AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY,
SITUATED IN THE W. WELCH SURVEY, ABSTRACT NO. 1644, BEING
OF BLOCK 6, TERRELL'S SUBDIVION, CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS RECORDED IN VOLUME 63, PAGE
155, VOLUME 388-188, PAGE 71 AND CABINET B, SLIDE 3061 OF THE
PLAT RECORDS OF TARRANT COUNTY TEXAS, AND CONTAINING
APPROXIMATELY 0.113 ACRE OF LAND, PROVIDING FOR THE
REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING
UTILITY EASEMENTS;REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a twelve foot wide public alley, situated the W. Welch Survey, Abstract No.
1644, City of Fort Worth, Tarrant County, Texas, being Block 6 of Terrell's Subdivision, an
addition to the City of Fort Worth, Tarrant County, Texas, according to the plats recorded in
Volume 63, Page 155, Volume 388-188, Page 71 and Cabinet B, Slide 3061 of the Plat Records
of Tarrant County, and containing approximately 4,958 square feet or 0.113 acre of land more or
less, and as more specifically described in Exhibit "A" attached hereto and incorporated herein
by reference be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described street right-of-way is released and shall
revert to DASHROSE, LLC., owner of the land abutting the western boundary of the alley, and
shall be replatted as part of Block 6, Lot 7R, Terrell's Subdivision. No interest in the lands in such
vacated alley shall, at any time, be released or revert to the owner of the property abutting the
eastern boundary of the alley.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

PROPERTY DESCRIPTION
BEING a tract of land situated in the W. Welch Survey, Abstract No. 1644, City of Fort Worth, Tarrant County,
Texas, being all of that certain Alley (variable width public right-of-way) in Block 6, as shown on those
plats for Terrell's Subdivision, an addition to the City of Fort Worth according to the plats recorded In
Volume 63, Page 155, Volume 388-138. Page 71, and in Cabinet B, Slide 3061, Plat Records, Tarrant County,
Texas, said tract of land being more particularly described by metes and bounds as follows:
BEGINNING at a 5/8" iron rod with yellow cap stamped "RUNAWAY ASSOC. LP" (hereinafter called 5/8" YCIR)
found for the northeast corner of Lot 7, sold Block 6, Terrell's Sub-Division, in the south right-of-way line
of W. Dashwood Street (a 50' width public right-of-way) and the west right-of-way line of said Alley,

Adopt Ordinance Vacating an Alley in Block 6, Terrell's Subdivision Between West Rosedale Street and
West Dashwood Street to Consolidate the Land for Future Development (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating an alley in Block 6, Terrell's Subdivision between West
Rosedale Street and West Dashwood Street to consolidate the land for future development; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Dunaway and Associates, on behalf of Robert H. McKenzie and Reza Bryant, have requested the
vacation of this alley to consolidate the land for future development. The City Plan Commission
recommended approval of this request at its meeting on June 28, 2017. An acceptable final plat (FS-17-
107) has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through platting
process. The City does not own any fee interest in the right-of-way or own any property adjacent to the
right-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007, Mayor and Council Communication (M&C G-15624), Staff recommends waiving the fair
market value or any portion thereof of purchase price of the right-of-way easements for the alley.
This project is located in COUNCIL DISTRICT 9.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds.
