WHEREAS, on January 5 1995 the D-FW International Airport Board ("Airport Board")
passed Resolution Number 95-01004, which requested the Cities of Dallas and Fort Worth, Texas
("Cities") to each pass a resolution to allow the revenue from the resale of single-family residential
properties acquired under its noise mntngation program (the 'Program') related to the construction
of each of the runways, 17/35R (formerly 16/34E) and 16/34W to remain nn the Program to be
reused in the Program (except for the Sound Insulation Program) until completion of the Program
by the Dallas-Fort Worth International Airport ("Airport"); and
WHEREAS, the total budget for each runway's Program ns net of the proceeds denved
from the resale of surplus properties, which are scheduled and budgeted for continuous fundnng of
each runway's Program, and the Airport must reimburse the Federal Aviation Administration
("FAA') for 75% of resale proceeds due to federal grant participation in the acquisition costs; and
WHEREAS, certain provisions nn the 1968 Contract and Agreement between the Cities
("Contract"), as well as the 1968 Regional Airport Concurrent Bond Ordinance ("Ordinance")
provide that proceeds from the sale of surplus property at the Airport be paid to the Cities as a
return of capital, and
WHEREAS, on February 28, 1995 the Fort Worth City Council passed Resolution
Number 2047 which conditionally waived rts nghts under certain provisions of the Contract and
Ordinance to receive proceeds of Program surplus property sales, to the extent that, and so long as,
the proceeds are used for the Program (except for the Sound Insulation Program), but only until
December 31 1998, nn connection with east-side runway 17/35R, and only for the 4-year penod
following commencement of the Program for the west-side runway 16/34W at which time all
proceeds not reimbursed to the FAA shall be returned to the Cities in accordance with provisions of
the Contract and Ordinance (the 'Conditional Waiver"); and
WHEREAS, on February 22, 1995 the Dallas City Council passed a similar resolution,
Number 95-0$33 and
WHEREAS, the resale of surplus single-family residential property m connection with the
Program for runway 17/35R ns now estimated to extend until December 31 2001 and
WHEREAS, the Airport Board at its meeting on October 23 1998, passed a resolution
requesting the Cities to extend the date for retaining revenues from surplus property sales nn
connection wrath the Program for runway 17/35R from December 31 1998, to December 31 2001

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS.
Section 1 That Section 1 of Resolution Number 2047 approved on February 28, 1995 is
hereby amended to extend the expiration date of the Conditional Waiver m connection with the
Airport's expansion of runway 17/358 (formerly 16/34E) from December3l 1998 to December 31
2001
Section 2. That all other provisions of Resolution Number 2047 remain unchanged and in
full force and effect.
Section 3 That the waiver of rights contained m this resolution m connection with the
expansion of runway 17/358 is further conditioned upon approval of a similar resolution by the
Dallas City Council.
Section 4. That this resolution shall take effect immediately from and after its passage m
accordance with the provisions of the Charter of the City of Fort Worth, and rt is accordingly so
resolved.
