HomeMy WebLinkAboutResolution 2404A Resolution Rdopte~ Resolution l~o~ ~ RETAINING THE SERVICES OF JIlVI BOYLE OF THE LAW OFFICES OF JIlVI BOYLE FOR ASSISTANCE IN SOUTIiWESTERN BELL RATEMAKING PROCEEDING, PUC DOCKET NO. 18509; SOAH DOCKET N0.473-98-0092 WHEREAS, Southwestern Bell Telephone Company ("Southwestern Bell') has filed an application with the Public Utility Commission of Texas ("PUC") for rate group reclassifications affecting 52 municnpalntnes, mcludnng the City of Fort Worth, which application has been docketed and styled PUC Docket No 18509• SOAH Docket No. 473-98-0092, and WHEREAS, this matter ns a ratemaknng proceeding and approval of Southwestern Bell's application, as filed, by the PUC will result m significant rate increases for both resndentnal and business telephone customers m Fort Worth; and WHEREAS, the Cnty of Fort Worth has intervened m thns matter pursuant to rts rights under state law and out of concern for the burden and harm nts crtnzens wall nncur as a result of ncreased telephone rates; and WHEREAS, the PUC has referred Southwestern Bell's applncatnon to the State Office of Admnmstratnve Hearings and instructed that an Admnmstratnve Law Judge ("ALJ") conduct a hearing to deterinine factual and legal nssues related to the apphcatnon, and WHEREAS, this matter ns of extraordinary importance and involves legal nssues, it ns necessary to retain outsnde counsel to assnst the Cnty Attorney nn the revnew of Southwestern Bell's apphcatnon and related documents and to represent the Cnty of Fort Worth m the admnmstratnve hearing on this applncatnon, and WHEREAS, Jim Boyle of the Law Offices of Jim Boyle, Austin, Texas, has substantnal expertnse in the area of telecommumcatnons and admnmstratnve law and has prevnously represented numerous muricnpalrtnes m admnnistratnve heanngs and before the PUC CITY OF FORT WORTH NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS I. That Jim Boyle be retained as outside counsel pursuant to Section 3 Chapter VI of the City Charter to assist the City Attorney m the review of Southwestern Bell's application and related documents and to represent the City of Fort Worth m the administrative heanng on this application. II. 'That, as far as practicable, the compensation to be paid Mr Boyle is hereby fixed not to exceed $170.00 per hour for a total amount not to exceed $20,000, but only to the extent that such compensation is reasonable for the services provided.
