HomeMy WebLinkAboutContract 26894 Amendment to City Secretary Contract No. 26123 CITY CONTRACT NO Y STATE OF TEXAS § COUNTY OF TARRANT § THIS contract amendment is made and entered into by and between the City of Fort Worth ("City"), acting by and through Libby Watson, its duly authorized Assistant City Manager, and Neighborhood Housing Services of Fort Worth, Inc. ("Contractor"), by and through Terry Ottley, its duly authorized Board President. Contractor's business address is 2315 N. Main St., Suite 401, Fort Worth, Texas 76106. WHEREAS, the City of Fort Worth and Contractor have heretofore entered into that City Secretary Contract No. 26123, dated August 18, 2000, to provide Contractor operating support funds on a fee for services basis to assist low and moderate income homebuyers with homeownership opportunities and homeowners with home improvement activities in Contractor's targeted neighborhoods, Polytechnic Heights, Near Northside and Riverside pursuant to a grant received from the United States Department of Housing and Urban Development ("HUD") through the Community Development Block Grant ("CDBG") Program and, WHEREAS, the said contract expires by its terms on May 31, 2001 and, WHEREAS, the parties have agreed that it is to their mutual benefit to extend Contract No. 26123 to meet the project goals. NOW, THEREFORE, in consideration of these premises and the terms and conditions hereinafter set forth, the parties covenant and agree as follows: 1. The term of Contract No. 26123 is hereby amended and extended for the period June 1, 2001 to December 31, 2001; 2. This contract may be extended for a period of upto one (1) year , if necessary, to achieve project goals. Contractor shall request the extension in writing and submit the request to the City sixty (60) days prior to the end of the contract. The City may then approve extension of the contract for another year. It is specifically understood that it is the City's sole discretion whether to approve or deny the request. If no request for extension is received after the expiration of the term of the contract, the unexpended balance shall automatically revert to the City's CDBG Program Fund. In such event, the contract is deemed terminated. 3. All other terms and conditions of the contract remain in full force and effect, binding upon the parties, and are hereby ratified by the parties. RECOMMENDATION: It is recommended that the City Council: 1. Authorize the City Manager to extend the Year XXVI Community Development Block Grant (CDBG) (City Secretary Contract No. 26123) with Neighborhood Housing Services of Fort Worth, Inc. (NHS) for the operation of its housing assistance programs for low and moderate income persons; and 2. Authorize the contract performance period to begin on June 1, 2001 and end on December 31, 2001; and 3. Authorize extension of the contract for up to one year, if NHS requests a further extension; and 4. Authorize amendment of the contract, if necessary, to achieve project goals provided that the amendment is within the scope of the project and in compliance with applicable laws and regulations. DISCUSSION: On May 5, 2000 (M&C C-17991), the City Council approved providing $55,958.00 in Year XXVI CDBG funds for NHS, a nonprofit, 501(c)(3) organization designed to strengthen and revitalize Fort Worth neighborhoods and communities. NHS has targeted three City neighborhoods for additional, intense, and concentrated services and programs which will reverse patterns of disinvestment and neighborhood deterioration, and, stabilize housing values in those neighborhoods. The three neighborhoods are Polytechnic Heights, the near Northside, and Riverside. The aim of NHS is to assist in the re-establishment of these target neighborhoods as healthy, self- sustaining neighborhoods with normal investment and reinvestment patterns. This process of neighborhood reinvestment is occurring through a partnership of residents, business leaders, local government, and a variety of federal and private capital sources. NHS' current City CDBG contract provides administrative support on a fee for services basis to assist low and moderate income homebuyers with homeownership opportunities, and homeowners with home improvement activities. In addition, NHS administers revolving loan programs in its near Northside and Polyi;echnic-Heights target neighborhoods. NHS is requesting a contract extension until December 31, 2001, to continue to utilize the remaining operating funds available under this contract, which by the end of May 2001 will be approximately $17,000 to help offset a projected administrative shortfall for its Fiscal Year October 1, 2000, to September 31, 2001. As of March 31, 2001, NHS has spent $32,132.00 of the $55,958.00. The current CDBG contract expired May 31, 2001. While NHS has additional funding commitments from other private and public sources forthcoming, they will not be available until after September 2001. In past years, NHS has been included in the City's CDBG budget for the period June 1st through May 31st, however, due to turnover in key NHS staff positions, NHS did not submit a proposal for funding this grant year. The approval of this request will allow NHS to continue to be a positive change agent in its target neighborhoods, and to assist the City as one of its nonprofit partners in meeting their mutual goal of revitalizing central City neighborhoods. F Neighborhood Housing Services of Fort Worth, Inc. provides services in COUNCIL DISTRICTS 2, 5, AND 8.
