:y A Resolution ~I~~9 CANVASSING THE VOTES AND DECLARING RESULTS OF THE ELECTION HELD ON MARCH 4, 1995, CREATING THE FORT WORTH. CRIME CONTROL AND PREVENTION DISTRICT AND ADOPTING A LOCAL SALES AND USE TAX AT A RATE OF ONE-HALF OF ONE PERCENT WHEREAS on January 24, 1995, the Temporary Board of Directors of the Fort W©rth Crime Control and Prevention District adopted a reso~],ution calling for an election to be held on March 4, 1995, to allow the qualified voters of the proposed District to consider the creation of the Fort Worth Crime Control and Prevention District and the adoption of a local sales and use tax in support thereof and WHEREAS, on March 4, 1995 the duly called and ordered election to consider the creation of the District and the adoption of the sales and use tax was held, at which election the qualified voters of the proposed District had the opportunity to vote for or against the proposition authorizing the creation of the District and adoption of the proposed tax and WHEREAS, on March 8, 1995, the Temporary Board of Directors of the Fort Worth Crime Control and Prevention District adopted a Resolution canvassing the votes and making certain findings concerning the results of said election a copy of which Resolution, and the findings therein, is attached hereto and made a part hereof and WHEREAS, following the canvassing of said votes and the adoption of said Resolution, the Temporary Board of Directors adopted an Order declaring the creation of the Fort Worth Crime Control and Prevention District and levying a local sales and use tax of one-half of one percent, a copy of which Order is attached hereto and made a part hereof and WHEREAS, pursuant to Section 321 405 of the Texas Municipal Sales and Use Tax, the City Council of the City of Fort Worth is required to declare by resolution the results of said election CITY OF FORT WORTH RESOLUTION CANVASSING VOTES AND MAKING FINDINGS CONCERNING THE RESULTS OF THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT CREATION ELECTION HELD ON MARCH 4, 1995 WHEREAS, on January 24, 1995, the Temporary Board of Directors of the Fort Worth Crime Control and Prevention District adopted a resolution calling for an election to be held on March 4, 1995, to allow the qualified voters of the proposed District to consider the creation of the Fort Worth Crime Control and Prevention District and the adoption of a local sales and use tax in support thereof and WHEREAS, on March 4 1995, the duly called and ordered election to consider the creation of the District and the adoption of the sales and use tax was held, at which election the qualified voters of the proposed District had the opportunity to vote for or against the proposition authorizing the creation of the District and adoption of the proposed tax and WHEREAS, the Temporary Board of Directors of the Fort Worth Crime Control and Prevention District has investigated all matters pertaining to said election, including the ordering and giving notice of said election, and the holding and making returns of said election and finds that in all respects, said election was held under and in strict conformity with the Constitution and laws of the State of Texas and WHEREAS, the election officers who held said elections have duly made the return of the results thereof and said return has been duly delivered to the Temporary Board of Directors of the Fort Worth Crime Control and Prevention District NOW, THEREFORE, BE IT RESOLVED BY THE TEMPORARY BOARD OF DIRECTORS OF THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT SECTION 1 That the matters and facts set forth in the preamble of this Resolution are hereby found to be true and correct SECTION 2 That the Temporary Board of Directors of the Fort Worth determines Control and and use tax Crime Control and Prevention District finds and that the creation election of the Fort Worth Crime Prevention District and the adoption of a local sales at a rate of one-half of one percent, was duly ordered that proper notice of said election was given that proper election officers were duly appointed prior to said election that said election was duly held, wherein only qualified voters of the proposed District voted in the creation election and that due return of the results of said election have been made and delivered to the Temporary Board of Directors of the Fort Worth Crime Control and Prevention District, all in accordance with the Resolution ordering and calling said election SECTION 3 That the Temporary Board of Directors of the Fort Worth Crime Control and Prevention District officially finds and determines that the following votes were cast at said election on the submitted Proposition by the qualified voters of the proposed District voting at