HomeMy WebLinkAboutOrdinance 23093-01-2018 Ordinance No. 23093-01-2018 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL PURPOSE FUND, IN THE AMOUNT OF$20,000.00 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE NEIGHBORHOOD EMPOWERMENT ZONE (NEZ) PROGRAM CONSULTANT, TRAINING, AND OPERATIONAL COST; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Special Purpose Fund in the amount of$20,000.00,from available funds,for the purpose of funding the Neighborhood Empowerment Zone(NEZ) program consultant, training, and operational cost. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22927-09-2017 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached ordinance increasing estimated receipts and appropriations in the Special Purpose Fund in the amount of$20,000.00, from available funds, to fund the Neighborhood Empowerment Zone program consultant, training, and operational cost; and 2. Adopt the attached ordinance increasing estimated receipts and appropriations in the Special Purpose Fund in the amount of$21,805.00, from available funds, to fund the Annual Housing Summit. DISCUSSION: The Neighborhood Services Department is requesting that appropriations be increased in the Special Purpose Funds to properly record program revenue received from the Neighborhood Empowerment Zone (NEZ) program and sponsor contributions received for the Annual Housing Summit. Appropriations are needed to account for revenue received so that program expenditures can provide additional support of these two programs. On April 25, 2000, Mayor and Council Communication (M&C G-12897) approved the Policy Statement on the creation of Local Neighborhood Empowerment Zone (NEZ) and amended it on December 7, 2010 (M&C G-17133) and May 16, 2017 (M&C G-19010), in accordance with Chapter 378 of the Texas Local Government Code. The City Council also authorized the City Manager to develop administrative procedures for the NEZ Program. The NEZ Administrative Procedures were adopted by the City Council on October 3, 2000 (M&C G- 13030) and amended on May 15, 2007, December 7, 2010 and May 16, 2017 to initiate improved program requirements. Under the NEZ program, there is a $25.00 per application fee required to be paid by applicants. To date, NEZ related fees in the amount of$177,101.01 have been received in the Special Purpose Account but have not been appropriated. This request is to appropriate $20,000.00 for a NEZ consultant/training and operational cost of the NEZ program. The Annual Housing Summit has been sponsored by the City, the United States Department of Housing and Urban Development (HUD), the Fort Worth Housing Solutions and other agencies and companies for the last 14 years. Additional sponsor contributions have been received in prior years by: Bank of America, Logname: 19NS APPROPRIATIONCLEANUP Page 1 of 2 LegacyTexas, Wells Fargo, Greater Fort Worth Association of Realtors, Housing Channel, Berkshire Hathaway, Farmers Insurance, Cendera Funding, and Fort Worth Association of Realtists in the amount $21,805.00. This M&C does not request approval of a contract with a business entity.
