HomeMy WebLinkAboutOrdinance 18331-10-2008Ordinance No. 18331-10-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CULTURE AND TOURISM FUND IN THE AMOUNT OF $25,000.00 AND DECREASING THE UNAUDITED, UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT FOR THE PURPOSE OF AUTHORIZING THE ACQUISITION FROM JAGEE REAL PROPERTIES, L. P., ONE PERPETUAL PUBLIC ACCESS EASEMENT LOCATED AT LOT 4, BLOCK 1, WILLIAM J. BAILEY ADDITION; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2007- 2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Culture and Tourism Fund in the amount of $25,000.00 and decreasing the unaudited, unreserved, undesignated fund balance by the same amount, for the purpose of authorizing the acquisition from JaGee Real Properties, L. P., of one perpetual public access easement located at Lot 4, Block 1, William J. Bailey Addition. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Bailey Addition at a Cost of $25,000.00; and Adopt Appropriation Ordinance RECOMMENDATION: It is recommended that the City Council: 1. Approve the acquisition from JaGee Real Properties, L.P., of a perpetual Public Access Easement over approximately 0.076 acre of land located at Lot 4, Block 1, William J. Bailey Addition, as described in the plat recorded in Volume 310, Page 61 of the Plat Records of Tarrant County, Texas; 2. Find that the price offered in the amount of $25,000.00 is just compensation for the grant of such easement; 3. Authorize the acceptance and recording of appropriate instruments related to the grant of such easement; and 4. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Culture and Tourism Fund in the amount of $25,000.00 and decreasing the unaudited, unreserved, undesignated fund balance by the same amount in order to pay the acquisition cost. DISCUSSION: JaGee Read Properties, L.P. (JaGee), has received a license for artwork to be displayed on an exterior wall of the new federal post office under construction in the vicinity of the Museum Place development near the intersection of West 7th Street and University Drive. JaGee has acquired real property adjacent to the post office that is intended to be used as an open space park. The proposed easement will allow public access to this property and ensure visibility and access to the artwork. The cost of the proposed easement is $25,000.00, which will be funded from currently available revenues in the City's Cualture and Tourism Fund. This property is located in COUNCIL DISTRICT 7. FISCAL INFORMATION/CERTIFICATION: The Financiial Management Services Director certifies that upon approval of the above recommendations and adoptimu~ of the attached supplemental appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Culture and Tourism Fund. Upon approval, the unaudited, unreserved, undesignated fund balance of the Culture and Tourism Fund will be $4,380,852.00.