said election PROPOSITION 17,327 VOTES FOR "THE CREATION OF THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT DEDICATED TO CRIME REDUCTION PROGRAMS, AND THE ADOPTION OF A PROPOSED LOCAL 12,208 VOTES AGAINST SALES AND USE TAX AT A RATE OF ONE-HALF OF ONE PERCENT i SECTION 4 That the Temporary Board of Directors of the Fort Worth Control and Prevention District officially finds determines and declares the result of said election to be that the Proposition so submitted has received a favorable majority vote in all respects and has carried by a margin of 5,119 votes that pursuant to Article 2370c-4, VAC S the Fort Worth Crime Control and Prevention District has been created and authorized to operate within the prescribed boundaries of the District that accordingly, a local sales and use tax of one-half of one percent has been adopted pursuant to said election and that said tax may be levied and collected as voted and provided by law to assist in funding the creation of the Fort Worth Crime Control and Prevention District and the carrying out of the District's crime control and prevention plan SECTION 5 That it is hereby officially found and determined that the meeting of the Temporary Board of Directors of the Fort Worth Crime Control and Prevention District, at which this Resolution was adopted, was open to the public and that public notice of the time place and purpose of said meeting was given, all as required by Chapter 551 of the Texas Government Code C. 2 • SECTION 6 That this in full force and effect from said date being the 8th day of ATTEST Resolution shall take effect and be and after the date of its adoption, March 1995, and it is so resolved Fort Worth Crime Control and Prevention District • i i • ORDER DECLARING CRIME CONTROL LEVYING A LOCAL ONE-HALF OF ONE CREATION OF THE FORT WORTH AND PREVENTION DISTRICT AND SALES AND USE TAX AT A RATE OF PERCENT WHEREAS, on January 24, 1995, the Temporary Board of Directors of the Fort Worth Crime Control and Prevention District adopted a resolution calling for an election to be held on March 4, 1995, to allow the qualified voters of the proposed District to consider the creation of the Fort Worth Crime Control and Prevention District and the adoption of a local sales and use tax in support thereof and WHEREAS, on March 4, 1995, the duly called and ordered election to consider the creation of the District and the adoption of the sales and use tax was held at which election the qualified voters of the proposed District had the opportunity to vote for or against the proposition authorizing the creation of the District and the adoption of the proposed tax and WHEREAS, the Temporary Board of Directors of the Fort Worth Crime Control and Prevention District has investigated all matters pertaining to said election, including the ordering and giving notice of said Fort Worth Crime Control and Prevention District and WHEREAS, upon receipt of said return, the Temporary Board of Directors of the Fort Worth Crime Control and Prevention District adopted a resolution canvassing the votes and making findings concerning the results of said election and WHEREAS, upon the canvassing of the results of said election, the Temporary Board of Directors of the Fort Warth Crime Control and Prevention District officially found, determined and declared that the Proposition submitted at said election received a favorable majority vote in all respects and carried by a margin of 5,119 votes NOW, THEREFORE, BE IT ORDERED BY THE TEMPORARY BOARD OF DIRECTORS OF THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT • 1 That pursuant to Article 2370c-4, V A C 5 specifically Section 3 07 (b) thereof, the Fort Worth Crime Control and Prevention District is hereby created, the boundaries of which shall be the same as the boundaries of the City of Fort Worth, as same may be adjusted from time to time and that the Fort Worth Crime Control and Prevention District is hereby authorized to operate within the prescribed boundaries of said District 2 It is further ordered that a sales and use tax of one-half of one percent is hereby adopted and shall be levied and collected as voted and provided by law to assist in the funding of the creation of the Fort Worth Crime Control and Prevention District and the carrying out of the District's crime control and prevention plan 3 Further, it is hereby declared that the meeting of the Temporary Board of Directors of the Fort Worth Crime Control and Prevention District, at which this Order was adopted, was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551 of the Texas Government Code 4 This Order shall take effect and be in full force and effect from and after the date of its adoption, said date being the 8th day of March, 1995,
