CALL TO ORDER With a quorum of the City Council Members present, Mayor Price called the regular session of the Fort Worth City Council to order at 7:01 p.m. on Tuesday, February 13, 2018, in the City Council Chamber of the Fort Worth City Hall, 200 Texas Street, Fort Worth, Texas. II. INVOCATION—Pastor Todd Derbyshire, Crosspoint Nazarene Church The invocation was provided by Pastor Todd Derbyshire, Crosspoint Nazarene Church. III. PLEDGES OF ALLEGIANCE TO THE UNITED STATES AND THE STATE OF TEXAS The Pledges of Allegiance to the United States of America and the State of Texas were recited. IV. CONSIDERATION OF THE MINUTES OF THE CITY COUNCIL WORK SESSION OF JANUARY 30, 2018, AND OF THE MEETING OF THE CITY COUNCIL WORK SESSION AND REGULAR MEETING OF FEBRUARY 6,2018 Motion: Mayor Pro tem Shingleton made a motion, seconded by Council Member Bivens, that the minutes of the City Council Work Session of January 30, 2018, and Regular meeting of February 6, 2018, be approved. ITEMS TO BE WITHDRAWN FROM THE CONSENT AGENDA City Manager Cooke requested that Mayor and Council Communications G-19225 and C-28579 be removed from the Consent Agenda for individual consideration. VI. ITEMS TO BE CONTINUED OR WITHDRAWN BY STAFF City Manager Cooke requested that Mayor and Council Communications G-19213 be withdrawn from the Council agenda. VII. CONSENT AGENDA Motion: Council Member Bivens made a motion, seconded by Mayor Pro tem Shingleton, that the Consent Agenda be approved as amended. M&C G-19224 - Authorize the Temporary Closure of Dalford Street from Oakhurst Scenic Drive to Scotts Way (COUNCIL DISTRICT 9) B. Purchase of Equipment,Materials, and Services - Consent Items 1. M&C P-12155 - Authorize Agreement with Corporate Floors, Inc. for the Purchase and Installation of Flooring at Four Libraries for a Total Amount Up to $348,850.00 (ALL COUNCIL DISTRICTS) E. Award of Contract- Consent Items 1. M&C C-28575 - Authorize Execution of Amendment No. 2 to Enhanced Community Facilities Agreement with Bell Helicopter Textron, Inc., City Secretary Contract No. 46479 to Increase City Participation by an Additional $628,434.40 with Funds Received from Tarrant County for the Reconstruction of Norwood Drive between Trinity Boulevard and State Highway 10 (COUNCIL DISTRICT 5) Ms. Danielle Tucker, 11500 Mosier Valley Road, completed a comment card in support of Mayor and Council Communication C-28575. 2. M&C C-28576 - Authorize Execution of Consent to Assignment of City Secretary Contract No. 46195, a Tax Abatement Agreement with LMP Realty, Inc. to AGNL Blade, L.P. for Construction of a Warehouse at 1700 Meacham Boulevard in the 28th Street/Meacham Neighborhood Empowerment Zone (COUNCIL DISTRICT 2) CITY OF FORT WORTH, TEXAS REGULAR CITY COUNCIL MEETING FEBRUARY 13,2018 Page 3 of 8 3. M&C C-28577 - Authorize Execution of Amendment No. 6 to City Secretary Contract No. 43361, an Engineering Services Agreement with URS Corporation n/k/a AECOM for the Widening of Garden Acres Bridge Over IH-35W, in the Amount of $44,784.00 for Additional Construction Phase Services Thereby Increasing the Contract Amount to $977,489.53 (COUNCIL DISTRICT 6) 4. M&C C-28578 - Authorize Execution of a Construction Contract with Johnson Controls, Inc., in the Amount of $599,891.00, Including 7.5 Percent for the Owner's Construction Contingency Allowance for the Chiller and Heat Pump Replacement at Will Rogers Memorial Center and Provide for Administrative Costs for a Total Project Cost of$900,000.00 (COUNCIL DISTRICT 7) VIII. PRESENTATIONS BY THE CITY SECRETARY - CONSENT ITEMS 1. Notice of Claims for Alleged Damages and/or Injuries End of Consent Agenda. A. General—Removed from Consent Agenda 2. M&C G-19225 - Authorize Acceptance of an Additional Award in the Amount of $192,000.00 in Fiscal Year 2016 Homeland Security Grant Program Funds from the United States Department of Homeland Security Through the State of Texas, Office of the Governor, Authorize Execution of Related Documents, and Adopt Appropriation Ordinance (ALL COUNCIL DISTRICTS) Mr. Isaiah Smith, P.O. Box 163411, completed an undecided speaker card relative to Mayor and Council Communication G-19225 and was recognized by Mayor Price but was not present in the Council Chamber. Motion: Mayor Pro tem Shingleton made a motion, seconded