WHEREAS, The City of Fort Worth and RPGA Design Group, Inc. (Architect) made and entered into City
Secretary Contract No. 40667 (The Contract) which was authorized by the City Council by M&C G-16991,
the 20th day of July, 2007; and amended as Amendment No. 1 on the 23rd day of September, 2010 in the
amount of$33,850.00 plus $6,000.00 in reimbursable expenses; and amended as Amendment No. 2 on
the 161h day of May, 2011 in the amount of$17,400.00 plus up to $0.00 in reimbursable expenses; and
amended as Amendment No. 3 on the 301h day of March, 2015 in the amount of $5,170.00 plus up to
$0.00 in reimbursable expenses; and
WHEREAS, further amendment is necessary to reimburse the Architect as part of the design services
agreement for additional design services for additional utility easement establishment for services to the
building.
NOW THEREFORE, City and Architect, acting herein by and through their duly authorized
representatives, enter into the following agreement which amends the Contract:
1.
Article 1.1, SECTION I — SERVICES OF THE ARCHITECT, the following paragraphs are added to read
as follows:
"Provide additional professional services for providing easement surveys to the site for Fire
Station #42. The cost of this additional service is $3,825.00 plus up to $0.00 in reimbursable
expenses_ The scope of services is described more fully in the RPGA letter dated January 18,
2018, subject: FS #42, Additional Services — Utility Easement, which is attached hereto as
Attachment"A" and made a part of this Agreement.
2.
Paragraph 1 of SECTION V-COMPENSATION TO ARCHITECT, is amended as follows:
"The total compensation for all of the assignments to be performed by Architect as described in
CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of
$275,542.00 plus up to$11,750.00 in reimbursable expenses. "

All other provisions of this Contract which are not expressly amended herein shall remain in full force and
effect.

Additional Services—Utility Easement
Mr. Clements:
As you are aware, it wasn't until AT&T requested a copy of the recorded Right-of-Way for the future
Stone Road that we were notified that no legal documents had been finalized by the City of Fort
Worth to establish that Right-of-Way. A Right-of-Way or utility easement is required to be
established and recorded by the City of Fort Worth before AT&T and Atmos will agree to contract to
install their new services to F.S#42—KSA.has been requested by the Crty__to ppv.ide the-services-to
establish a utility easement for AT&T'-arid Atmos as quickly as possible fo mtmrraizay-delays fcr -' _ _
the completion of FS#42.
KSA has provided a proposal to provide those services for$3,825.00. We are requesting that our
agreement with the City for FS#42 be amended to allow completion of the required easements.
