AMENDMENT No. 6 CONTRACT NO. U �lG J
TO CITY SECRETARY CONTRACT
WHEREAIS, the City of Fort Worth (CITY) and Dannenbaum
Engineering Corporation, (ENGINEER) made and entered into City
Secretary Contract No. 28006, (the CONTRACT) which was authorized
by M&C C-19172 on the 30th day of July, 2002 in theamount of
$721,899.76; and
WHEREAS, the CONTRACT was subsequently revised by:
Amendment Number 1 in the amount of $111,800 .52 which was
authorized by M&C C-19936 on January 20 , 2004 and Amendment No.2
in the amount of $329,406.00 which was authorized by M&C C-22535
on November 27, 2007 and Amendment No. 3 in the amount of
$96,825 .00 which was authorized by M&C C-23578 on June 9, 2009
and Amendment No. 4 in the amount of $60,835.00 which was
authorized by M&C C-24794 on March 22, 2011 and Amendment No. 5
in the amount of $149,012.00 which was authorized by M&C C -28110
on February 14, 2017; and
WHEREAS, the CONTRACT involves engineering services for
the following project:
Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek
Parallel Relief Alignment Study and Design; and
WHEREAS, it has become necessary to execute Amendment No.
6 to the CONTRACT to include an increased scope of work and
revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the
additional engineering services specified in a proposal dated
August 8, 2017, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer totals $63,751 .00 .
2 .
Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall bean �}

Dear Mr. Kasavich:
Dannenbaum Engineering Corporation, (Dannenbaum or ENGINEER) is pleased to provide the City of Fort Worth
(CITY) with Amendment No.6 for the Sanitary Sewer Main 257 & 325 Middle and Upper Village Creek Parallel
Relief Alignment Study contract (the PROJECT). The CITY has asked Dannenbaum to perform additional services
under this contract for:
1) Re-design associated with increased sanitary sewer pipe size from 42-inch to 48-inch diameter.
2) Hydrovac Excavation services for utility locates at 9 proposed crossing locations for Parts 1 and 2 of the
PROJECT.
3) Survey associated with tying in the location and elevation of the 9 utility locates
4) Survey and easement preparation associated with access roadway easements east and west of PROJECT
crossing IH-35W.
These services are necessary because:
1) The City determined that it was more cost effective to rehabilitate the existing 18-inch to 24-inch Main
325 through Parts 1 and 2, than to replace it with a new 30-inch pipeline as recommended in the
DeOtte/Freese and Nichols Revaluation of the Village Creek Basin CIP Needs for Burleson's Peak Flow
Design Memorandum.This required that Main 325 Relief Sewer provide the additional capacity required
to offset the capacity reduction between the 30-in replacement and the 18-inch to 24-inch rehabilitation.
2) Subsurface locates of existing utilities at crossings of the proposed Main 325 alignment were not included
in prior scopes of work and the CITY's on-call utility locate contract has expired.
3) Hydrovac Excavation services only include GPS locations and measure-downs from the existing surface to
the utility. More accurate elevations and locations tied to PROJECT control are required for sewer pipeline
design.
4) In conversations with TxDOT regarding access permits,TxDOT indicated new access driveways located at
the proposed PROJECT crossing would be too close to nearby existing access driveways and violate their
minimum spacing requirements. To address this, we propose separate access roadway easements be
acquired that utilize existing gas well sites' access driveways and roadways.
The additional services required for this realignment are as follows:
1) Re-Design for Increased Pipe Size- The re-evaluation and re-design of the sewer pipeline profile for
increased pipe size for Parts 1 and 2 of the PROJECT is to be performed by Dannenbaum Engineering
Corporation (DEC). This work is classified as Basic Engineering Services under former Part 2-Main 325
Design Phase and current Work Phase 33 of the contract.The detailed scope of services is as described in

Exhibit "A"—General Scope of Services of the original contract and includes subconsultant management.
Fee=$35,691 (Lump Sum),
2) Hydrovac Excavation Services — Badger Daylighting, Ltd. (Badger) will perform Hydrovac Excavation
Services for utility locates at nine (9) proposed crossing locations in Parts 1 and 2 as identified on Exhibit
A.1. This work is classified as Special Services under former Part 2-Main 325 Design Phase and current
Work Phase 33 of the contract. The scope of work is described in Attachment A—Subconsultant's Scope
of Work. Fee=$20,210(Not-to-Exceed, Billed on Hourly Basis).
3) Survey—
a. ANA Consultants, LLC will survey,stake and tie-in the Hydrovac Excavation locations.This work is
classified as Special Services under former Part 2-Main 325 Design Phase and current Work Phase
51 of the contract. The scope of work is described in Attachment A. Fee=$4,250 (Lump Sum).
b. The survey work for preparing and providing easement documents for two (2) access easement
parcels, one east and one west of IH-35W. These documents will include Exhibit A, easement
parcel description, and Exhibit B, easement parcel map in the format required by the City of Fort
Worth Real Property Management Department.The scope of work is described in Attachment A.
Fee=$3,600(Lump Sum).
ENGINEER will perform/manage the work described in the items above for this Amendment in accordance with
the original Contract.
We recommend that the City increase the budget by $63,751 for these additional services. From the additional
services listed above,the recommended breakdown for Item 1) Design Services for DEC is as follows:

