A Resolution ~--3 ~ ~
WHEREAS The D-FW International Airport Board (Airport Board') has passed resolutions
(i) authorizing offers to purchase avigation easement air rights above certain lands which are
needed in connection with airport expansion, (ii) requesting the Cities of Dallas and Fort
Worth, Texas (Cities') to jointly acquire for the Airport Board these avigation easements for
airport expansion purposes and (iii) agreeing to fund all costs associated with these
acquisitions and
WHEREAS as required by the Airport Use Agreement, a Majority In-Interest of D-FW
Airport s Signatory Airlines (including American and Delta) have approved the expenditure of
such Airport Board funds to acquire the avigation easements Now Therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH
SECTION 1 That, pursuant to the request of the Airport Board and subject to the conditions
of this resolution, the avigation easements over the properties described on Exhibits A and B
( Avigation Easements') from the owners listed on Exhibit A and for the amounts set forth on
Exhibit A each Exhibit attached hereto and made a part hereof shall be acquired on the
condition that the Airport Board has assumed responsibility for payment of all costs including
but not limited to the consideration, title expenses closing costs court costs court filing fees
appraisal costs expert appraisal witness costs cost associated with compliance with the
Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 and
applicable regulations and all other costs fees and expenses which shall be paid from the
proceeds of the. D-FW Airport
Joint Revenue Bonds or from any other available Airport Board fund
SECTION 2 That, following approval as to form by the Cities City Attorneys the City
Manager is authorized to accept, subject to the conditions contained in this resolution,
instruments conveying jointly to the Cities the properties described in Exhibits A and B
corrected to eliminate errors in the property descriptions and/or to reflect changes in
ownership
SECTION 3 That the property descriptions set forth in the attached Exhibits A and B of the
{Cities resolutions and the Airport Board resolutions be forwarded to a title insurance company
for preparation of instruments necessary for closing, which will be forwarded to the Cities
City Attorneys for approval as to form, and subsequent to closing filed in the Dallas County
Real Property Records and thereafter returned to the Cities for their permanent record.
SECTION 4 That, following approval as to form by the Cities City Attorneys and subject to
the terms of this resolution, the City Manager is authorized to execute such additional
instruments as may be necessary in connection with the acquisitions of the Avigation
Easements

SECTION 5 That, for the purpose of acquiring the Avigation Easements the Property
Management Director or such employee as she may designate is authorized and directed to
offer each amount listed on Exhibit A (Payment Amounts') to the respective owners of the
specific properties listed on Exhibit B ('Legal Description )
SECTION 6 That following each acquisition the D-FW Airport Plan be amended to include
the Avigation Easement area, and following its acquisition by the Cities each Avigation
Easement area shall be subject to the control and jurisdiction of the Airport Board pursuant to
the terms of the Contract and Agreement between the Cities dated and effective April 15
1968 and applicable provisions of the 1968 Regional Airport Concurrent Bond Ordinance
SECTION 7 That the approvals and authorizations contained in this resolution are
conditioned upon approval by the Dallas City Council of the joint acquisition of the Avigation
Easements
SECTION 8 That this resolution shall take effect immediately from and after its passage in
accordance with the provisions of the Charter of the City of Fort Worth, and it is accordingly
so resolved
