HomeMy WebLinkAboutResolution 2412.~ JOINT RESOLUTION AND AGREEMENT ~~~~~~~ ~~eso~U~so~ ~rQ w ~~ STATE OF TEXAS § § KNOW ALL MEN BY THESE PRESENTS COUNTY OF TARRANT § WHEREAS the City of Fort Worth is a home-rule city lying and being situated in Tarrant and Denton counties, State of Texas, and ~.~- ~C~. WHEREAS the City of Watauga is a r~e~ra~l~~a-v~city lying and being situated in Tarrant County State of Texas and WHEREAS the City of Fort Worth and the City of Watauga desire to adjust their corporate boundary lines whereby the City of Fort Worth will disannex from its corporate limits a certain 2 693 acre tract of land and will release from its extraterritorial jurisdiction an additional 16 119 acre tract of land and thereafter the City of Watauga will annex said tracts for the purpose of developing thereon single-family residences ® NOW THEREFORE, BE IT RESOLVED AND MUTUALLY AGREED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH AND THE CITY COUNCIL OF THE CITY OF WATAUGA. SECTION 1 That the following release of extraterritorial jurisdiction by the City of Fort Worth and the adjustment of corporate boundaries between the City of Fort Worth and the City of Watauga as herein described is in the best interests of the property owners and inhabitants of both cities and the City of Fort Worth and the City of Watauga agree to proceed with due diligence in adopting the annexation and disannexation ordinances necessary to adjust their corporate boundaries and to effectuate all other covenants of this Joint Resolution and Agreement. SECTION 2. That in reliance upon the representations and covenants made by the City of Watauga in Section 8 hereof the City of Fort Worth agrees to disannex from its corporate limits and to release from its extraterritorial jurisdiction all that territory described by metes and bounds in Exhibit A attached hereto and incorporated herein and consisting of 2 693 acres of land situated in the William Evans Survey Abstract No 467 ~J ® SECTION 3. That the disannexation of the above described territory by the City of Fort Worth shall automatically effectuate a release and relinquishment to the City of Watauga of all extraterritorial jurisdictional rights which the City of Fort Worth has in said territory SECTION 4. That in further reliance upon the representations and covenants made by the City of Watauga in Section 8 hereof and subject to the disannexation of the territory described in Section 2 hereof the City of Fort Worth does hereby release and relinquish to the City of Watauga all extraterritorial jurisdictional rights it may have in that territory described by metes and bounds in Exhibit 'B" attached hereto and incorporated herein consisting of 16 119 acres of land situated in the William Evans Survey Abstract No 467 SECTION 5 That the territories described in Section 2 and 4 hereof are depicted on the map attached hereto and incorporated herein as Exhibit 'C" • SECTION 6. That the City of Watauga hereby agrees to annex the territory which is disannexed by the City of Fort Worth and released from its extraterritorial jurisdiction under this Joint Resolution and Agreement, and the City of Watauga agrees to assume the rights and obligations appurtenant to said territory SECTION 7 That the City of Fort Worth and the City of Watauga do hereby covenant and agree to protect, preserve and defend the herein described adjustments to the corporate boundaries and extraterritorial jurisdiction SECTION 8 That in consideration of the City of Fort Worth disannexing from its corporate limits and releasing from its extraterritorial jurisdiction the territory described herein the City of Watauga covenants, agrees and represents that it shall create a Public Improvement District pursuant to Chapter 372 of the Local Government Code and shall make and maintain certain improvements and provide certain services with the assessments levied and collected on the property within said District. The boundaries of said Public Improvement District, the improvements to be constructed and maintained and the services to be performed in said District are described in Exhibit ® `D" hereof Said Public Improvement District shall be finally created no later than one 2 hundred and eighty (180) days following completion of the herein described disannexation by the City of Fort Worth In the event the City of Watauga fails to complete said improvements and perform such services within two (2) years following completion of the hereindescribed disannexation or thereafter fails to continuously maintain