' TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Halff Associates, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 33121, (the CONTRACT) which was authorized by M&C C-21239 on the 23rd day of January, 2006 in the amount of $ 286, 640; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $195, 000 which was authorized [by M&C # C-22078] on May 14, 2007, Amendment Number 2 in the amount of $577, 500 which was authorized [by M&C # C-229951 on August 26, 2008, Amendment Number 3 in the amount of $600, 400 which was authorized [by M&C # C-24212] on May 11, 2010, Amendment Number 4 in the amount of $726, 000 which was authorized [by M&C # C-24961] on June 14, 2011; and WHEREAS, the CONTRACT involves engineering services for the following project: HENDERSON STREET STORM DRAIN WATERSHED PLANNING STUDY (PHASE 7) ; and WHEREAS, it has become necessary to execute Amendment No. 5 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated March 151 2012, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $572, 000. 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $2, 957, 540. 3 . (Halff)has been under contract with the Stormwater Division of the City of Fort Worth Transportation and Public Works Department since 2005 in several roles. Among these roles are program management for the City's ongoing Neighborhood and Open Channel Study Program and the oversight and quality control for the City's ongoing Storm Water Management System Inventory Project. In this capacity Halff has provided contract administration services,technical quality assurance and quality control (QA/QC)for those studies under contract,and other services. More recently, Halff has provided its expertise to the City for its GIS Storm Water Inventory Project,which includes several tasks such as QA/QC of the GIS data and the resultant InfoWorks product. Finally, Halff has been responsible for updating the Fort Worth Local Drainage Criteria Manual and has assisted the DTPW with development drainage reviews. It is the intent of the City to have Halff Associates to continue in this capacity. A. Stormwater Management GIS Support and Quality Control With the assistance of Halff Associates, Inc.,the City of Fort Worth has developed a Stormwater GIS Program. The City is currently in the process of implementing the program. During the ongoing implementation of this program, Halff will continue to provide GIS support and assist with the quality control of the GIS database. The following consulting services will be provided to assist the City with their Stormwater GIS Program: 1. Perform quality control of the stormwater GIS database for 111 mapsheds by checking: a. Feature attributes b. Random sample against plan information c. Topology d. Proper import to InfoWorks. 2. Perform final review and approval for 165 mapsheds. 3. Process the Parker County LiDAR data within the City's ET1 and expand the City's current terrain database. 4. Update the mapshed boundaries using the City's terrain database and stormwater network. 5. Maintain the stormwater GIS quality control tools developed by Halff through the completion of the system inventory project(18 months). 6. Provide general consulting services and assistance with the GIS program implementation through the completion of the system inventory project(18 months). B. Neighborhood and Open Channel Study Assistance 1 The City is currently conducting open channel and neighborhood drainage studies to review the current drainage conditions in multiple watersheds to identify and evaluate potential improvements in various watersheds throughout the City. The task will be to provide continuing assistance to the City in the program. The goals of this task are to assist the City in: 1. Assist coordination of meetings between Storm Water Management and other consultants. 2. Provide guidance to consultants for the management and review of GIS data including topography,stream centerlines, and cross section layouts. 3. Provide administration assistance to the City for the review and coordination of a standardized scope of services,fee and schedule for each consultant selected by the City. This includes all awarded studies in which consultants have not submitted information Halff. 4. Provide detailed review of hydraulic cross section layout and proposed survey cross section layout prior to contract submittal. 5. Perform detailed technical review of hydrologic and hydraulic modeling and floodplain mapping for the 75%submittal (Existing Conditions). Halff will conduct a 75%review meeting with the City and the study consultant. 6. Perform detailed technical review of hydrologic and hydraulic modeling and floodplain mapping for the 90%submittal (Existing Conditions and Alternative Analysis). Halff will conduct a 75%review meeting with the City and the study consultant. 7. Perform cursory review of final report to ensure report format,as shown in scope of services,is being followed appropriately. No additional detailed reviews of the report will be prepared,unless requested by City staff. 