_ The following additions, deletions, modifications or clarifications shall be made to the
appropriate sections of the plans and specifications and shall become a part of the
Contract Documents. Bidders shall acknowledge receipt of this Addendum in the space
provided on the Bid form.
GENERAL
Al-1 Pre-Bid Conference
A. Addition: "The Pre-Bid Conference attendee list is attached to this addendum.
Attendance at the Pre-Bid Conference was mandatory and only those firms that
were in attendance are eligible to bid the project as a Prime bidder. Attendance
by subcontractors was not mandatory."
Al-2 Part A-Comprehensive Notice to Bidders
A. Addition: Add the following to the end of the paragraph discussing pre-qualification
® of bidders,"The responsible bidder shall have successfully completed a minimum of
three projects similar in size and scope to this project, have a minimum of three years
of experience in the excavation, handling, confirmation sampling and disposal of
contaminated waste, and comply with the requirements of the authority having
jurisdiction.
Al-3 Part B—Proposal
A. Replacement: Remove the existing Proposal (pages 1-14)and replace it with the
attached new Proposal. Revisions to the proposal include the following:
1. Quantity and Unit Price modification for Bid Item No. 6—Disposal of Class II
PCB-Contaminated Soils < 50 ppm (PCLE Zone).
2. Quantity and Unit Price modification for Bid Item No. 7- Disposal of PCB-
Contaminated Soils > 50 ppm (PCLE Zone).
3. Add Bid Item No. 8A—TCLP Testing for RCRA Metals.
4. Clarification to Bid Item No. 47—24"and 36"Concrete Columns (including steel

Al-4 Section 01300- Submittals
A. Replacement: Remove the existing table- Submittal Schedule and replace it with the
attached new Submittal Schedule. Revisions to the Submittal Schedule include the
following:

Al-5 Section 01568—Storm Water Pollution Prevention During Construction

is not located within the PCLE zone. Backfill material within the PCLE zone
shall be disposed of at CSC Disposal and Landfill in Avalon, Texas.
Designate the remaining excavated materials located outside of the PCLE
.. zone as spoiled material and dispose of material off the site in accordance
with all applicable laws, ordinances, and codes. Contractor shall be
responsible for the storage, transportation, and deposition of spoiled material
and shall be responsible for acquiring the necessary permits, and the
payment of fees and duties at no additional cost to the Owner"

as PCB-contaminated soil (PCLE zone) shall be disposed of at CSC
Disposal in Avalon, Texas. Contaminated soil that is excavated shall be

Contractor shall assume all soils excavated from Zones 1, 2 and 4 will meet
criteria for classification as a TSCA-regulated, nonhazardous waste with
Class 2 characteristics containing less than 50 ppm PCB's. For bidding
purposes,the Contractor shall assume all soils excavated from Zone 3 will
meet criteria for classification as a Class 2 non-hazardous waste containing
greater than 50 ppm PCB's."

Al-9 Section 02403—Care of Water During Construction
A. Reference Page 02403—2
1. Modification: Modify Paragraph 3.03.A.to read, "Groundwater or runoff
water(which may be encountered during excavation of the PCB-
contaminated soil or during other excavations)which has come in contact
with PCB-contaminated soil shall be designated as "contaminated"and must
be contained and not be allowed to enter adjacent streams or otherwise exit
the site. The potentially contaminated water must then be tested for PCB
concentrations. Any water containing 3 ppb or more of PCB's must be stored
on-site in a clean frac tank approved by the Engineer. The Contractor shall
provide two frac tanks (40,000 gallon total)for storage of the PCB
contaminated-water. The City will be responsible for treatment and disposal
of this water. Water containing PCB concentrations less than 3 ppb shall be
discharged into the City's sanitary sewer system via a manhole located within
Gateway Park."

1. ADDITION: ADD THE FOLLOWING PARAGRAPH 3.03. "FIELD
QUALITY CONTROL; OBSERVATION AND ACCEPTANCE
a. OBSERVATION
Upon completion of the site preparation, mulching,fertilizing,
seeding, and maintenance of seeded areas, the Engineer will
observe the seeded areas periodically to determine the
establishment success. The Engineer will consider soil
_ coverage, purity of the grass stand, and maturity of the plants.
b. ESTABLISHMENT OF STAND AND ACCEPTANCE
The Engineer will determine that a grassed area is established
upon fulfillment of the following conditions:
1. The permanent grass stand uniformly covers the
planting area, with no exposed soil areas more than 36"
across in any dimension.
2. The permanent grass stand is free of over-topping weed
species which would compete for sunlight, moisture, and
nutrients. In addition, no area of pure weed species
greater than 36"across in any dimension shall occur
within a permanent grass stand.
3. The majority of the grass plants in a stand shall have a
well-established root system to survive if irrigation is
discontinued."
Al-11 Section 02831 —Chain Link Fences and Gates

