LEASE AGREEMENT

This First Amendment to City Secretary Contract No. 24642 (the "Agreement") is made
and entered into by and between the HICKMAN INVESTMENTS, INC., a Texas Corporation,
by and through its duly authorized Chairman of the Board and CEO (hereinafter referred to as
the "Lessor") and the City of Fort Worth, by and through its duly authorized assistant city
manager(hereinafter referred to as the "Lessee).
WHEREAS, on February 5, 1999, the Lessor and Lessee entered into City Secretary
Contract No. 24642 where the Lessor demised and leased to the Lessee property located at 130,
131 and other addresses on East Exchange Avenue, Fort Worth, Texas 76106, together as the
Leased Premises, more particularly described in the attached Exhibit A, for the promotion and
use of the Fort Worth Herd program; and
WHEREAS, the Lessor and Lessee desire to amend said City Secretary Contract No.
24642 for the purpose of including additional property in the Leased Premises in order to
develop an interpretative exhibit for the Fort Worth.
NOW, THEREFORE, KNOW ALL PERSONS BY THESE PRESENTS:
That for good and valuable consideration which both parties acknowledge by their
signatures below,the Lessor and Lessee hereby covenant and agree as follows:
1.
That City Secretary Contract No. 24642 is hereby amended by adding Exhibit A-4 as part
of the Leased Premises in SECTION 1- GRANTING CLAUSE, and after said amendment,
Section 1 of City Secretary Contract No. 24642, shall read as follows:
SECTION 1- GRANTING CLAUSE.
That the Lessor, for and in consideration of the covenants, conditions, agreements and
stipulations hereinafter contained, DOES HEREBY DEMISE AND LEASE to the Lessee, and
the Lessee DOES HEREBY TAKE AND HIRE from the Lessor, as listed on attached Exhibit
A, to include Exhibits A-1, A-2, A-3 and A-4 ("Leased Premises") located at 130, 131 and other
addresses on East Exchange Avenue, Fort Worth, Texas 76106, togethe a9 -Leased P

more fully described in the Attached Exhibit A, to include Exhibits A-1, A-2, A-3 and A-4, and
made a part hereof.
2.
That all other terms and conditions of City Secretary Contract No. 24642 which are not
expressly amended herein, shall remain in full force and effect throughout the term of this
Agreement.
IN WITNESS WHEREOF, the parties hereto have made and entered into this amendment

SUBJECT AMEND LEASE AGREEMENT WITH HICKMAN INVESTMENTS, INC. TO PROVIDE
ADDITIONAL PROPERTY FOR THE FORT WORTH HERD PROGRAM
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to amend the current lease with
Hickman Investments, Inc. to include the property identified in the attached Exhibit A-4 of Amendment
No. 1 to City Secretary Contract No. 24642.
DISCUSSION:
On December 15, 1998 (M&C L-12400), the City Council approved a lease agreement with Hickman
Investments, Inc. providing office space, livestock pens and stable facilities for the Fort Worth Herd
program (City Secretary Contract No. 24642). The term of the lease is five years, with one five-year
option to renew. The agreement was entered into on February 5, 1999, at an annual lease fee of
$1.00.
The additional property shown in Exhibit A-4 will be utilized in the Fort Worth Herd education program.
The property is planned for a cattle demonstration area and an interpretive learning center utilizing the
original Scalehouse.
The Parks and Community Services Department is currently seeking grant funding and donations from
external sources for this renovation project which is estimated to cost $100,000.
This program is located in COUNCIL DISTRICT 2.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that this action will have no material effect on City funds.
