Home My WebLink AboutContract 26972 CITY SECRETARY CONTRACT NO CONSTRUCTION CONTRACT THE STATE OF TEXAS § CITY SECRETARY CONTRACT NO. (No M&C Needed) COUNTY OF TARRANT § This agreement made this day by and between the City of Fort Worth (City) and Watts Drilling Company(Contractor) as follows: 1. THE WORK UNDER PART"A" The Contractor shall perform the work as required by this contract for: A. Disassemble an existing 21,000 gallon epoxy coated bolted steel ground storage , tank located at the old Crest Point Water Supply Corporation Well Site. B. Remove the steel support ring around the foundation of the tank. C. Move both the disassembled tank and the support ring to the location designated at the Rolling Hills Water Treatment Plant. D. Erect the bolted steel tank, using new bolts, washers, fasteners, and gaskets; on a foundation provided by the City of Fort Worth. 2. TIME FOR PART"A" The Work for Part "A" to be performed by the Contractor shall commence on the date of the established Notice to Proceed for Part "A", given by the City of Fort Worth. Thereafter, substantial completion, to be defined as erection of the bolted steel tank at the designated site at the Rolling Hills Treatment Plant, shall be achieved in not more than ten(10) calendar days. 3. THE WORK FOR PART"B" Upon completion of the new powdered activated carbon feed facility under the "Rolling Hills Water Treatment Plant—Phase 1 Ozonation Facilities Project", the City will issue Watts Drilling Company a second Notice to Proceed. The Work under Part `B" shall consist of the dismantling and removal of the 21,000 gallon Crest Point tank. It is anticipated that the Notice to Proceed for the Work under Part`B"will be issued in April 2002. 1 ~ O 4. TIME FOR PART `B" The Work under Part "B" to be performed by the Contractor, shall commence on the date of the established Notice to Proceed for Part `B", given by the City of Fort Worth. Thereafter, substantial completion, to be defined as the removal of the 21,000 gallon Crest Point ground storage tank from the Rolling Hills Water Treatment Plant property, shall be achieved in not more than ten(10) calendar days. 5. LIQUIDATED DAMAGES Liquidated damages are hereby established for work which is not substantially complete in the amount of One Hundred Dollars ($100.00) per Calendar Day for each Calendar Day after the date established by the Notice to Proceed for Substantial Completion. 6. PAYMENTS The City shall pay the Contractor a lump sum payment in the amount of 90% of the Contract Sum, not later than thirty (30)days after substantial completion of the Work described under Part "A". The City shall pay the remaining 10% of the contract sum not later than thirty (30) days after substantial completion of the work described under Part `B". 7. LIABILITY INDEMNITY The Contractor agrees to indemnify, defend, and hold harmless the City of Fort Worth, Texas, and all of their respective officers, agents, and employees from all suits, actions, claims, damages, personal injuries, losses, property damages, and expenses of any character whatsoever, including attorney's fees brought for or on account of any injuries of damages received or sustained by any person or property on account of any negligent act of the Contractor,the City of Fort Worth, Texas, or any of their respective officers, employees, agents, representatives, or subcontractors in the execution, supervision, and operations growing out of or in any way connected with the performance of this agreement,whether or not the act or omission of the City or any of their respective officers, employees, or agents was the sole proximate cause of injury or damage or a proximate cause jointly or concurrently with the negligence of the Contractor of its officers, employees, Gents, Contractors, or Subcontractors, in the execution, supervision and operations growing out of or in any way connected with the performance of this agreement. 8. INSURANCE Prior to the commencement of any work, and not later than fifteen (15) day following the execution of this contract, the Contractor shall furnish the City copies of paid-up policies �'V;_ providing Liability and Workman's Compensation coverage, with the minimum limits as follows: TYPE OF INSURANCE LIMITS A. Workmen's Compensation covering all employees Statutory B. Employer's Liability $100,000 C. Comprehensive General Liability $1,000,000 D. Automobile Liability $1,000,000 The Commercial General Liability and Automobile Liability policies shall name the City of Fort Worth, Texas as additional insured and all policies shall provide for a waiver of subrogation in favor of the City of Fort Worth. All policies will be effective until final acceptance of this Contract, unless otherwise specified. 9. CONTRACT SUM The Contractor agrees to provide all labor, materials, and all incidentals necessary to complete "THE WORK"under both Part"A"and Part`B"at the following lump sum price: Part "A" Disassemble existing 21,000 gallon tank and Erect at Rolling Hills Water Plant, complete with new bolts, washers,'fasteners, and gaskets: Part"B" Disassemble and remove from plant site 21,000 gallon Crest Point ground storage tank. $ 14,800.00 P tlo �'U-/U U U9 Y lhU�o EXECUTED on this July day of 23rd 2001, in Fort Worth, Tarrant County, Texas.