1. Modification: Modify Paragraph 3.02 A.to read"The gates shall be installed
by skilled and experienced fence erectors and on level grades. For 6-0"
fence height, set line posts in concrete piers having a minimum size of 10" in
diameter and 36" deep. Gate posts for 6'-0"fence height shall be set in
concrete piers having a minimum size of 12" in diameter and 48"deep. For
18'-0"fence height, set line posts and gate posts as indicated on the plans.
The complete fence shall discourage tampering with connections and ends
shall be secured to prevent easy removal or disconnecting."

Includes the furnishing of all materials (except as specified to be furnished by the City),
equipment and labor for the installation of all improvements and appurtenant work
., shown in the plans and specification, all necessary appurtenances and incidental work
to provide a complete and serviceable project.
Pursuant to the foregoing "Notice to Bidders", the undersigned bidder, having
thoroughly examined the contract documents, including plans, special contract
documents, and the General Contract Documents and General Specifications for Water
Department Projects, the site of the project and understanding the amount of work to be
done, and the prevailing conditions, hereby proposes to do all the work, furnish all labor,
equipment and material except as specified to be furnished by the City, which is
necessary to fully complete the inspection and approval of the Director of the Water
Department of the City of Fort Worth, Texas; and binds himself upon acceptance of this
proposal to execute a contract and furnish an approved Performance Bond, Payment
Bond, and Maintenance Bond, and such other bonds, if any, as may be required by the
Contract Documents for the performing and completing of the said work.

The basis for bid award will be the lowest responsible Bidder for the Base Bid whose evaluation
by the City of Fort Worth, Texas indicates that the award will be in the best interests of the
Project if a contract is to be awarded.
Within ten (10) days after acceptance of this Proposal, the undersigned will execute the formal
contract and will deliver an approved Surety Bond and such other bonds as required by the
Contract Documents, for the faithful performance of the Contract. The attached bid security in
the amount of five (5%) percent is to become the property of the City of Fort Worth, Texas, in
the event the contract or bonds are not executed and delivered within the time above set forth,
as liquidated damages for delay and additional work caused thereby.
The undersigned bidder certifies that he has been furnished at least one set of the General
Contract Documents and General Specifications for Water Department Projects dated January
1, 1978, and that he has read and thoroughly understands all the requirements and conditions
of those General Documents and these specific Contract Documents and appurtenant plans.
The undersigned assures that its employees and applicants for employment and those of any
labor organization, subcontractors or employment agency in either furnishing or referring
employee applicants to the undersigned are not discriminated against as prohibited by the terms
of City Ordinance No. 7278 as amended by City Ordinance No. 7400.
The Bidder agrees to begin construction within 10 calendar days after issue of the work order,
and to complete the contract within 180 calendar days after beginning construction as set forth
in the written order to be furnished by the Owner. Liquidated damages shall be assessed as
indicated in section 7-7.10.
Construction Sequencing and Completion Dates:
The bidder agrees to complete the contract within 180 calendar days from the issuance of the
work order.

compensation for labor, equipment, tools, and incidentals necessary to
complete the work specified herein, including refilling of depressions. No
payment will be made for clearing and grubbing as such in the borrow areas
and cost thereof shall be included in the appropriate bid price of the type of
work included. The amount bid for"Clearing and Grubbing" shall not exceed

Includes the furnishing of all materials (except as specified to be furnished by the City),
equipment and labor for the installation of all improvements and appurtenant work
., shown in the plans and specification, all necessary appurtenances and incidental work
to provide a complete and serviceable project.
Pursuant to the foregoing "Notice to Bidders", the undersigned bidder, having
thoroughly examined the contract documents, including plans, special contract
documents, and the General Contract Documents and General Specifications for Water
Department Projects, the site of the project and understanding the amount of work to be
done, and the prevailing conditions, hereby proposes to do all the work, furnish all labor,
equipment and material except as specified to be furnished by the City, which is
necessary to fully complete the inspection and approval of the Director of the Water
Department of the City of Fort Worth, Texas; and binds himself upon acceptance of this
proposal to execute a contract and furnish an approved Performance Bond, Payment
Bond, and Maintenance Bond, and such other bonds, if any, as may be required by the
Contract Documents for the performing and completing of the said work.