by Council Member Flores, that Mayor and Council Communication G-19225 be approved and Appropriation Ordinance No. 23113-02-2018 be adopted. Motion passed 7-0, Council Members Byrd and Moon absent. F. Award of Contract—Removed from Consent Aeenda 5. M&C C-28579 - Authorize Execution of an Interlocal Agreement with Tarrant County to Participate in the Tarrant Regional Auto Crimes Task Force, Authorize Acceptance of Grant Funding from the Tarrant County Regional Auto Crimes Task Force in the Amount of $106,679.00, Authorize Transfer from the Police Department - General Fund in the Amount of $25,420.00 for the City's Match Requirement and Adopt Appropriation Ordinance (ALL COUNCIL DISTRICTS) CITY OF FORT WORTH, TEXAS REGULAR CITY COUNCIL MEETING FEBRUARY 13,2018 Page 4 of 8 Mr. Isaiah Smith, P.O. Motion passed 7-0, Council Members Byrd and Moon absent. IX. SPECIAL PRESENTATIONS, INTRODUCTIONS,ETC. 1. Presentation of Certificate of Appreciation for Peter Duncan 2. Presentation of Certificate of Appreciation for Trey Duncan Mayor Price presented a Certificates of Appreciation to Mr. Peter Duncan and Mr. Trey Duncan, representing the Mattress Factory, who generously donated a bed to a deserving student from Western Hills Elementary during the holiday season. 3. Presentation by Fort Worth Sister Cities, Inc. and the Administration of the Citizen Diplomat Oath Ms. Mae Ferguson, President and CEO, Fort Worth Sister Cities, Inc., recognized students and teachers who will represent Fort Worth as part of the Youth Ambassador Exchange Program traveling to Budapest, Hungary; Reggio Emilia and Florence, Italy; Trier, Germany; Toluca, Mexico; Nimes, France; Mbabane, Swaziland; Johannesburg, South Africa; and Nagaoka and Tokyo, Japan. Mayor Price administered the Citizen Diplomat Oath to the Youth Ambassadors. X. ANNOUNCEMENTS BY CITY COUNCIL MEMBERS AND STAFF 1. Upcoming and Recent Events Mayor Price, Mayor Pro tem Shingleton, and Council Members Flores, Bivens, and Allen Gray announced upcoming and recent events within the City and various Council districts. 2. Recognition of Citizens There were no recognition of citizens. 3. Approval of Ceremonial Travel There was no approval of ceremonial travel. Changes in Membership on Boards and Commissions Motion: Council Member Flores made a motion, seconded by Mayor Pro tem Shingleton, that the following individuals be appointed to Place 2 of the various boards effective February 13, 2018, and with a term expiring October 1, 2018. Mr. Armando Pina—Historic and Cultural Landmarks Commission Mr. Tyler Trembley— City Plan Commission and Capital Improvements Advisory Committee for Transportation Impact Fees Motion passed 7-0, Council Members Byrd and Moon absent. Motion: Council Member Bivens made a motion, seconded by Mayor Pro tem Shingleton, that Mr. Rick Herring be appointed to Place 4 of the Historic and Cultural Landmarks Commission effective February 13, 2018, and with a term expiring October 1, 2018. Motion passed 7-0, Council Members Byrd and Moon absent. XII. PRESENTATIONS AND/OR COMMUNICATIONS FROM BOARDS, COMMISSIONS AND/OR CITY COUNCIL COMMITTEES There were no presentations and/or communication from boards, commissions, and/or City Council committees. XIII. REPORT OF THE CITY MANAGER B. General 1. M&C G-19213 - Adopt Resolution Revising the Policy for Operating Public Improvement Districts (ALL COUNCIL DISTRICTS) (Continued from a Previous Meeting) It was the consensus of the City Council that Mayor and Council Communication G-19213 be withdrawn from the Council agenda. 2. M&C G-19213 - (Revised) Adopt Resolution Revising the Policy for Operating Public Improvement Districts (ALL COUNCIL DISTRICTS) Motion: Mayor Pro tem Shingleton made a motion, seconded by Council Member Flores, that Mayor and Council Communication G-19213 Revised be approved and Resolution No. 4905-02-2018 be adopted. M&C G-19226 - Adopt Ordinance Adjusting Appropriations in Various Funds and Amounts to Bring Revenues and Expenditures Into Balance in Order to Finalize Fiscal Year 2017 (ALL COUNCIL DISTRICTS) Motion: Mayor Pro tem Shingleton made a motion, seconded by Council Member Bivens, that Mayor and Council Communication G-19226 be approved and Appropriation Ordinance No. 23115-02-2018 be adopted. Motion passed 7-0, Council Members Byrd and Moon absent. 