WHEREAS, the City of Fort Worth (City) and Montgomery Watson America
Inc. , (Engineer) made and entered into City Secretary Contract No. 24011,
(the Contract) which was authorized by the City Council by M&C C-16811 on
the 6 day of February, 1998; and
WHEREAS, the Contract involves engineering services for the
following project :
Design and construction management of South Holly Water Treatment Plant
Coagulant Feed System Improvements, project No.P77-060770500090.
WHEREAS, it has become necessary to execute Amendment No. 1 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their
duly authorized representatives, enter into the following agreement which
amends the Contract:

Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated October 12 ,
2000, a copy of which is attached hereto and incorporated herein. The
cost to City for the additional services to be performed by Engineer
total $48 , 042 .

Article II of the Contract is amended to provide for an increase in
the maximum fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid by
the City for all work and services shall not exceed the sum of $322, 109 .

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Request for Contract Amendment
Dear Sir:
This is to request a $48,042 contract amendment on the South Holly WTP Coagulant Feed
System Improvements project, as discussed previously and as documented in our earlier
letters of October 12, 2000 and March 30, 2001. This is the first and only amendment
request and will increase the contract upper limit to $322,109.
As described in our letters of October 12 and March 30, the construction period was
extended by 160 calendar days, resulting in additional construction phase services. The
extended construction period resulted from three change orders, which we described in
detail in our March 30 letter. These change orders were due to city-requested upgrades and
unforeseen conditions and not due to design errors and omissions.

SUBJECT AMENDMENT NO. 1 TO THE ENGINEERING AGREEMENT WITH MONTGOMERY
WATSON AMERICAS, INC. FOR DESIGN AND CONSTRUCTION MANAGEMENT OF
THE SOUTH HOLLY WATER TREATMENT PLANT COAGULANT FEED SYSTEM
IMPROVEMENTS
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to the
engineering agreement with Montgomery Watson Americas, Inc. (City Secretary Contract No. 24011)
for design and construction management of the South Holly Water Treatment Plant coagulant feed
system improvements, increasing the total contract cost by $48,042, to $322,109.
DISCUSSION:
On June 9, 1998 (M&C C-16811), the City Council authorized the execution of an engineering
agreement with Montgomery Watson Americas, Inc. to design and prepare construction plans and
specifications for construction of the coagulant feed system at the South Holly Water Treatment Plant.
The project consisted of construction of a new coagulant pump building, installation of a new ferric
sulfate tank, and modification to the existing chemical building including HVAC (heating, ventilation, and
air-conditioning) system improvements, and fiber optic cable installation.
The proposed Amendment No. 1 is for additional construction management and inspection service work
that will extend the length of the contract. The engineer will provide these additional services for a fee
not to exceed $48,042.
Montgomery Watson Americas, Inc. is in compliance with the City's M/WBE Ordinance by committing to
an additional 20% M/WBE participation on this amendment No. 1.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of
the Commercial Paper-Water Fund.