The basis for bid award will be the lowest responsible Bidder for the Base Bid whose evaluation
by the City of Fort Worth, Texas indicates that the award will be in the best interests of the
Project if a contract is to be awarded.
Within ten (10) days after acceptance of this Proposal, the undersigned will execute the formal
contract and will deliver an approved Surety Bond and such other bonds as required by the
Contract Documents, for the faithful performance of the Contract. The attached bid security in
the amount of five (5%) percent is to become the property of the City of Fort Worth, Texas, in
the event the contract or bonds are not executed and delivered within the time above set forth,
as liquidated damages for delay and additional work caused thereby.
The undersigned bidder certifies that he has been furnished at least one set of the General
_ Contract Documents and General Specifications for Water Department Projects dated January
1, 1978, and that he has read and thoroughly understands all the requirements and conditions
of those General Documents and these specific Contract Documents and appurtenant plans.

employee applicants to the undersigned are not discriminated against as prohibited by the terms

The Bidder agrees to begin construction within 10 calendar days after issue of the work order,
and to complete the contract within 180 calendar days after beginning construction as set forth
in the written order to be furnished by the Owner. Liquidated damages shall be assessed as
indicated in section 7-7.10.

the Council Chambers at 2:00 PM. Any bid received after the closing time will be returned unopened
Plans and Specifications for this project may be obtained at the offices of Freese and Nichols, Inc., 4055
International Plaza Suite 200, Fort Worth, Texas 76109-4895, Telephone (817) 735-7300. A set of plans
and documents will be provided for a non-refundable fee of one hundred twenty-five dollars ($125)each.
A majority of the work consists of the following:
• Excavation and disposal of PCB-contaminated soil (PCLE Zone)
• Installation of geomembrane cap over existing soccer fields (approximately 400,000 sf)
• Installation of three synthetic grass sports fields over cap (approximately 330,000 sf)
• Construction of concrete pavement and concrete pavers
• Construction of new 60' diameter pavilion and fabric sails
• Construction of 12"—36" storm drain lines (approximately 3900 If)
Included in the above will be all other items of construction as outlined in the Plans and Specifications.
Pre-qualification of Bidders, according to the Special Instructions to Bidders in the Contract Documents or
the Fort Worth Water Department General Contract Documents and General Specifications is required.
The City reserves the right to reject any or all bids and waive any of all irregularities. Bidders shall be
allowed to modify and/or withdraw bids prior to bid opening. No bid may be withdrawn until the expiration
of 90 days from the date bids are received.

• Installation of geomembrane cap over existing soccer fields (approximately 400,000 sf)

• Construction of concrete pavement and concrete pavers
• Construction of new 60' diameter pavilion and fabric sails
• Construction of 12"—36"storm drain lines (approximately 3900 If)
Included in the above will be all other items of construction as outlined in the Plans and
Specifications.
Pre-qualification of Bidders, according to the Special Instructions to Bidders in the Contract
Documents or the Fort Worth Water Department General Contract Documents and General
Specifications is required.
The City reserves the right to reject any or all bids and waive any of all irregularities. Bidders shall
be allowed to modify and/or withdraw bids prior to bid opening. No bid may be withdrawn until the
expiration of 90 days from the date bids are received.
A mandatory pre-bid meeting will be held on Tuesday, July 12, 2005 at 9:00 a.m. in City of Fort
Worth Pre-Council Chambers, Municipal Building, 1000 Throckmorton Street, Fort Worth, Texas,

AWARD OF CONTRACT: No bid may be withdrawn until the expiration of ninety (90) days from
the date the M/WBE UTILIZATION FORM, PRIME CONTRACTOR WAIVER FORM, GOOD
FAITH FORM ("Documentation"), and/or the JOINT VENTURE FORM as appropriate is received
by the City. The award of the contract, if made, will be within ninety (90) days after this
documentation is received, but in no case will the award be made until all the necessary
investigations are made as to the responsibility of the bidder to whom it is proposed to award the u
contract.
Bidders are responsible for obtaining all addenda to the contract documents and acknowledging
receipt of the addenda by initialing the appropriate spaces on the proposal form. Bids that do not
acknowledge receipt of all addenda may be rejected as being non-responsive. Information

In accord with City of Fort Worth Ordinance No. 15530, the City of Fort Worth has goals for the

A copy of the Ordinance can be obtained from the Office of the City Secretary. The bidder shall `
submit the MBE/WBE UTILIZATION FORM SUBCONTRACTOR/SUPPLIER UTILIZATION
FORM, PRIME CONTRACTOR WAIVER FORM, GOOD FAITH EFFORT FORM
("Documentation") and/or the JOINT VENTURE FORM as appropriate. The Documentation must z
be received by the managing department no later than 5:00 p.m., five (5) City business days after

(SW3P) during construction. Bidders will not be required to prepare the SW3P. All bidders will
be required to have all on-site personnel fulfill the requirements of 29CFR 1910.120 by
completing OSHA's 40-hour training program for Hazardous Waste Operational Emergency
Responders. Personnel who will be working outside the PCLE Zone or working on-site after the
PCLE Zone has been capped or the contaminated soil removed will not be required to complete -
the 40-hour training program.