It is proposed that funding for this amendment be drawn from the previously approved contract Amendment
No. 5 (dated 3/5/2017) budget for the acquisition of Easement Parcels 15PE(r01) and 15CE(r01) (Reference
Exhibit C—Amendment 5—Exhibits 4 and 5 )which are located on property (Deer Creek Park) owned by the City
of Fort Worth.A cost of$123,954 was inadvertently assigned to cover acquisition costs for these two easement
Parcels and is included in the Amendment No. 5 budget (Reference Exhibit D—City Council Action Ref No.C-
28110,dated 2/14/2017). Since the two Parcels are owned by the City,there is no acquisition cost associated
with them, and the associated funds are available to cover the contract budget increase for this Amendment
(No. 6).

Hydrovac Excavation and Restoration
Scope of Services
A. Scope of Services
1. Provide equipment,water and labor to perform hydro-vacuum excavation at nine(9)
Potholes at Sites as identified on the attached Exhibit A.1 to include:
a. Hydro-vacuum excavated potholes at no more than ten (10)feet in depth each
b. Locate and identify the top of the pipe or utility, record the distance from natural
ground to the top of the pipe or utility and record the diameter of the pipe or utility.
c. Traffic Control for entering and exiting on South Oak Grove Road and 135W
d. GPS pot hole tracker and 2" PVC for line marking
e. Backfill with cushion sand approximately two (2) cubic yards for each ten (10)foot
deep pothole
f. Dump off at a disposal site provided by the contractor for non-contaminated
excavated soil
B. General Notes&Conditions:
1. In no event shall Badger Daylighting be liable for any special, indirect, incidental,
consequential (including loss of profit), or punitive damages.
2. Work shall comply with Specification Section 33 05 30, "Design Phase Vacuum Excavation
Location of Existing Utilities" in attached Exhibit A.2.
3. In the event that the pipe or utility is not located at the location staked in the field,
embedment and backfill to fill the excavation will comply with Specification Section 33 05
10, "Utility Trench Excavation, Embedment and Backfill" in attached Exhibit A.3.
4. Reference Attachment"B"for Pricing.
C. Additional Cost:
1. Should contaminated soils be encountered there will be an additional charge per day that
the materials have to be maintained on the contractors truck while processing the required
paperwork to properly dispose of the contaminated soils.
2. Should the pipeline that is being located be deeper than ten (10)feet deep, additional
charges for excavation and backfill will be applied. City will be notified if such conditions
exist.
3. Any additional training required by the site owner will be done at an additional charge for
time out of the field.
4. Any additional embedment and backfill dirt required due to inaccurate preliminary staking
and inability to locate the utility upon excavation will be an additional cost and will be as
described in Section B.3,General Notes & Conditions above.
5. Breaking, removal, and restoration of asphalt and or concrete unless agreed to in writing
prior,will be an additional cost.
6. Site restoration to include grass,trees, shrubs, etc... unless agreed to in writing prior will be
an additional cost.
7. Materials to secure and cover the excavation unless agreed to in writing prior,will be an
additional cost.
8. It is understood that the City will provide all specialty PPE which will include, but is not
limited to, Self-Contained Breathing Apparatus,trailer unit, masks, attachments, and other

related equipment. If specialty wet suits or other PPE are required to be supplied by
Badger,they will be an additional cost.
D. Dannenbaum Engineering responsibility Includes:
1. Communicate to owner of pipeline findings.
2. Specific direction and locations for Hydrovacuum excavation based on coordination and
staking by a surveyor.
3. Notify Badger of all billing requirements and any appropriate purchase orders,job numbers,
AFE, etc.that would be necessary to release payment to Badger. This must be done prior to
the first day of work.
4. Notify Badger of any of the following:Certified payrolls,OCIP requirements, prevailing wage
requirements,additional insurance requirements over what Badger already has in place.
DI. City of Fort Worth responsibility Includes:
1. Access to the Hydrovacuum site. Permits and permission from property owners, utilities,
and government agents.
2. All required shoring, maintenance and barricading.
3. Ownership of the soil and debris removed by the Hydrovacuum including any soils or debris
contaminated or suspect which cannot be readily disposed of.
DII. Contractor Deliverables Include:
1. Excavation Report provided to Dannenbaum Engineering indicating actual coordinates of
the located pipe at the location of the Pothole,top of located pipe depth from the surface,
top of surface elevation,and any unusual conditions or findings encountered during the
hydrovacuum excavation.
DIII. Schedule of Excavation:(Based on a Notice to Proceed no later than August 7, 2017.
1. Site 1 is PRIORITY. Site 1 excavation and utility location shall be coordinated, performed
and completed no later than August 14,2017.
2. Sites 2—9 are not as urgent as Site 1 and shall be completed, in no particular sequence, no
later than September 18,2017.
3. Site 9 is within Union Pacific Railroad ROW and involves locating AT&T facilities. This
location will require additional coordination efforts on the contractor. The contractor is
advised to begin coordination efforts with the appropriate parties upon Notice to
Proceed. With prior authorization from Dannenbaum and the City of Fort Worth,an
extension of time for completion will be considered in the event that coordination,access
or completion is delayed by either UPRR or AT&T.
