Worth is a home-rule city lying and being situated in the Counties of Tarrant and Denton State of Texas end WHEREAS the City of Burleson is a home-rule city lying and being situated in the Counties of Tarrant and Johnson State of Texas and WHEREAS the City of Fort Worth and the City of Burleson desire to adjust their corporate boundary lines whereby the City of Fort Worth will disannex from its corporate limits a certain 3 584 acre tract of land so that it may be annexed by the City of Burleson and the City of Burleson will disannex from its corporate limits a certain 0 747 acre tract of land so that it may be annexed by the City of Fort Worth ,~ NOW THEREFORE BE IT RESOLVED AND MUTUALLY AGREED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH AND THE CITY COUNCIL OF THE CITY OF BURLESON That pursuant to Section 43 031 of the Texas Local Government Code the following corporate boundary change and realignment between the City of Fort Worth and the City of Burleson as hereinafter described is in the interest of the property owners and inhabitants of both cities and the City of Fort Worth and the City of Burleson agree to proceed with due diligence in adopting the necessary annexation and disannexation ordinances adjusting their respective corporate boundaries and conducting all other proceedings necessary to effectuate this agreement. 2 That the City of Fort Worth hereby agrees to disannex from its corporate limits and to release from its extraterritorial jurisdiction the following described property which property is depicted in detail on the map attached hereto marked Exhibit `A and incorporated herein for all purposes Being that certain tract of land situated in the Sarah Gray Survey Abstract Number 558 Cities of Fort Worth and Burleson Tarrant County Texas and being comprised of a portion of Tract `B" and all of Tract A as described by Deed to J C Pace & Company recorded in Volume 6709 Page 691 of the Deed Records Tarrant County Texas and a portion of that tract of land conveyed to J C Pace & Company recorded in Volume 8852 Page 1063 of said Deed Records and being more particularly described by metes and bounds as follows Beginning at the intersection of the southerly right-of-way of Boone Road (a called 50 foot right-of-way) and the westerly of Stone Road (a 90 foot right-of-way) Thence N 89° 39' 53" W 161 63 feet with said southerly right-of way• Thence N 00° 08 17" E 660 80 feet, departing said north right-of way to the beginning of anon-tangent curare to the left, Thence with said non-tangent curve to the left, an arc distance of 300 80 feet, through a central angle of 16° 58' 51 having a radius of 1014 93 feet, the long chord of which bears N 52° 05 24 W 299 70 feet, to the southerly right-of-way of Alsbury Boulevard (a variable width right-of-way) Thence S 89° 54 22" E 398 53 feet, with said southerly right-of way to a 5/8 inch iron rod with plastic cap stamped "Carter & Burgess" found in the west right-of way line of said Stone Road Thence S 00° 08 17" W 845.23 feet, with said west right-of-way • to the point of beginning and containing 156 100 square feet or 3 584 acres of land more or less 3 That the disannexation of the above described land or territory by the City of Fort Worth shall automatically effectuate a release and relinquishment to the City of Burleson of all extraterritorial jurisdictional rights which the City of Fort Worth may have in said described land 4 That the City of Burleson hereby agrees to annex the territory disannexed and released by the City of Fort Worth as described in paragraph 2 above and shown on Exhibit A hereof and the City of Burleson agrees to assume all rights and obligations appurtenant to said territory 5 That the City of Burleson hereby agrees to disannex from its corporate limits and to release from its extraterritorial jurisdiction the following described property which property is depicted in detail on the map attached hereto marked Exhibit "A and incorporated herein for all purposes C 2 Being all that certain tract of land situated in the Sarah Gray • Survey Abstract Number 558 Cities of Fort Worth and Burleson Tarrant County Texas and comprised of all said land as described by deed J C Pace and Company recorded in Volume 8852 Page 1063 of Deed Records Tarrant County Texas and being more particularly described by metes and bounds as follows Beginning at a'h inch iron rod found at the northeast corner of Lot 1 Block 1 Village Addition an Addition to the City of Burleson recorded in Volume 388-126 Page 55 of plat records Tarrant County Texas and being in the southerly right-of-way of Alsbury Boulevard (a variable width right-of-way) as recorded in Volume 8588 Page 1489 of said deed records THENCE S89° 58 00"W 212 38 feet, with said southerly right-of way of Alsbury Boulevard to a point of intersection with the east right-of-way line of Interstate Highway 35 (East) as conveyed to the State of Texas recorded in Volume 4671 Page 222 of Deed Records of Tarrant County Texas and the northwest corner of said Lot 1 Block 1 Village Addition THENCE N00° 15 45" E 130 33 feet, with the east right-of-way line of Interstate Highway 35 (East) to a point of intersection with the northerly right-of-way line of Alsbury Boulevard (a variable width right-of-way) • THENCE N89° 58 00"E 91 55 feet along said northerly right-of way line of Alsbury Boulevard to a point said point being the beginning of anon-tangent curve concave to the southeast; THENCE along said curve in a southeasterly direction through a central angle of 29° 20' 34 an arc distance of 519 78 feet to a point of intersection with the southerly right-of-way line of Alsbury THENCE N89° 54 22" W 376 99 feet along the southerly right-of way of Alsbury Boulevard to said POINT OF BEGINNING and containing 0 747 acres of land more or less 6 That the disannexation of the above described land or territory by the City of Burleson shall automatically effectuate a release and relinquishment to the City of Fort Worth of all the extraterritorial jurisdictional rights which the City of Burleson may have in said described land 7 That the City of Fort Worth hereby agrees to annex the territory disannexed and released by the City of Burleson as described in Paragraph 5 above and shown on Exhibit A' hereof and the City of Fort Worth agrees to assume all rights and obligations appurtenant to said territory • 3 ~, 8 • That the City of Fort Worth and the City of Burleson do hereby covenant and agree to protect, preserve and defend the herein described boundary adjustments 9 That the City of Fort Worth and the City of Burleson agree and resolve that the adoption by both cities of this Joint Resolution and Agreement, and the disannexations and annexations resulting therefrom do not mitigate diminish or lessen in any way the rights that either party may have at law or in equity to challenge or contest any other annexations attempted annexations or extraterritorial jurisdiction claims made by the other party 10 That this Joint Resolution and Agreement shall become effective and shall become a binding agreement upon the City of Fort Worth and the City of Burleson by the adoption of same in regular open city council meetings of the City of Fort Worth and the City of Burleson 11 That this Joint Resolution and Agreement, upon adoption by both cities shall be executed in duplicate originals by the Mayor of each City • PASSED AND APPROVED by the City Council of the City of Fort Worth on this day of_J/~y_J ,
