WHEREAS, Fort Worth Transportation Authority (the T) hereinafter called"Developer",
is building an Intermodal Transportation Center in the vicinity of Grove Street between 7'and 8`'
Streets.
WHEREAS,the City of Fort Worth a municipal corporation of Tarrant and Denton
Counties,Texas, hereinafter called"City"has requested Developer to participate in certain
improvements to Grove Street and the City will do certain work.
NOW, THEREFORE, KNOW ALL BY THESE PRESENTS:
That said Developer, acting herein by and through Anthony V. Johnson, its duly
authorized Assistant General Manager and the City, acting herein by and through Mike Groomer,
its duly authorized Assistant City Manager, for and in consideration of the covenants and
conditions contained herein, do hereby agree as follows:

COMMUNITY FACILITIES AGREEMENT

STREET, STORM DRAIN, STREET LIGHT AND STREET NAME SIGN
IMPROVEMENTS FOR
GROVE STREET BETWEEN 7TH AND 8TH STREETS
A. The Developer(s) agrees to pay to the City $250,000.00 for improvements to Grove Street
from 7`h Street to 8`' Street, including sidewalks on both side of the street.
B. The City will handle all paper work, approvals, bonds, warranties, and fees related to the
roadway improvements. The City will be responsible for letting, awarding, and
inspecting the roadway improvements. Engineering design will be done by an outside
engineering consultant firm hired by the City.
C. As shown on the attached"Summary of Cost", the Developer agrees to fund his share of
"current improvements" and to pay the City for its share of the cost for street
improvements as shown on the attached exhibit.
D. Payment is due at the time this agreement is executed by the Developer.
E. In accordance with the City's current Policy for Installation of Community Facilities as
shown in the Cost Summary on Page 3.
The Developer shall pay the City $194,000 Dollars for the road improvements and
$56,000 Dollars for engineering fees for a total of$250,000 Dollars.
F. City agrees to provide, at its sole cost and expense , all necessary rights of way and
easements required to construct current and future improvements provided for in this
agreement.
G. The City shall be responsible for installing or to cause to have installed or adjusted all fo
the required utilities to serve the development or to construct the improvements required
herein.
H. The City will endeavor to complete the improvements covered by this agreement on or
before October 26, 2001. In the event the cost of engineering and the bid amount for
construction is greater than$250,000, City shall request funding for such overage of City
Council. If such overage funding is not approved, City shall not be required to proceed
with its obligation hereunder and shall refund to Developer its deposit less such costs as
the City has incurred in the furtherance of this agreement.

IN TESTIMONY WHEREOF, the City of Fort Worth has caused this instrument to be
executed in triplicate in its name and on its behalf by its City Manager, attested by its City
Secretary, with the corporate seal of the City affixed, and said Devel9per has qxecuted this

1. All Preliminary Plats filed after July 11, 2000 will require sidewalks on all streets.
Forty-two (42)feet and wider street include sidewalk cost.
Grove Street will include sidewalk on both sides.
2. (*) Inspection costs for developer are included in the $194,000.
3. The cost for street lights and signs is included under street cost.

SUBJECT COMMUNITY FACILITIES AGREEMENT WITH THE FORT WORTH

STREET BETWEEN 7TH AND 8TH STREET TO BENEFIT THE INTERMODAL
TRANSPORTATION CENTER IN DOWNTOWN FORT WORTH
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute a Community Facilities
Agreement with the Fort Worth Transportation Authority (The "T") for street improvements to Grove
Street from 7th Street to 8th Street in order to benefit the Intermodal Transportation Center (ITC) in
downtown Fort Worth.
DISCUSSION:
On February 15, 2001, The "T" Executive Committee authorized the General Manager to spend up to
$250,000 for reconstruction of Grove Street from 7th Street to 8th Street to benefit the ITC in downtown
Fort Worth. Under the agreement, The "T" will spend up to $250,000 for reconstruction of Grove Street
from 7th Street to 8th Street estimated to cost $500,000. The City of Fort Worth will be responsible for
designing and constructing the street and for costs exceeding $250,000.
The project will consist of fully reconstructing Grove Street from 7th Street to 8th Street, constructing
sidewalks, landscaping on both sides of the street, installing pedestrian scale street lighting and railing
adjacent to the parking lot, and on-street parking along one side of the street.
City staff proposes to retain the firm of Carter & Burgess, Inc. to prepare the engineering plans and
specifications for Grove Street for an amount of$56,000.
This Community Facilities Agreement is in compliance with standard City policy.
This project is located in COUNCIL DISTRICT 9, Mapsco 63W.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that this action will have no material effect on City funds.
