HomeMy WebLinkAboutResolution 2577A Resolution NO ~S`7 7 URGING THE TEXAS MUNICIPAL LEAGUE TO SUPPORT CHANGES IN STATE LAW TO ALLOW A CITY TO FORECLOSE ON PROPERTY ON WHICH A CIVIL PENALTY HAS BEEN ASSESSED PURSUANT TO CHAPTER 214 OF THE TEXAS LOCAL GOVERNMENT CODE WHEREAS, Chapter 214 of the Texas Local Goverrinent Code allows a home rule municipality to order a property owner of a substandard building to repair or demolish the building; and WHEREAS if a property owner fails to repair or demolish the substandard building by the time ordered by a city Chapter 214 allows a home rule municipality to impose a civil penalty against the property and WHEREAS the statute provides that a city can enforce a civil penalty m distract court by filing a copy of the civil penalty order in distract court; and WHEREAS state law does not contain a procedure by which a city can foreclose on property on which a civil penalty has been assessed. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH That the City of Fort Worth urges the Texas Municipal League to support changes to state law to allow a city to foreclose on property on which a civil penalty has been assessed.
