RESOLUTION ACCEPTING THE PROVISIONS OF
TEXAS TRANSPORTATION COMMISSION MINIITE ORDER

accept the provisions contained in Minute Order 1067.42 passed
by the Texas Transportation Commission on February 29 1996
for the improvement by the Texas Department of Transportation of
the project described below
IH 35W From 0 3 mile south of Alliance Boulevard
To 0 2 mile north of SH 170 (in sections)
Vote on the motion was as follows

WHEREAS, in TARRANT COUNTY on INTERSTATE HIGHWAY 35W, two frontage road
expansion projects totaling a distance of 1 6 miles, from Westport Parkway to 0.2 mile south of Alliance
Boulevard, and from 0.2 mile south of Westport Parkway to 0.2 mile north of State Highway 170 are
being requested; and
WHEREAS, Minute Order 89068 dated July i 9 1989 approved interchange projects on
Interstate Highway 35W from Interstate Highway 820 to State Highway 114 for a total of
$18 7 million, and
WHEREAS, Minute Order 89068 stated that the Texas Department of Trarsporta_t.ion (the
department) would provide 100 percent of the construction cost for the interchanges located at Park Vista
and Alliance Boulevard, and the related frontage roads, and
WHEREAS, there is a total of $2.95 million which remains available from the previous
interchange projects; and
WHEREAS, the first section from Westport Parkway to 0.2 mile south of Alliance Boulevard
will be concrete pavement with curb and gutter while the second section from 0.2 mile south of Westport
Parkway to State Highway 170 will be a rural-type section with asphalt pavement; and
• WHEREAS, these projects will help alleviate heavy traffic volumes around the Texas Motor
Speedway'
NOW THEREFORE, IT IS ORDERED that the executive director is hereby directed to tender
the following proposal to the City of Fort Worth (the city}
Provided the city will.
1.Provide ten percent of the cost of all non-donated nght of way clear of obstruction and free of
cost to the State, with acquisition procedures to be in accordance with the policies of the
department, and with applicable Federal and State laws governing the acquisition policies for
acquiring real property
2.Provide the environmental clearance, schematics, right of way maps, field notes, plans,
specifications and estimates, m accordance with policies and procedures of the department and
subject to approval of the department and the Federal Highway Administration.
The department will
1 Provide ninety percent of the cost of all non-donated nght of way clear of obstructions with

Federal and. State laws governing the acquisttton pohctes for acgwnng real property
2.Provide one hundred percent of the cost of eligible utility adjustments as may be required in
accordance with pohctes of the department.
3.Provide one hundred percent of construction cost for the frontage road sections.
WHEREAS, this action is consistent with the 1995-1999 Strategic Plan strategy to plan, design,

IT IS FURTHER ORDERED THAT upon acceptance of the provisions of this Order by the city
the executive director is hereby authonzed to proceed m the most feasible and econoinic manner with
project development to include any necessary agreements, nght of way acquisition, utility adjustments,
relocation assistance and construction, at an estunated cost of $2.95 rtulhon to be programmed m Pnonty
I Strategic Pnonty Program of the 1996 Project Development Plan.
This order shall become operative upon acceptance by the city and if not accepted within 90
davs of the date hereof, the action herein contained shall be automatically canceled.
