situated in the north right-of-way line of West Bailey Boswell Road (variable width right-of-way),said iron rod also being situated in the
east line of Twin Mills, Phase I, an addition to the City of Fort Worth,Tarrant County,Texas according to the plat thereof recorded in

THENCE North 00 deg 05 min 14 sec West, departing said north right-of-way line and along the east line of said Twin Mills, Phase I, a