4. M&C G-19227 - Approve Applications for Partial Approval of the Historic Site Tax Exemption for 1412 S. Lake Street, 2208 Mistletoe Avenue, 2317 Carverly Drive, 1905 S. Adams Street, 1509 Fairmount Avenue, 1221 S. Clara Street, 1431 Lipscomb Street, 1501 W. Morphy Street, 1598 Sunset Terrace, 1920 Washington Avenue and 2260 5th Avenue (COUNCIL DISTRICTS 5 and 9) Council Member Zadeh advised that she had filed a Conflict of Interest Affidavit with the City Secretary's Office and would abstain from voting on this issue. Motion: Council Member Bivens made a motion, seconded by Mayor Pro tem Shingleton, that Mayor and Council Communication G-19227 be approved. Motion passed 6-0, with one abstention by Council Member Zadeh and Council Members Byrd and Moon absent. 5. M&C G-19228 - Approve Appointment and Reappointments to the City's Construction and Fire Prevention Board of Appeals, Places 1, 3, 5 and 11 (ALL COUNCIL DISTRICTS) Motion: Council Member Allen Gray made a motion, seconded by Mayor Pro tem Shingleton, that Mayor and Council Communication G-19228 be approved. Motion passed 7-0, Council Members Byrd and Moon absent. 6. M&C G-19229 - Consider and Adopt Resolutions of Support for 2018 Competitive Housing Tax Credit Applications, Approve Commitments of Development Funding, Determine Which Developments Contribute More Than Any Other to the City's Concerted Revitalization Efforts, and Make Related Determinations (COUNCIL DISTRICTS 4 and 8) Mr. Dan Allgeier, 6333 East Mockingbird Lane, Dallas, Texas, completed a speaker card in support of Mayor and Council Communication G-19229 and was recognized by Mayor Price but did not wish to address Council. Motion: Council Member Allen Gray made a motion, seconded by Council Member Zadeh, that Mayor and Council Communication G-19229 be approved and Resolution Nos. 4906-02-2018, 4907-02-2018, and 4908-02-2018 be adopted. M&C G-19230 - Conduct a Public Hearing and Approve Amended Fiscal Year 2017 Crime Control and Prevention District Budget with Adjustments Among Initiatives and No Net Increase to the Overall Budget (ALL COUNCIL DISTRICTS) (PUBLIC HEARING) Mayor Price opened the public hearing. a. Report of City Staff Mr. Terry Hanson, Performance and Budget Office, appeared before Council and provided a staff report. b. Citizen Presentations Ms. Danielle Tucker, 11500 Mosier Valley Road, completed a comment card in support of Mayor and Council Communication G-19230. c. Council Action Motion: Mayor Pro tem Shingleton made a motion, seconded by Council Member Flores, that the public hearing be closed and Mayor and Council Communication G-19230 be approved. Motion passed 7-0, Council Members Byrd and Moon absent. F. Award of Contract 1. M&C C-28580 - Authorize Execution of Tax Abatement Agreement with Raider Express for an Office, Training and Maintenance Facility to be Located at Property in the Vicinity of the Intersection of Highway 287 and Willow Springs Road (COUNCIL DISTRICT 7) Motion: Mayor Pro tem Shingleton made a motion, seconded by Council Member Bivens, that Mayor and Council Communication C-28580 be approved. Motion passed 7- 0, Council Members Byrd and Moon absent. 2. M&C C-28581 - Authorize Acceptance of a Grant from Direct Energy in an Amount Up to $25,000.00 for the Neighbor-to-Neighbor Utility Assistance Program, Authorize Related Contracts, Approve Allocation of Investment Income/Interest Income Up to $1,200.00 and Adopt Appropriation Ordinance (ALL COUNCIL DISTRICTS) Motion: Council Member Allen Gray made a motion, seconded by Council Member Zadeh, that Mayor and Council Communication C-28580 be approved with appreciation and Appropriation Ordinance No. 23116-02-2018 be adopted. CITIZEN PRESENTATIONS Mr. Bob Willoughby, 6731 Bridge Street #125, appeared before Council relative to Code Compliance. XV. EXECUTIVE SESSION (CITY COUNCIL CONFERENCE ROOM, CITY HALL, ROOM 290) XVI. ADJOURNMENT There being no further business, Mayor Price adjourned the Regular meeting 7:36 p.m., in memory of Mr. William "Bill" Koenig, Police Department, Mr. Patrick Richards, IT Solutions Department, and Mr. Henry Lemlyn, Water Department, who all passed away last week, and Richardson Police Officer David Sherrard, who lost his life in the line of duty on Wednesday, February 7, 2018.
