to Engineering Services Agreement for
Multiple Projects for the Riverside Wastewater Treatment Plant
Ned K. Burleson & Associates, Inc. will perform the following additional services related
to the environmental assessment, cleanup and regulatory closure of the City's
abandoned Riverside Wastewater Treatment Plant as delineated in the contract:
1. Additional Environmental Assessment involving collection
and analytical management of additional soil, sludge,
concrete, groundwater and water samples to confirm and
more accurately quantify concentrations of heavy metal
and PCB contaminants identified during previously conducted
assessment activities $47,880.00
2. Development of a coordinated risk-based closure strategy with
concurrence from the Texas Natural Resource Conservation
Commission (TNRCC) and the United States Environmental
Protection Agency (U.S. EPA) $25,740.00
Total Amendment No. 2 $73,620.00
The costs shown above for the additional environmental assessment include design and
implementation of the sampling plan for the additional assessment, management and
oversight of laboratory analyses to be performed by laboratories under City of Fort
Worth contract, review and compilation of laboratory analytical results, integration of
new analytical results with previous results, preparation of report summarizing all results
to date at the conclusion of the assessment, and presentation of the results and report
to City personnel. The costs do not include any laboratory analyses; these are to be
paid directly by the City to the City-contracted laboratories. These costs also do not
include any mechanical drilling costs; though it is anticipated that all additional soil
samples will be obtained using a hand auger or other manual means, if use of
mechanical drilling equipment should become necessary, the cost for drilling services
will be paid directly by the City to a City-contracted drilling company. The costs shown
above for development of the closure strategy include research of applicable state and
federal regulations; telephone calls, meetings and correspondence with the TNRCC and
U.S. EPA to negotiate a viable and acceptable closure strategy; preparation and
presentation of a formal proposal for risk-based closure to the TNRCC and U.S. EPA;
preparation of a Final Closure Plan; and meetings and conferences with the City. The
costs do not include preparation of risk assessment(s) or implementation of the Final
Closure Plan. An explanation of the project amendment is given in Exhibit A, a Scope
of Work is presented in Exhibit B, and a Fee Justification is presented in Exhibit C.

Due to the time required to complete the activities included in this amendment, the
Project Schedule in Exhibit D will also be amended as follows:
I. Additional Environmental Assessment 180 days following approval of
Amendment No. 2.
II. Development of closure strategy 180 days following completion of Additional
Environmental Assessment (360 days following approval of Amendment No. 2).

EXPLANATION OF AMENDMENT No. 2
Completion of the initial environmental assessment and closure study by Ned K.
Burleson and Associates, Inc. revealed apparent contamination of former sludge
lagoon soils and residual sludges at the former Riverside Wastewater Treatment
Plant with various heavy metals (arsenic, cadmium, lead, and mercury) and PCBs
(Aroclor 1260). Soil and groundwater outside of the former lagoons appeared to be
contaminated at some locations with lesser concentrations of cadmium, lead and
mercury. Because of the wide-ranging contaminant concentrations encountered and
the large area involved, it was determined that a risk-based regulatory closure would
result in the lowest closure costs while providing flexibility in terms of potential future
uses for the site. Due to the fact that the heavy metals fall under the regulations of
the Texas Natural Resource Conservation Commission (TNRCC) and PCBs fall
under the federal Toxic Substance Control Act (TSCA) as implemented by the
United States Environmental Protection Agency (U.S. EPA), concurrence and
approval from these two regulatory agencies for a risk-based closure will be needed
in order to achieve closure of this site. Acquisition of additional contaminant data
confirming and more accurately delineating the initial results is desirable prior to
initiating closure negotiations with the regulators. The additional assessment to be
performed under this amendment should help to confirm and more accurately
quantify concentrations of heavy metal and PCB contaminants prior to negotiating a
final closure with TNRCC and U.S. EPA. Once the additional data has been
obtained and summarized in conjunction with the previous data, negotiations with
the TNRCC and U.S. EPA can be initiated and a formal proposal can be prepared
and submitted for concurrence by the regulatory agencies. Upon receipt of
concurrence from those agencies, a Final Closure Plan can be prepared which
details the steps to be taken to achieve final regulatory closure of this site.

TREATMENT PLANT
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 to an
engineering agreement with Ned K. Burleson and Associates, Inc. for the preparation of an
environmental site assessment plan for the Riverside Wastewater Treatment Plant for a fee not to
exceed $73,620, thereby increasing the total fee to an amount not to exceed $1 .
DISCUSSION: ~
On April 9, 1996 (M&C C-15393), the City Council authorized an agreement with Ned K. Burleson and
Associates, Inc. for the preparation of an environmental site assessment plan for the Riverside
Wastewater Treatment Plant. The agreement was subsequently modified on May 14, 1996 (M&C C-
15448), to clarify the scope of the agreement. The Environmental Management Department is
administering the project for the Water Department.
Completion of the initial environmental assessment and closure study by Ned K. Burleson and
Associates, Inc. revealed potential contamination of former sludge lagoon soils and residual sludge at the
former Riverside Wastewater Treatment Plant. Because of the potential contaminant concentrations
encountered and the large area involved, it has been determined that a risk-based regulatory closure
would result in the lowest closure costs while providing the greatest flexibility in terms of potential future
uses for the site. Acquisition of additional contaminant data confirming and more accurately delineating
the initial results is desirable prior to initiating closure negotiations with the Texas Natural Resource
Conservation Commission (TNRCC) and the U.S. Environmental Protection Agency (EPA).
The additional assessment to be performed under this amendment should help to confirm and more

A waiver of the goal for M/WBE subcontracting requirements was approved by the M/WBE Office
because subcontracting opportunities are negligible on this amendment.

the Commercial Paper-Sewer Fund.
