A Resolution

WHEREAS on January 10 1995 the City Council approved M&C G~
10942 retaining Glen Johnson and the law firm of Kelly Hart and Hallman as
outside legal counsel to assist the City Attorney in representing the City in a
lawsuit styled Fort Worth Independent School District v. City of Fort Worth and
Southwestern Bell Telephone Company, Cause No 141-156225-94 and
WHEREAS the law firm has previously billed the City a total of
$31x736 22 which has been paid; and
WHEREAS the law firm has billed the City an additional $14,216 14
for services rendered in the lawsuit which has not been paid, thereby increasing
to $45 952.36 the total legal fees incurred by the City during the pendency of the
lawsuit; and
WHEREAS it is anticipated that additional legal fees will be incurred
during the pendency of the lawsuit; and
WHEREAS it is necessary that a Resolution be adopted by the City
Council fixing at $75 000 the total compensation authorized to be paid to the law
firm for its services in the lawsuit;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH TEXAS
That the total compensation authorized to be paid tp Glen Johnson and
the firm of Kelly Hart and Hallman for their services relating to the lawsuit of Fort
Worth Independent School District v. City of Fort Worth and Southwestern Bell
Telephone Company be and is hereby increased to $75 000
ADOPTED this day of April 1997
