AN ORDINANCE AMENDING SECTIONS 35-56(g) and 35-56(h)
OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT
WORTH (1986), AS AMENDED, "WATER AND SEWERS", BY
REVISING AND ADDING CERTAIN RATES AND CHARGES;
MAI~NG THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES AND
PROVISIONS OF THE FORT WORTH CITY CODE IN
CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE;
PROVIDING A SEVERASILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH:
SECTION 1.
That Section 35-56(g) of Chapter 35 of the Code of the City of Fort Worth (1986),
as amended, is hereby amended to be and read as follows:
(g) The following schedule of rates per month, or fraction thereof, shall be the
charges to all wholesale customers for 1=unzishing water to such customers:

SECTION 2.
That Section 35-56(h) of Chapter 35 of the Code of the City of Fort Worth (1986)
as amended, is hereby amended to be and read as follows:
(h) The following schedule of rates per month, or fraction thereof, shall be the
charges to all wholesale customers for furnishing wastewater services to such
customers:

SECTION 3.
This ordinance shall be cumulative of all provisions of ordinances and of the
Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions
of this ordinance are in direct conflict with the provisions of such ordinance and such
Code, in which event conflicting provisions of such ordinances and such Code are hereby
repealed.
SECTION 4.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 5.
This ordinance shall take effect on October 1, 2008.

Adopt Ordinance Revising Wholesale Water, Wastewater and Raw Water Service Rates and
Amending Chapter 35 "Water and Sewer," Article III "Charges," Sections 35-56(g) and 35-56(h)
"Water and Sewer Rates Within City"
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance revising wholesale water, wastewater
and raw water service rates and amending Chapter 35 "Water and Sewer," Article III "Charges," Sections
35-56(g) and 35-56(h) "Water and Sewer Rates Within City," and providing an effective date of billing on or
after November 1, 2008, for usage of flows from and after October 1, 2008.
DISCUSSION:
Each year wholesale water and wastewater rate studies are prepared in accordance with the Texas Water
Code and the terms of the wholesale customer contracts.
For Fiscal Year 2009, the wholesale water cost of service study was completed by Black and Veatch
Corporation. The wholesale wastewater cost of service study was performed by Water Department staff
based on the wholesale wastewater cost of service study completed by Malcolm Pirnie for Fiscal Year
2008. The results of these studies indicated the rates, as proposed below, will recover the cost of providing
wholesale water and wastewater service.
A joint meeting of the Wholesale Water Advisory Committee and the Wholesale Wastewater Advisory
Committee was held July 17, 2008, to present the study and the rate requirements. The Committees had
no objection to the rate.

RAW WATER RATES
The cost of untreated water supplied by the Tarrant Regional Water District is $0.6544 for use inside the
district and $0.6874 outside the district. Adjusted for street rental and system loss, the raw water charge to
customers is $0.7068 inside the district and $0.7424 outside the district and is a direct "pass through" to
wholesale water customers.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that the Fiscal and CIP Services Division of the
Water Department is responsible for collection of funds due to the City by adoption of this ordinance.
