AMENDMENT NO. 1 TO 4q701—L— COMMUNITY FACILITIES AGREEMENT THE STATE OF TEXAS § CITY SECRETARY CONTRACT NO. 47701-A1 COUNTY OF TARRANT § WHEREAS, the City of Fort Worth ("City") and FW Bluff Apartments, L.P. ("Developer") entered into Community Facility Agreement, City Secretary Contract No. 47701 ("CFA"), wherein Developer is to make certain improvements related to a project generally described as Scenic Village ("Project"), within the City or the extraterritorial jurisdiction of the City; and WHEREAS, the Developer and City have agreed that the CFA should be amended to add the installation of approximately 610 linear feet of 12 inch reinforced concrete pipe (Class III ) at an estimated cost of$39,442.00 as more fully described in this Amendment No. 1 ("Additional Work") in order to benefit the Project and the surrounding area; and WHEREAS,the City and Developer have agreed that the City will pay for the cost of the Additional Work in an amount not to exceed $39,442.00. NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CFA: 1. Exhibit B-1: Storm Drain Improvements is amended to add the information contained in Attachment No. 1 to this Amendment No. 1 to Community Facilities Agreement. 1 OFFICIAL RECORD CITY SECRETARY FT.
