WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc. ,
(ENGINEER) made and entered into City Secretary Contract No. 46057, (the
CONTRACT) which was authorized by M&C C-27028 on the 14th day of October,
2014 in the amount of $ $217, 925 . 00; and amendment No. 1 was authorized
on the 7th day of January, 2016 in the amount of $33, 000 . 00 for a total
contract amount of $250, 925 . 00 .
WHEREAS, the CONTRACT involves engineering services for the
following project:
Six Points Urban Village Streetscape Improvements,
Project No. 00705;
WHEREAS, it has become necessary to execute Amendment No. 2 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated May 17, 2017, a copy
of which is attached hereto and incorporated herein. The cost to City
for the additional design services and construction phase project
management to be performed by Engineer totals $133, 700. 00. (See Attached
Funding Breakdown Sheet, Attachment B)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $384, 625. 00.

SUBJECT: Authorize Execution of Amendment 2 to City Secretary Contract No. 46057, in the Amount

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize Execution of Amendment 2 to City Secretary Contract No. 46057 in the amount of
$133,700.00, an Engineering Services Agreement with Freese and Nichols, Inc., for additional
engineering and project management services for the Six Points Urban Village Phase 1 Streetscape
Improvements along Race Street from Grace Avenue to Holden Street; and
2. Authorize Execution of Amendment 1 to City Secretary Contract No. 46981 in the amount of
$127,520.00, an Engineering Services Agreement with Freese and Nichols, Inc., for additional
engineering and project management services for the Six Points Urban Village Phase 2 Streetscape
Improvements along Race Street from Grace Avenue to Oakhurst Scenic Drive and Along Sylvania
Avenue from 150 Feet North of Race Street to the State Highway 121 Frontage Road.
DISCUSSION:
On June 2, 2015, Mayor and Council Communication (M&C G-18493), the City Council allocated the
amount of$2,500,000.00 in 2014 Bond Program Urban Village Funds to the Six Points Urban Village
for complete street improvements in accordance with the 2007 Six Points Urban Village Master Plan
and the Comprehensive Plan. In addition, as part of the Fiscal Year 2017 capital projects budget, an
additional $1,548,533.00 in 2014 Bond Program Urban Village Funds was appropriated to the Six
Points Urban Village complete street improvements projects to cover an anticipated Phase 1 shortfall
due to increases in construction costs and easement acquisition costs, for a total 2014 Bond Program
Urban Village Funds appropriation of$4,048,533.00 for the Six Points Urban Village.
Phase 1 Scope Amendment
On October 14, 2014, Mayor and Council Communication (M&C C-27028), the City Council
authorized the execution of an Engineering Services Agreement in an amount not to exceed
$217,925.00 with Freese and Nichols, Inc., for the design of pedestrian and streetscape
improvements in the Six Points Urban Village. On January 1, 2016, the City executed Contract
Amendment 1 (46057-A1) in the amount of$33,000.00 for additional easement acquisition services,
including processing 25 additional easement documents. The proposed Contract Amendment 2
includes the following expanded scope: historic resources survey, additional survey documents,
additional project design and property owner meetings, and construction phase meetings and
documentation (City and TxDOT).
Phase 2 Scope Amendment
On August 18, 2015, Mayor and Council Communication (M&C C-27418), the City Council authorized

the execution of an Engineering Services Agreement in an amount not to exceed $204,190.00 with
Freese and Nichols, Inc., for preparation of engineering documents for the construction of the Six
Points Urban Village Phase 2 streetscape improvements. The proposed Contract Amendment 1
includes the following expanded scope: modify the preliminary design, prepare intersection design
details for design competition, additional project and property owner meetings, construction phase
meetings and documentation.
Below is the Six Points Streetscape Improvements Project (Phase 1 & 2) estimated schedule. The
Phase 1 bid advertisement date is contingent upon TxDOT approval.

The project is included in the 2014 Bond Program. Available resources within the General Fund will
be used to provide interim financing until debt is issued. Once debt associated with the project is sold,
bond proceeds will reimburse the General Fund, in accordance with the statement expressing official
Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election
(Ordinance No. 21241-05-2014) and subsequent events taken by the Mayor and City Council.
Streetscape projects such as this typically have a higher long-term basic maintenance cost than
standard street projects because of additional landscaping and paving details. The Park and
Recreation Department has estimated an annual budget impact for this project could average
$5,400.00 per 1/10th mile (block), depending upon the extent of landscape improvements.
Freese and Nichols, Inc., agrees to maintain its initial DBE commitment of 14 percent that it made on
the original Agreement (CSC No. 46981) and extend and maintain the same DBE commitment of 14
percent to this first amendment. Therefore, Freese and Nichols remains in compliance with the City's
BDE Ordinance and attests to its commitment by its signature on the Acceptance of Previous DBE
Commitment form executed by an authorized representative of its company.
Freese and Nichols, Inc., agrees to maintain its initial DBE commitment of 13 percent that it made on
the original Agreement (CSC No. 46057) and extend and maintain the same DBE commitment of 13
percent to this second amendment. Therefore, Freese and Nichols, Inc., remains in compliance with
the City's BDE Ordinance and attests to its commitment by its signature on the Acceptance of
Previous DBE Commitment form executed by an authorized representative of its company.
The project is located in COUNCIL DISTRICT 9.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as
appropriated, of the Grants Fund for the Phase 1 project, and that the appropriations are included in
the Fiscal Year 2017 Adopted Budget of the 2014 Bond Program pursuant to Ordinance No. 21457-
09-2014.

