CONSTRUCTION AND MAINTENANCE AGREEMENT
For Bridge Replacement or Rehabilitation
Off the State System
AMENDMENT No. 1
THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas, acting through the
Texas Department of Transportation,hereinafter called the State, and the City of Fort Worth,
acting by and through it's City Council,hereinafter called the Local Government.
WITNESSETH
WHEREAS,the State and the Local Government executed a contract on the 22"d of November
2002 to effectuate their agreement to replace the East 1" Street Bridge over the West Fork of the
Trinity River; and,
WHEREAS, it has become necessary to amend that contract to recognize the increase in the cost
of the equivalent-match projects and the increase in the construction cost of the project; and,
WHEREAS, the Governing Body of the Local Government has approved entering into
Amendment No. 1 by resolution or ordinance dated 8/9/05 r%C C20896 , which is attached
hereto and made a part hereof as Exhibit A; and,
NOW THEREFORE, in consideration of the premises and of the mutual covenants and
agreements of the parties hereto, the State and the Local Government do agree as follows:
AGREEMENT
Article 1. Description of Amended Items
Amendment Item A. —Attachment C. List of District Engineer Approved Equivalent-Match
Project(s) (EMP)is hereby superseded by Exhibit B.
Amendment Item B. —Attachment D. Estimate of Direct Costs is hereby superseded by
Exhibit C. Please note that the $2,910,063 listed in Line 6 of
Attachment D has been deleted and Line 6 is now zero. All costs for
roadway construction outside the limits of the bridge project will be
included in a separate agreement.

Article 2.
The state auditor may conduct an audit or investigation of any entity receiving funds from the
State directly under the contract or indirectly through a subcontract under the contract.
Acceptance of funds directly under the contract or indirectly through a subcontract under this
contract acts as acceptance of the authority of the state auditor,under the direction of the
legislative audit committee, to conduct an audit or investigation in connection with those funds.
Article 3.
All other provisions of the original contract are unchanged and remain in full force and effect.
Article 4. Signatory Warranty
The signatories to this amendment warrant that each has the authority to enter into this agreement
on behalf of the organization they represent.
IN WITNESS WHEREOF, THE STATE AND THE LOCAL GOVERNMENT have
executed duplicate counterparts to effectuate this agreement.

Authorization to Execute an Amendment to the Advance Funding Agreement with the Texas
Department of Transportation for the Replacement of the East First Street Bridge, the South
Pipeline Road Bridge and the Chapin Road Bridge
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 of the
Advance Funding Agreement with the Texas Department of Transportation (TxDOT) for the replacement of
the East First Street Bridge over the Trinity River, the replacement of the South Pipeline Road Bridge over a
tributary of the West Fork of the Trinity River and the replacement of the Chapin Road Bridge over Santa
Clara Channel.
DISCUSSION:
On October 22, 2002, (M&C C-19303) the City Council approved an Advance Funding Agreement with
TxDOT for the reconstruction of East First Street Bridge over the Trinity River (Bridge ID
02220ZZ0075002). Under the terms of that agreement, the City is responsible for 10% of cost of eligible
work on this project, plus 100% of costs that are deemed ineligible by TxDOT, including right-of-way
acquisition, utility relocation, environmental mitigation and any non-standard construction. TxDOT agreed
to waive the normal 10% cost participation in lieu of the City's agreement to replace, at its sole cost the two
minor bridges on South Pipeline Road (Bridge ID 022200ZP542003) and Chapin Road (Bridge ID
022200AC3475001).
The cost estimate for the East First Street Bridge has increased from $6,880,000 to $11,167,000 due to
increased structure size as determined by hydraulic studies unavailable at the time of the original estimates.
Cost estimates for the two minor bridges have shown a corresponding increase for the same reason.
On July 26, 2005, (M&C C-20868) Council adopted an Ordinance finding that the 2004 Capital
Improvement Program funds for the Precinct Line Road over Walkers Branch Bridge be reprogrammed in
the amount of $775,000.00 for two minor bridges. These two minor bridges (South Pipeline Road Bridge
and Chapin Road Bridge) are being used as the City's local match for both the Precinct Line Road Bridge
and the East First Street Bridge.
This M&C authorizes the City Manager to amend this Advance Funding Agreement to add the $775,000.00
to cover the increased cost of the two minor bridges.
These projects are located in Council Districts 3, 4 and 5.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the
Street Improvements Fund.
