A RESOLUTION ADOPTING POLICIES AND PROCEDURES GOVERNING THE
PROVISION OF TEMPORARY RELOCATION ASSISTANCE TO HOMEOWNERS
VOLUNTARILY DISPLACED UNDER THE CITY'S COMMUNITY DEVELOPMENT
PROGRAM.
WHEREAS, the City under rts Community Development Block Grant and HOME Investment
Partnership programs, provides assistance to owner-occupants of inadequate and substandard
dwellings for the purpose of repair and rehabilitation of these dwellings m accordance with the
City's Codes and Ordinances, and,
WHEREAS there exists within the designated project areas, occupied dwellings which either
cannot be feasibly rehabilitated in accordance with the City's Rehabilitation Standards, or require
substantial rehabilitation that constitutes a considerable hazard or dangerous condition for the
occupants, and,
WHEREAS the City has determined that the removal or rehab~litahon of such inadequate and
substandard dwellings is consistent with rts Community Development strategy and
WHEREAS rt is considered necessary to adopt a written policy available to the public setting
forth the relocation payments and assistance the Crty elects to provide under this program.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, AS FOLLOWS
That it is appropriate for the City's Community Development Program to provide relocation
assistance from project funds to the owner-occupants of homes which are determined infeasible to
rehabilitate under the City's Home Improvement Loan Program guidelines or which require
substantial rehabilitation that constitutes a considerable hazard or dangerous condition for the
occupants, and that such relocation payments and assistance shall be provided upon request by
eligible applicants to the Crty m accordance with the provisions of this Resolution, as follows.
I General Policy
It shall be the policy of the Crty of Fort Worth to provide temporary relocation assistance m
a manner set forth herein to
A. An eligible owner-occupant of any home determined to be infeasible to rehabilitate
under the City's Home Improvement Loan Program guidelines whenever such owner
occupant voluntarily requests the relocation payments and assistance authorized herein,
or
B An eligible owner-occupant of any home undergoing substantial rehabilitation who
enters into an agreement with the City to vacate his/her occupied dwelling for the
purpose of demolition and clearance, provided that the substantial rehabilitation of the
existing structure poses an extended threat (more than one { 1 } week in duration) to the
health of the occupant(s) of the dwelling who are frail, elderly or have documented pre-
existing health concerns, such as any cardio-pulmmary disease or mobility impairment.
Medical verification is required.
C. Temporary relocation assistance as authorized herein shall be an eligible expense,
carried out under the City s Community Development Block Grant Program and Home
Investments Partnership Program, and shall be subject to
(1) the availability of grant funds,
(2) HUD implementing regulations, and
(3) Basic Eligibility Requirements and Conditions as set forth m this Policy
II Basic Eligibility Requirements
Eligibility for replacement housing assistance under the Policy may be granted if the
following requirements are met:
A. Residency
• ~~ The person applying for replacement housing assistance under this program must be the
owner-occupant of a dwelling which is the customary and usual place of residence of the
person, and for which dwelling, the owner-occupant has duly and properly submitted an
application for rehabilitation assistance under the City's Home Improvement Loan
Program.
B Low to Moderate Income Owner-Occupants
Relocation payments and assistance under this program shall be made only to low-
mcome (earning 80% of median area income or less) owner-occupants, as defined by the
City under its Home Improvement Loan Program.
C Hardship
Applicants for temporary relocation assistance must demonstrate a lack of resources to
make temporary housing arrangements on their own (i.e. with friends or relatives)

III. General Conditions
As a condition of obtaining temporary relocation assistance, and prior to any assistance
being granted under this Policy the apphcantlowner-occupant must enter into a written
Relocation Payments Agreement with the City
In the case of a Replacement Housing applicant, the Relocation Payments Agreement shall
require the apphcant/owner-occupant to permanently vacate his{her dilapidated dwelling at
a time stipulated by the Housing Department, and to allow the Crty to demolish the
dwelling and clear the site m such a manner as to facilitate the construction of replacement
dwelling. Costs associated with demolition and clearance will be borne by the City
Demolition and clearance action under this Policy shall be contingent upon the
apphcant/owner-occupant's legal authority to permit such action.
In the case of substantial rehabilitation under the Home Improvement Loan program, the
apphcant/owner-occupant is required to temporarily vacate hzslher dwelling at a time
stipulated by the Housing Department in order to facilitate the rehabilitation process.
IV Moving Expenses
The City shall bear the costs of the actual, reasonable moving and related (storage)
expenses necessary to temporarily relocate a person approved for temporary relocation
assistance under this Policy
V Eligible Miscellaneous Costs
The Crty will provide additional relocation payments to approved replacement housing
payment recipients for the following relocation-related costs when actually incurred.
1 Utility hook-up or tap fees necessary to make the replacement dwelling ready for full
use and occupancy
2 Closing and settlement costs related to the purchase of a replacement dwelling
customarily borne by the purchaser
3 Costs of temporary housing in extreme hardship cases when determined by the City to
be necessary to accomplish the relocation of the owner-occupant;
4 Any other expenses determined by the Crty to be necessary to complete the re housing
of the owner-occupant.

VI Additional Requirements
In order to protect the interests of recipients of payments under this Policy applicants shall
agree that contractors involved in the moving or storage of personal items shall comply
with the following requirements
1 Bonding or other provisions determined by the Crty to be necessary to assure the
contractor's satisfactory performance under his contract;
2. Appropriate contractor liability insurance when determined by the Crty to be necessary
3 Other requirements of law and regulations applicable to this Crty County and State.
