HomeMy WebLinkAboutContract 26988 CONI HACT No. 9 SJ AMENDMENT NO. 2 STATE OF TEXAS § CITY SECRETARY CONTRACT (No M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Baird, Hampton & Brown, Inc . Consulting Engineers, Inc. (the "Engineer" ) made and entered into City Secretary Contract No. 24247, (the Contract) which was authorized by the City Council by M&C C-16961 on the 1't day of September, 1998 ; and WHEREAS, the Contract involves engineering services for the following project : Water, Sewer, Paving & Drainage Improvements to E. Fogg Street (West of Berke to Dead End) DOE 2198, Glen Garden Avenue (Old Mansfield to Stephen Lee) DOE 2199, Kingsdale Drive (Rolling Hills to Ellis Ranch) DOE 2200, Timberline Drive S. (S . Riverside to S. Dead End) DOE 2201 WHEREAS, it has became necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee to; (1) modify the original plans to separate Fogg Street into a separate stand-alone project, (2) add traffic control plans for each of the streets, (3) modify the details and bid proposals to provide for an alternate (concrete) pavement section, and (4) additional printing/reproduction for advertising two separate projects. NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract : 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated July 31, 2001, a copy of which is attached hereto and incorporated herein. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $178, 509. 00 3 . All other provisions of the Contract which are not expressly amended herein shall remain in full force1 and effect . Fogg Street has proven to be more'diffcult than originally anticipated. To allow for the reconstruction of the remaining streets to proceed now, we have been requested to revise our final plans and.break up the project into two separate sets of bid documents. We are writing to, request a contract modification to provide additional compensation, for (1) modifying the original plans to delete Fogg Street from the project, (2) adding traffic control plans for each of the streets, (3) modifying the details and bid proposals to provide for an alternate (concrete) pavement section, and (4)the additional printing/reproduction.
