RETAINING THE SERVICES OF JIM BOYLE OF THE LAW OFFICES OF JIlVI BOYLE
FOR ASSISTANCE IN SOUTHWESTERN BELL RATEMAKING PROCEEDING,
PUC DOCKET NO.18513; SOAR DOCKET N0.473-98-0266
WHEREAS, Southwestern Bell Telephone Company ("Southwestern
Bell') has filed an application with the Public Utility Comrmssion of Texas
("PUC") for an expanded toll-free local calking service surcharge that will apply to
telephone customers in the City of Fort Worth, winch applncahon has been docketed
and styled PUC Docket No 18513 SOAR Docket No 473-98-0266 and
WHEREAS, this matter ns a ratemaknng proceeding and approval of
Southwestern Bell's application, as filed, by the PUC will result m sngmficant
additional charges for both residential and business telephone customers in Fort
Worth, and
WHEREAS, the City of Fort Worth has intervened m this matter pursuant
to its rights under state law and out of concern for the burden and harm its citizens
will incur as a result of increased telephone rates, and
WHEREAS, the PUC has referred Southwestern Bell's application to the
State Office of Admimstrative Hearings ("SOAR") and instructed that an
Admnmstrative Law Judge ("ALJ") conduct a heanng to determine factual and legal
issues related to the application, and
WHEREAS, this matter ns of extraordinary nmportance and involves legal
issues, rt ns necessary to retain outside counsel to assist the City Attorney m the
review of Southwestern Bell's application and related documents and to represent
the City of Fort Worth nn the admnmstrahve hearing on this application, and
WHEREAS, Jim Boyle of the Law Offices of Jim Boyle, Austin, Texas,
has substantial expertise nn the area of telecommunications and admnmstratnve law
and has prevnously represented numerous mumcipalrtnes m admimstratnve hearings
and before the PUC and SOAR,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS
I.
That Jim Boyle be retained as outside counsel pursuant to Section 3 Chapter
VI of the City Charter to assist the City Attorney m the review of Southwestern
Bell's application and related documents and to represent the City of Fort Worth in
the administrative heanng on this application.
II.
That, as far as practicable, the compensation to be paid Mr Boyle is hereby
fixed not to exceed $170 00 per hour for a total amount not to exceed $20,000 but
only to the extent that such compensation is reasonable for the services provided.
