HomeMy WebLinkAboutOrdinance 23008-12-2017ORDINANCE NO. 23008-12-2017 AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED SWORN POSTIONS IN THE POLICE DEPARTMENT BY ADDING TWENTY-NINE POSITIONS IN THE CLASSIFICATION OF POLICE OFFICER EFFECTIVE DECEMBER 9, 2017; PROVIDING A STATEMENT OF PURPOSE AND INTENT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES AND REPEAL CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 143.021(a), Texas Local Government Code provides that a municipality's governing body shall by ordinance (i) establish the classifications of police officers and (ii) prescribe the number of positions in each classification; and WHEREAS, on November 14, 2017, the City Council adopted Ordinance 22999-11-2017, which established the Police Department's sworn personnel staffing levels effective November 14, 2017, as follows: Assistant Chief 3 Deputy Chief 5 Commander 6 Captain 17 Lieutenant 50 Sergeant 184 Corporal/Detective 241 Police Officer 1,224 Total 1,730; and WHEREAS, the Police Chief requested that the City Council increase the number of authorized positions in the existing classification of Police Officer by twenty- nine (29) effective December 9, 2017, to accommodate the graduates of Academy Class 144 and thereafter prescribe the number of authorized positions in the Police Department to conform with the proposed changes as set forth below in order to effect efficient economy of the operations of the Police Department. Ordinance No. 23008-12-2017 Page 1 of 3 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That, following the formal adoption of this ordinance, the following positions shall be the only civil service positions in each classification (rank) authorized in the City of Fort Worth Police Department effective December 9, 2017, until modified by subsequent ordinance: Assistant Chief Deputy Chief Commander Captain Lieutenant Sergeant Corporal/Detective Police Officer Total SECTION 2. 3 5 6 17 50 184 241 1,253 1,759 The "Mayor and Council Communication" memorandum, which is presented contemporaneously with this ordinance, is hereby expressly incorporated herein by reference for further clarification and explanation of the purpose and intent of the City Council in its adoption of this ordinance as well as the Department in its implementation. SECTION 3. This ordinance shall be cumulative of all provisions of previous ordinances and of the Code of the City of Fort Worth, Texas (2015), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior police staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinances and such code provisions are hereby repealed and this ordinance shall be controlling. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and pluases of these ordinances are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorpor•ation in this oi•dinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. This ordinance shall take effect and be in fiill force and effective December 9, 2017, with respect to the addition of twenty-nine (29) positions in the Police Officei• classification, and it is so oi•dained. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) and the attached ordinance is to temporarily increase the number of authorized positions in the classification of Police Officer in the Fort Worth Police Department by a total of twenty-nine in order to have sufficient Police Officer positions for all of the graduates of the Fort Worth Police Department Recruit Class 144, who are expected to graduate on December 8, 2017 and promote to Police Officer on December 9, 2017. There are currently forty-five recruits in Recruit Class 144 and sixteen Police Officer vacancies. Projected Civil Service retirements and separations in the Police Officer rank are not expected to result in enough vacancies in this rank in order to promote all graduating recruits to Police Officer on December 9, 2017. Additionally, although Civil Service promotional testing and associated promotion processes are currently underway, a new Corporal promotional list is not expected to be available until after December 21, 2017. The Officer vacancies created by promotions to Corporal based on the new list will not be available until after Recruit Class 144 graduates; thus, creating the need for temporary overages. On August 1 and 29, 2017, the City Council adopted Staffing Ordinances for the Police Department (Ordinance No's. 22813-08-2017 and 22856-08-2017) to temporarily increase the authorized positions at the Officer rank in order to accommodate graduating Fort Worth Police Recruit Classes. These increases, or overages were necessary due to accelerated training associated with staffing up the sixth patrol, lower- than-projected attrition and delays in promotions at higher ranks that resulted in too few vacancies at the Officer rank to accommodate the graduates. Class 144 was also associated with this effort. As the promotional processes are completed and true vacant Police Officer positions are realized, revised staffing ordinances will be presented beginning in the spring of 2018 to restore the intended authorized strength noted in the table below. On November 14, 2017, the City Council adopted the most recent Staffing Ordinance 22999-11-2017, effective November 14, 2017, which amended the Police Department Staffing levels, establishing the classification of Commander and creating six positions in the rank as allowed in the Meet and Confer Logname: 03STAFFING ORDINANCE - OFFICER POSITIONS CLASS 144 Page 1 of 2 Contract and approved by City Council on May 16, 2017.
