SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO.45953 �,�' G�yc�cs�Ge `a ENCROACHMENT AGREEMENT This SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO. 459531 ENCROACHMENT AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County, Texas,acting herein by and through its duly authorized City Manager, its duly designated Assistant City Manager or Planning and Development Director, hereinafter referred to as the "City," and BOARD OF REGENTS OF THE UNIVERSITY OF TEXAS SYSTEM, acting herein by and through its duly authorized representative, hereinafter referred to as"Licensee". RECITALS WHEREAS, the City of Fort Worth ("City") and Licensee made and entered into City Secretary Contract No. 45953-CAl on December 21, 2015 (the "Agreement") to authorize the use of right-of-way for the improvements described as follows: .1 —-- The encroachment is for 82 linear feet of sewer line with 6 cleanouts, 1 grease trap (250 gallons), 1 oil water separator (150 gallons), 21 square feet of backflow preventer vault, 1,016 linear feet of electrical conduit, 8 lighted bollards, 3 directional signs, 21 linear feet of storm drain, 144 square feet of ramp and wall, and 2,337 linear feet of PVC irrigation pipe and heads along Pennsylvania Avenue, Galveston Avenue,and West Annie Street. to be located in the public right-of-way;and WHEREAS, the parties wish to amend the Agreement for the improvements described as follows: The encroachment is for 82 linear feet of sewer line with 6 cleanouts, 1 grease trap (250 gallons), 1 oil water separator(150 gallons),21 square feet of backflow preventer vault, 150 linear feet of electrical conduit,24 linear feet of storm drain,and 133 irrigation heads along Pennsylvania Avenue, Galveston Avenue,and West Annie Street. Exhibits A through F are hereby attached hereto and incorporated herein to the Agreement, consisting of a revised description of the encroaching improvements. 2. City acknowledges that Licensee is a self-ensured governmental entity. As such,City agrees that the requirement to furnish City with a Certificate of Insurance,as more particularly described in Section 15 of the Agreement is hereby waived,provided that such waiver shall apply only to Licensee and not to any future assigns. 2.