SPECIAL INSTRUCTIONS TO BIDDERS
(September 10,2004)
1. PREQUALIFICATION REQUIREMENTS. All contractors submitting bids, are
required to be pre-qualified by the Fort Worth Water Department prior to submitting
bids. This pre-qualification process will establish a bid limit based on technical
evaluation and financial analysis of the contractor. It is the bidder's responsibility to
submit the following documentation: a current financial statement, an acceptable
equipment schedule, names and addresses of each individual or business entity
owning 10% or more of the bidding entity, and any other documents the Department
may deem necessary, to the Director of the Water Department or his designated
representative, at least seven (7) calendar days prior to the date of the opening of bids.
a) COVER LETTER. The cover letter provided by the prospective bidder
with the pre-qualification information must include the following
information:
• Contact person (for additional information) if other than individual
who signed the cover letter
• If the bidder intends to submit a bid within thirty (30) days from the
date that the pre-qualification request is submitted to the City, a
statement as to the project to be bid and the date that the bids are
scheduled to be opened.
b) FINANCIAL STATEMENT. The financial statement required shall have
been prepared by an independent certified public accountant or
independent public accountant holding a valid permit issued by an
appropriate State licensing agency and shall have been so prepared as to
reflect the financial status of the submitting company. This statement must
be current and not more than one (1) year old. In the case that a bidding
date falls within the time a new statement is being prepared, the previous
statement shall be updated by proper verification.
C) EXPERIENCE RECORD. For an experience record to be considered to be
acceptable for a given project, it must reflect the experience of the firm
seeking qualification in the work of both the same nature and technical
level as that of the project for which bids are to be received. Experience
must be on projects that were completed no more than 5 years prior to the
date on which bids will be received. A minimum of three references must
be included. References must include a contact person name, telephone
number, project name and total cost, and type of work done (Utility
contractor shall list pipe size and pipe linear footage).
d) EQUIPMENT SCHEDULE. The prospective bidder shall list the
equipment that the Contractor has available for the project and list the
equipment that Contractor will rent as may be required to complete the
project on which the Contractor submits a bid.

The Water Department will review each pre-qualification submittal. From the financial
statement, the maximum bid limit will be based on amount of liquid assets times 10. The
expiration date for pre-qualification will be established as 15 months after the date of the
financial statement. The experience record will be reviewed and verified at the same time.
The following conditions will apply:
a) The Director of the Water Department shall be the sole judge as to the
acceptability for financial and experience qualification to bid on any Fort �-
Worth Water Department project.
b) Bids received in excess of the bid limit shall be considered non-responsive
and will be rejected as such.
C) The City, in its sole discretion, may reject a bid for failure to demonstrate -'
experience and/or expertise.
d) Any proposals submitted by a non pre-qualified bidder shall be returned
unopened, and if inadvertently opened, shall not be considered.
e) The City will attempt to notify prospective bidders whose qualifications i
(financial or experience) are not deemed to be appropriate to the nature
and/or magnitude of the project on which bids are to be received. Failure
to notify shall not be a wavier of any necessary pre-qualification.

2. BID SECURITY. A cashier's check, or an acceptable bidder's bond, payable to the
City of Fort Worth, in the amount of not less than five (5%) percent of the largest
possible total of the bid submitted must accompany the bid, and is subject to
forfeiture in the event the successful bidder fails to execute the Contract Documents
within ten (10) days after the contract has been awarded. To be an acceptable surety
on the bid bond, the surety must be licensed to do business in the State of Texas. In r
addition, the surety must (1) hold a certificate of authority from the United States
Secretary of the Treasury to qualify as a surety on obligations permitted or required R
under federal law; or (2) have obtained reinsurance for any liability in excess of
$100,000 from a reinsurer that is authorized and admitted as a reinsurer in the State of
Texas and is the holder of a certificate of authority from the Untied States Secretary
of the Treasury to qualify as a surety on obligations permitted or required under
federal law. Satisfactory proof of any such reinsurance shall be provided to the City
upon request. The City, in its sole discretion, will determine the adequacy of the proof
required herein.