said improvements and perform said services to the standard prescribed herein for a period of five (5) years from the date of completion of said improvements, then the City of Watauga shall take all actions necessary to disannex from its corporate limits the territory described in Sections 2 and 4 hereof and to release exclusively to the City of Fort Worth all extraterritorial jurisdictional rights which the City of Watauga has or may have in said territory so that same may be available for annexation by the City of Fort Worth SECTION 9 That the City of Fort Worth and the City of Watauga agree and resolve that the adoption by both cities of this Joint Resolution and Agreement, and the disannexation and release of the -above described territory by the City of Fort Worth and the annexation thereof by the City of Watauga does not mitigate diminish or lessen in any way the rights either party may have at law or in equity to challenge or contest any other annexations attempted annexations or extraterritorial jurisdictional claims made by the other party SECTION 10 That this Joint Resolution and Agreement shall become effective and shall become a binding agreement upon the City of Fort Worth and the City of Watauga by the adoption of same in regular open City Council meetings of the City of Fort Worth and the City of Watauga SECTION 11 That this Joint Resolution and Agreement, upon adoption by both cities shall be executed in several originals and shall be spread in full on the minutes of each city A copy of this Joint Resolution and Agreement shall be executed by the Mayor and attested by the City Secretary of each city PASSED AND APPROVED by the City Council of the City of Fort Worth on this ,day of , 1998 • 3 CITY OF FORT WORTH By. DISCUSSION Adoption of the attached Joint Resolution and Agreement would facilitate the proposed residential development of an 80 5 acre tract of land located west of Highway 377 north of Western Center Boulevard and south of Basswood Boulevard The property currently owned by Havener Rupert Limited Partnership lies principally within the City of Watauga, but portions of the property are located within the city limits of Fort Worth and in Fort Worth's extraterritorial jurisdiction (ETJ) The prospective developer of the tract, Gehan Homes and the City of Watauga requested that the City of Fort Worth disannex the 2 693 acre portion located within the Fort Worth city limits and release its ETJ rights to the 16 119 acre portion so that the property may be annexed by Watauga and the development could be located entirely within the City of Watauga. The request was routed to the City Council's Government Relations Committee After review the Committee voted to recommend that Fort Worth take the requested actions, subject to the developer and the City of Watauga agreeing to establish a public improvement district (PID) encompassing the development which would fund improvements and services in a manner similar to the Fort Worth's Public Improvement District No 4 which serves the nearby Park Glen neighborhood Section 8 of the attached Joint Resolution and Agreement provides that in consideration of the City of Fort Worth disannexing and relinquishing ETJ rights to the property the City of Watauga will create a PID within 180 days of disannexation In the event that the described improvements and services are not completed and provided within 2 years following disannexation or are not continuously provided for a period of 5 years from the date of completion of the improvements, Watauga is obligated to take all actions necessary to disannex and release ETJ rights to the property The services to be provided within the Watauga PID are described in Exhibit D to the Joint Resolution and Agreement, and are similar to those provided in Park Glen The Joint Resolution and Agreement becomes effective upon approval by both City Councils After approval and execution of this Agreement, a formal disannexation ordinance will be presented to the City Council for action City of Fort Worth, Texas M'Ayor and Council Commu~vicAtian DATE 6/23/98 REFERENCE NUMBER C-16848 LOG NAME 12WATAUGA PAGE 2 of 2 SUBJECT ADOPT JOINT RESOLUTION AND AGREEMENT WITH THE CITY OF WATAUGA CONCERNING DISANNEXATlON OF A 2.693 ACRE TRACT AND RELEASE OF EXTRATERRITORIAL JURISDICTION RIGHTS IN A 16 119 ACRE TRACT LOCATED IN THE WILLIAM EVANS SURVEY ABSTRACT NO 467 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that adoption of the attached Joint Resolution and Agreement will have no material affect on City funds.