8. Deliverables and Reports—Monthly progress reports will be prepared. Individual QA/QC reports regarding detailed technical review of open channel studies by Halff staff will be submitted to the City upon completion of the reviews. QA/QC reports will provide technical details of the review and if consultants are following appropriate format provided in scope of work. Hall will maintain project organization of data. C. Updates to Storm Water Local Design Criteria Manual and CIP Stormwater Plan Review and Training Halff will coordinate with City staff to finalize an updated Local Criteria Section(LCS)of the City's Storm Water Management Design Manual. Effort for this task is summarized below: 1. Complete updates of all remaining figures and cross reference in manual text. 2. Update the April 2011 posted draft of the City's Local Criteria Manual(LCM)to incorporate comments from past year. Post Final Draft on city website for public review and comments. 3. Respond to comments from public and City on updated draft of LCM and prepare Final Version for website posting and printing. Halff will assist the City with the review of Engineering Drainage Plans. The scope for the plan review is as follows: 2 1. Assist and help facilitate the process of implementing new procedures and requirements related to the 2006 iSWM Manual and the adoption of the 2011 iSWM Manual and new Grading Permit Ordinance,including those related to the preparation and review of the required iSWM Construction Plan and Stormwater Management Plan. 2. Backup Staffing: As needed,provide additional technical support to the Stormwater Department staff during this time of transition/implementation to avoid delaying the review of submitted plans. 3. Potential projects that could be included in the review process include: a. Small Commercial Permits b. Single Family Residential Permits: Could include referrals from Development for Residential Building Permits that are not standard. c. Plats d. iSWM Construction Plan Review: This is the most significant change in procedures and standards. e. Grading Permit applications, as required. f. FEMA CLOMR and LOMR Review:As needed,provide support for review of submitted floodplain-related applications,including review of hydrology and hydraulics. g. Review of Drainage Studies for Downstream Assessment:As needed, provide review of detailed H&H computations and downstream impact assessments for proposed development projects. 4. Other Services: This could include the complete array of review services provided by City. This could also include a Lessons Learned training session at end of review project, based on experiences during transition. S. City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION: Approved on 5/1/2012 DATE: Tuesday, May 01, 2012 REFERENCE NO.: **C-25582 LOG NAME: 20SWM-HENDERSON5 SUBJECT: Authorize Execution of Amendment No. 5 with Halff Associates, Inc., in the Amount of$572,000.00 to City Secretary Contract No. 33121 for Engineering Services Associated with the City's Stormwater Management Program for a Total Contract Amount of$2,957,540.00 (ALL COUNCIL DISTRICTS) RECOMMENDATION: It is recommended that the City Council authorize the execution of Amendment No. 5 to the engineering Agreement with Halff Associates, Inc., City Secretary Contract No. 33121, for the Henderson Street Storm Drain Watershed Planning Study in the amount of$572,000.00 for a total contract amount of $2,957,540.00. DISCUSSION: The scope for this Storm Water Management Division amendment provides for a continuation of technical and management assistance for the watershed and open channel study program, oversight of the stormwater mapping program, independent QA/QC assistance to Staff, plan review associated with new development activities and support for updating the City's stormwater design manual and implementing new grading permit procedures. In March 2004, Staff issued a Request for Qualifications (RFQ) for watershed planning studies and for management assistance with the study program. Halff Associates, Inc., was selected to manage the City's watershed study program. These management services were included in the Henderson Street Storm Drain Watershed Planning Study, which Halff Associates, Inc., was also selected to perform through that 2004 RFQ selection process. Program management work in previous phases of this Agreement included development of technical standards and scoping review for stormwater studies, technical oversight of watershed planning studies and open channel studies, a pilot project that established basic parameters for the City's current GIS mapping project and third-party technical review of the GIS mapping project. This will be the final amendment to this Agreement and will complete the existing work program begun in previous phases. A new consultant has been selected through a recent RFQ process to provide necessary program management services for new initiatives going forward. Halff Associates, Inc., proposes to perform this work for a lump sum fee of$572,000.00. Staff considers this fee to be fair and reasonable for the scope of services proposed. The original contract was funded by the 2004 CIP. Storm Water Utility funds have been used for all amendments. Halff Associates, Inc., is in compliance with the City's M/WBE Ordinance by committing to an additional 10 percent M/WBE participation on this Amendment No. 5.