3. BONDS. A performance bond, a payment bond, and a maintenance bond each for one
hundred(100%)percent of the contract price will be required. Reference C3-3.7.
4. WAGE RATES.Not less that the prevailing wage rates established by the City of Fort
Worth, Texas, and as set forth in the Contract Documents. must be paid on this
project.
_ 5. AMBIGUITY: In the case of ambiguity or lack of clearness in stating prices in the
Proposal, the City reserves the right to adopt the most advantageous construction
thereof to the City or to reject the Proposal.
6. BIDDER LICENSE: Prior to the award of contract to an out-of-state bidder, the
_ bidder shall be licensed to do business in the State of Texas. For licensing procedures,

7. NONRESIDENT BIDDERS: Pursuant to Article 601g, Texas Revised Civil Statues,
the City of Fort Worth will not award this contract to a nonresident bidder unless'the
nonresident's bid is lower that the lowest bid submitted by a Texas resident bidder by
the same amount that a Texas resident would be required to underbid a nonresident
bidder to obtain a comparable contract in the state in which the nonresident `s
z principal place of business is located.
"Nonresident bidder" means a bidder whose principal place of business is not in this
state, but excludes a contractor whose ultimate parent company or majority owner has
a place of business in the State of Texas.
This provision does not apply if this contract involves federal funds.
The appropriate blanks of the Proposal must be filled out by all nonresident bidders in
order for the bid to meet specifications. The failure of a nonresident contractor to do
so will automatically disqualify that bidder.
8. PAYMENT: If the contract amount is $25,000 or less, the contract amount shall be
paid within forty-five (45) days after the completion and acceptance by the City.
9. AGE: In accordance with the policy ("Policy") of the Executive Branch of the Federal
Government, Contractor covenants that neither it nor any of its officers, members,
T agents, employees, program participants or subcontractors, while engaged in
performing this contract, shall, in connection with the employment, advancement or
discharge of employees or in connection with the terms, conditions or privileges of
- their employment, discriminate against persons because of their age except on the
basis of a bona fide occupational qualification, retirement plan or statutory
requirement.
Contractor further covenants that neither it nor its officers, members, agents,
employees, subcontractors, program participants, or persons acting on their behalf,
shall specify, in solicitations or advertisements for employees to work on this

contract, a maximum age limit for such employment unless the specified maximum
age limit is based upon a bona fide occupational qualification, retirement plan or
statutory requirements.
Contractor warrants it will fully comply with the policy and will defend, indemnify
and hold City harmless against any claims or allegations asserted by third parties or
subcontractors against the City arising out of the Contractor's and/or its
subcontractors' alleged failure to comply with the above referenced Policy concerning
age discrimination in the performance of the contract.
10. DISABILITY: In accordance with provisions of the Americans with Disabilities Act
of 1990 ("ADA"), Contractor warrants that it and any and all of its subcontractors will
not unlawfully discriminate on; the basis of disability in the provision of services to
the general public, nor in the availability, terms and/or conditions of employment for
applicants for employment with, or employees of the Contractor or any of its
subcontractors. Contract warrants it will fully comply with ADA's provision and any
other applicable Federal, State, and local laws concerning disability and will defend,
indemnify and hold harmless against any claims or allegations asserted by third
parties or subcontractors against the City arising out of the Contractor's and/or its
subcontractors' alleged failure to comply with the above referenced Policy concerning
disability discrimination in the performance of this contract.
11. MINORITY AND WOMEN BUSINESS ENTERPRISES: In a accord with City of

grounds for termination of the contract and/or initiating action under appropriate
Federal, State or local laws or ordinances relating to false statements. Further, any
such misrepresentation facts (other than a negligent misrepresentation) and/or
commission of fraud will result in the Contractor being determined to be irresponsible

12. ADDENDA: Bidders wanting further information, interpretation or clarification of
the contract documents must make their request in writing to the Fort Worth Water
Department Engineering Services, at least 96 hours prior to bid opening. Answers to
all such requests will be bound and made a part of the Contract Documents. No other
explanation or interpretation will be considered official or binding. Should a bidder
find discrepancies in, or omissions from, the Contract Documents, or should the
bidder be in doubt as to their meaning, the bidder should at once notify the Fort
Worth Water Department Engineering Services, in order that a written addendum may
be sent to all bidders. Any addenda issued will be mailed or be delivered to each
prospective bidder. The bid proposal as submitted by the bidder must be so
constructed as to include any addenda issued by the Fort Worth Water Department,
