A RESOLUTION ADOPTING POLICIES AND PROCEDURES GOVERNING THE
PROVISION OF RELOCATION PAYMENTS AND ASSISTANCE TO HOMEOWNERS
VOLUNTARILY DISPLACED UNDER THE CITY'S COMMUNITY DEVELOPMENT
PROGRAM.
WHEREAS, the City under its Community Development Block Grant program, provides assistance
to owner-occupants of inadequate and substandard dwellings for the purpose of repair and
rehabilitation of these dwellings on accordance with City Codes and Ordinances, and,
WHEREAS, there exist wuthon the designated project areas, occupied dwellings which cannot be
feasibly rehabilitated un accordance with the City's Rehabilitation Standards, and which constitute a
hazardous and dangerous condition to the communoty and their occupants, and,
WHEREAS, the City has determined that the removal of such unadequate and substandard dwellings
us consistent wuth its Commumty Development strategy and,
WHEREAS, rt us considered necessary to adopt a written policy available to the public setting forth
the relocation payments and assistance the City elects to provide under this program.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, AS FOLLOWS
That ut us appropriate to the City's Community Development Program to provide relocation payments
and assistance from project funds to the owner-occupants of homes whuuch are determined infeasible
to rehabilitate under the City's Home Improvement Loan Program guidelines, and that such
relocation payments and assistance shall be provoded upon request by eligible applicants to the Coty
on accordance with the provusuons of thus Resolution, as follows
I. General Polucy
It shall be the policy of the City of Fort Worth to provide relocation payments and assistance
on a manner set forth herein to an eligible owner-occupant of any home determined to be
unfeasible to rehabilutate under the City's Home Improvement Loan Program guidelines
whenever such owner-occupant voluntarily requests the relocation payments and assistance
authorized hereon, and who enters unto an agreement with the City to vacate his/her occupied
dwelling for the purpose of demolitoon and clearance Relocation payments and assistance as
authorized herein shall be Gamed out under the City's Community Development Block Grant
Program as an eligible expense from project funds, and shall be subject to (1) the availability
of grant funds, (2) HUD omplementing regulatoons, and (3) Basoc Eligibility Requurements and

• II. Basic Eligibility Requirements
Eligibility for relocation payments and assistance under the Policy may be granted only if the
following requirements are met
A. Residency
The person applying for relocation payments and assistance under this program must be the
owner-occupant of a dwelling which is the customary and usual place of residence of the
person, and for which dwelling, the owner-occupant has duly and properly submitted an
application for rehabilitation assistance under the City's Home Improvement Loan Program.
B Eligible for Rehabilitation Assistance
Except for the infeasibility of rehabilitation, an applicant for relocation payments and
assistance under this program must meet the eligibility requirements of the City's housing
Home Improvement Loan Programs.
C Rehabilitation Not Feasible
Housing Department staff shall have determined that the rehabilitation of the person s
• dwelling is not feasible under the City's Home Improvement Loan Program.
D Low to Moderate Income Owner-Occupants
Relocation payments and assistance under this program may be made only to owner
occupants of low to moderate income, as defined by the City under its CDBG Home
Improvement Loan Program.
III. General Conditions
As a condition of, and prior to any assistance under this Policy the person applying for
relocation payments and assistance must enter into a wntten Relocation Payment Agreement
with the City The Relocation Payments Agreement shall require the owner-occupant
applying for assistance to vacate permanently hisJher dilapidated dwelling at a time stipulated,
and to allow the City to demolish the dwelling and clear the site in such a manner as to
facilitate the construction of replacement dwelling. Costs associated with demolition and
clearance will be borne by the City Demolition and clearance action under this Policy shall
be contingent upon the owner-occupant s legal authority to permit such action.
IV Replacement Housing Payments
A. Replacement housing payments shall be provided to eligible owner occupants who
• have requested and been approved for such payments in accordance with this policy

. and who agree to actually obtain and occupy the dwelling for which the replacement
housing payment is made.
B Replacement housing payments shall not exceed the new construction cost, as
determined by the City of a dwelling adequate for the owner-occupant s family and
m compliance with City codes and ordinances.
V Moving Expenses
The City shall bear the costs of the actual, reasonable moving and related expenses necessary
to move a person approved for a replacement housing payment under this Policy from his
original vacated dwelling into the replacement dwelling.
VI. Eligible Miscellaneous Costs
The City will provide additional relocation payments to approved replacement housing
payment recipients far actual relocation-related costs as follows
A. Utility hook-up, or tap fees necessary to make the replacement dwelling ready for
full use and occupancy
B Closing and settlement costs related to the purchase of a replacement dwelling
• customarily borne by the purchaser
C Costs oftemporary housing in extreme hardship cases when determined by the Crty
to be necessary to accomplish the relocation of the owner-occupant;
D Any other expenses determined by the City to be necessary to complete the rehousing
of the owner-occupant.
VII. Additional Requirements
In order to protect the interests of a replacement housing payment recipient, and to assure
that any replacement dwelling obtained with a replacement housing payment will be
constructed in accordance with Crty codes and ordinances, and completed in a reasonable
and timely manner recipients of payments under this Policy shall agree that contractors
involved m the provision of any replacement dwelling shall subrrut to the following conditions
1 Bondmg,to assure the contractor's satisfactory performance under lis contract,
2 Appropnate Contractor's or Builder's risk insurance;
3 Customary one-year warranty of all workmanship and materials provided under any
replacement dwelling contract;

4 Other requirements of law and regulations applicable to this City and State
