HomeMy WebLinkAboutOrdinance 22954-10-2017 Ordinance No. 22954-10-2017 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF $144,336.00 IN THE GRANTS FUND, FROM PROCEEDS FROM AN AGREEMENT WITH THE UNITED STATES JUSTICE DEPARTMENT DRUG ENFORCEMENT ADMINISTRATION, FOR REIMBURSEMENT OF OVERTIME COSTS AND FOR THE PARTICIPATION IN THE TEXMOA HIGH INTENSITY DRUG TRAFFICKING AREAS WESTERN DRUG SQUAD/GROUP 2; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the amount of$144,336.00 in the Grants Fund,from an agreement with the United States Department of Justice Drug Enforcement Administration, for reimbursement of overtime costs and for the participation in the Texoma High Intensity Drug Trafficking Areas Western Drug Squad/Group 2. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22927-09-2017 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the execution of an Agreement with the United States Department of Justice, Drug Enforcement Administration for reimbursement of overtime costs and for participation in the Texoma High Intensity Drug Trafficking Areas Western Drug Squad/Group 2 for Fiscal Year 2018; 2. Authorize the execution of an Asset Forfeiture Sharing Agreement governing the Task Force's equitable sharing requests and participation in the United States Department of Justice Equitable Sharing Program; 3. Authorize the acceptance of the amount up to $144,336.00 for the reimbursement of overtime costs for eight officers assigned to the Texoma High Intensity Drug Trafficking Areas Western Drug Squad/Group 2 Task Force; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of$144,336.00, upon execution of the Agreement. DISCUSSION: Since 1999, the City of Fort Worth has worked cooperatively with the United States Department of Justice, Drug Enforcement Administration (DEA) to address the problem of drug trafficking in North Texas through various task forces. The Texoma High Intensity Drug Trafficking Areas (HIDTA) Western Drug Squad/Group 2 Task Force seeks to disrupt the illicit drug traffic in the City of Fort Worth by immobilizing targeted violators and trafficking organizations, gathering and reporting intelligence data relating to trafficking of narcotics and other dangerous drugs, and by conducting undercover operations where appropriate. The task force will also engage in other traditional methods of investigations in order that the task force's activities will result in effective prosecution in both state and federal courts. The Fort Worth Police Department currently has eight officers assigned to the HIDTA Western Drug Squad Task Force. The City of Fort Worth will be reimbursed by the DEA for overtime expenses related to the department's participation in the task force in an amount not to exceed $144,336.00. This is a reimbursement Agreement and indirect costs are prohibited.