Dear Mrs.Smith:
This letter is written in response to our recent discussions related to providing additional design
management and construction phase coordination services for the City of Fort Worth for the Six Points
Urban Village project from Grace Avenue to Holden Street. It is our understanding that the City of Fort
Worth will be providing full time construction inspection and performing materials testing. FNI will
prepare the required TOOT Local Government Project Procedures (LGPP) documentation for the City to
submit for design and construction reimbursement. This proposal also includes the scope and fee for
preparing a Historic Resources Windshield Survey for Race Street and two additional easement
documents.
FNI proposes a contract modification fee not to exceed $133,700.00. Refer to the attached level of
effort spreadsheet for a detailed breakdown of the proposed services.The following is a summary of our
DBE participation to date for this project.

Scope for Engineering Design Related Services for Construction Coordination
The scope set forth herein defines the work to be performed by the ENGINEER in
completing the project. Both the CITY and ENGINEER have attempted to clearly define the
work to be performed and address the needs of the Project.
OBJECTIVE
The objective of the project is to provide project management support for the Six Points
Urban Village project and provide regular updates to the Transportation and Public Works
department
WORK TO BE PERFORMED
Task 1. Design Phase Management Support
Task 2. Project Management Support during Construction
Task 3. Historic Resources Windshield Survey
Task 4. Survey Documents
Task 5. Additional Services
TASK 1. Design Phase Management Support
ENGINEER will support the construction phase of the project as follows.
1.1 Project Management Support
• The ENGINEER shall coordinate with Right-of-Way agent (Up to 4 meetings)
• The ENGINEER shall attend and document up to 25 additional meetings with
property owners
• The ENGINEER will attend up to 4 additional franchise utility coordination meetings
• The ENGINEER will coordinate with City water department. Attend up to 2 meetings
and prepare comment responses for waterline comments.
• The ENGINEER will coordinate with project control specialist monthly.
• The ENGINEER will attend up to 15 meeting with program manager
• The ENGINEER will prepare documents for M&C's (up to 4 M&C's)

• This scope does not include waterline relocation design.

ENGINEER will support the construction phase of the project as follows.
2.1 Project Management Support
• The ENGINEER will prepare project summary memo
• The ENGINEER will prepare weekly progress meetings (up to 30)
• The ENGINEER will coordinate reviews of submittals, BFI's, pay estimates, and
change orders.
• The ENGINEER shall attend up to 24 construction coordination meetings and
document the meeting with meeting minutes
• The ENGINEER will prepare up to 15 monthly progress memos with project photos
and description of progress and any current construction issues or delays.
• The ENGINEER will coordinate with project control specialist monthly.
• The ENGINEER will review record drawings for project closeout

TASK 3. Historic Resources Windshield Survey
3.1 Historic Resource Windshield Survey
• FNI subconsultant will prepare a Research Design conforming to the current TxDOT
Documentation Standard.
• FNI understands the City of Fort Worth has photographs of the buildings located adjacent to
the proposed project area. FNI would use the photographs to the greatest extent possible to
prepare the historic resources survey.TxDOT Documentation Standards set forth particular
requirements for the photographs, including the requirement to have at least two photographs
of each documented resource presented on photo pages. Upon receipt of the electronic
photograph files in .jpg or.tit format from the City of Fort Worth, FNI will review the
photographs to determine if they meet the minimum requirements set forth in the
documentation standards.lf the photographs do not meet the minimum requirements, FNI will
conduct a site visit to the proposed project area to obtain sufficient photographs to complete
the windshield-level historic resources survey report. Historians would conduct the site visit of
the area of potential effects (APE), preliminarily defined as the parcels adjacent to the
proposed work,within 15 working days of TxDOT's approval of the Research Design and FNI
completion of review of the photographs.A Historic Resources Survey Report will be
prepared,conforming to the current TxDOT Documentation Standard, and including
recommendations regarding the effect of the proposed project on any eligible resources in

the APE.The draft report will be submitted to City within 20 working days of completion of
fieldwork.A final report will be submitted to City within 12 working days of receipt of all
comments on the draft report from the City and TxDOT.

• This scope/fee does not include ecological/NEPA services,archeological background or
field studies at any level, historic structures reconnaissance survey or intensive study,
NRHP nominations, HABS/HAER documentation, human remains
evaluation/coordination/removal.All excluded services could be provided under separate
scope/budget

Additional Services not included in the existing Scope of Services — CITY and

needed, upon the CITY's written request. Any additional amounts paid to the
ENGINEER as a result of any material change to the Scope of the Project shall be
agreed upon in writing by both parties before the services are performed. These
