COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth (City) and Carter & Burgess, (Engineer)
made and entered into City Secretary Contract No. 18476= (the Contract) which was
authorized by the City Council by M&C C-12837 on the 30`h day of April, 1991; and
amended by City Council on May 16, 2000 (M&C C-17970), and subsequently amended
by nine (9) previous amendments; and
WHEREAS, the Contract involves engineering services for the following project:
Construction Management Services for West Fork Relief Main, Segments
WF-4, and WF-5.
WHEREAS, it has become necessary to execute Amendment No. 10 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:
1.
Section 1, Services of the Engineer, of the Contract is amended to include the
additional engineering services specified in a proposal letter dated June 15, 2001, a copy
of which is attached hereto and incorporated herein. The cost to City for the additional
services to be performed by Engineer total $ 55,897.15.
2.
Section IV, Compensation to Engineer, of the Contract is amended to provide for
an increase in the maximum fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid by the City for all
work and services shall not exceed the sum of$ 2,871,050.15.
3.
All other provisions of the contract, which are not expressly amended herein, shall
remain in full force and effect.

Dear Mr. Sahu:
This letter serves as the "Letter of Intent"for Carter& Burgess, Inc.'s proposed M/WBE
commitment for the above referenced project. Carter & Burgess proposes to use ANA
Consultants, L.L.C. to fulfill the M/WBE requirement on this project.
ANA Consultants, L.L.C. will provide project representation services during the
construction observation of WF-4 & WF-5 projects. Compensation for ANA Consultants,
L.L.C. services will be at least$8,386.47, which is approximately 15% of the proposed
engineering contract amendment amount of$55,897.15.

Dear Mr. Sahu:
Carter& Burgess acknowledges its commitment for making a "good faith" effort to meet the
City of Fort Worth's goals for disadvantaged business enterprises (DBE) participation in City
of Fort Worth contracts. The staffing requirements for this project will consist of:
• One part-time construction representative
• One part-time secretary
• One part-time project manager
Our current contract amount is $2,815,153.00 with a M/WBE participation of$422,271.05 for
an involvement of 15%. We propose to engage a certified M/WBE firm to provide project
representation services in the amount of$8,386.47 on this amendment. This will result in a
total M/WBE participation of$430,657.52 on the revised total contract amount of
$2,871,050.15, which is a total project commitment of 15%.
We feel this is the most feasible means of providing M/WBE participation on what is basically
a one-person assignment (one project representative). It also achieves our goal of 15%
participation on the overall project.

WEST FORK RELIEF SEWER PROJECT SECTIONS WF-4 AND WF-5
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 10 to
City Secretary Contract No. 18476, for construction management and inspection services with Carter &
Burgess, Inc. for additional work related to West Fork Relief Sewer Project Sections WF-4 and WF-5 for
a fee of$55,897.15 increasing the total contract amount to $2,871,050.15.
DISCUSSION:
On April 30, 1991 (M&C C-12837), the City Council authorized the execution of an engineering
agreement with Carter & Burgess, Inc. for engineering services for West Fork Sanitary Sewer Relief
Project Sections WF-2, WF-3, WF-4, and WF-5 in the amount of $1,949,500.00. Construction of
Sections WF-2 and WF-3 has been completed. This contract was previously revised by nine
amendments, thereby increasing the total contract amount to $2,815,153.00.
The construction of West Fork Sanitary Sewer Project Sections WF-4 and WF-5 is in progress and
nearing completion. Due to unforeseen utility conflicts and subsequent required design modifications
that have lengthened the project duration, Carter & Burgess, Inc. is requesting an additional 105
calendar days (30 days for WF-4 and 75 days for WF-5) of construction inspection services be added to
its contract. The original contract included inspection services based on construction duration of 330
days for WF4 and 270 days for WF-5. Staff has received the Cater & Burgess, Inc. proposal for
additional construction inspection services and cancurs with the additional days requested.
Carter & Burgess, Inc. proposes to provide additional construction and management services for a fee
not to exceed $55,897.15. Staff considers this fee to be fair and reasonable for the work to be performed.
This project is located in COUNCIL DISTRICTS 7 and 9, Mapsco 61 R, X, U, and 62S.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of
the Commercial Paper-Sewer Fund.
