HomeMy WebLinkAboutContract 27003 CITY SECRETARY O�i CONTRACT NO. 70 INTERLOCAL COOPERATION AGREEMENT BETWEEN CITY OF FORT WORTH AND TARRANT COUNTRY REGARDING 2001 SUMMER WORKS PROGRAM This INTERLOCAL COOPERATION AGREEMENT ("Agreement") is hereby made and entered into by and between the City of Fort Worth, Texas ("City") and Tarrant County, Texas ("County"). The following statements are true and correct and form the basis upon which the City and the County have entered into this Agreement: A. The County operates and administers a public/private initiative known as the Summer Works Program. This program matches 16-21 year old youth residing in the County, including the City, with various employers in the County in order to assist these youths in obtaining summer jobs. The City has previously assisted the County in various fashions to ensure the availability and success of the Summer Works Program. B. The City believes that the Summer Works Program is of benefit to the City and supports the public purposes achieved through the Summer Works Program. As a result, the City wishes to transfer $68,000 ("Funding") to the County in support of the County's operation and administration of the 2001 Summer Works Program ("Program") in return for the commitments of the County that are set forth in this Agreement. The County wishes to accept the Funding on the terms and conditions that are set forth in this Agreement. C. Both the City and the County are authorized to enter into this Agreement pursuant to and in accordance with the Interlocal Cooperation Act, as codified in the Texas Government Code, Title 7, Chapter 791.001, et seq. NOW, THEREFORE, the City and the County agree as follows: 1. TERM. This Agreement shall be in effect from May 1, 2001 until August 31, 2001; provided, however, that any obligation of the County to return any unused Funding or other sums to the City, as provided in Section 2 of this Agreement, shall survive such expiration. 2. RESPONSIBILITIES OF THE PARTIES. The City agrees to provide the Funding to the County from current revenues of the City. In return, the County agrees to use the Funding only for the direct operation and administration of the Program. In addition, the County agrees to administer the Program in accordance with the goals, objectives and milestones set forth on Exhibit "A", attached hereto and hereby made a part of this Agreement for all purposes. At the City's request, the County will provide a written accounting that details the County's actual use of the Funding. If the County fails to use all of the Funding or has additional sums left in its budget for the Program, the County will return to �l MU'�DRY the City the unused portion of the Funding or reimburse the City its pro rata share of the budget surplus, as appropriate, within thirty (30) calendar days following the expiration of this Agreement. 3. LIABILITY. As an independent contractor, the County shall have sole right and responsibility to coordinate and operate the Program and to administer the Program and shall be solely responsible for the acts and omissions of its officers, agents, servants, employees, contractors and subcontractors. The City, its officers, boards, commissions, agents, employees and volunteers, shall not be liable for any liabilities, obligations, damages, penalties, claims, liens, costs, charges, losses and/or expenses, including, but not limited to, personal injury, including death, or property damages, whether legal or equitable, which may arise or be alleged pursuant to or in relation to the Program. This Agreement shall not be construed as the creation of any partnership or joint enterprise between the City and the County. 4. MISCELLANEOUS. 4.1. No Waiver. The failure of either party to insist upon the performance of any provision or condition of this Agreement or to exercise any right granted herein shall not constitute a waiver of that party's right to insist upon appropriate performance or to assert any such right on any future occasion. 4.2. Severability. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired. 4.3. Force Majeure. The parties shall exercise their best efforts to meet their respective duties and obligations hereunder, but shall not be held liable for any delay in or omission of performance due to force majeure or other causes beyond their reasonable control, including, but not limited to, compliance with any state or federal law or regulation, acts of God, acts of omission, fires, strikes, lockouts, national disasters, wars, riots, material or labor restrictions, transportation problems or existing contractual obligations directly related to the subject matter of this Agreement. 4.4. Venue and Jurisdiction. This Agreement shall be construed in accordance with the laws of the State of Texas. Venue for any action brought on the basis of this Agreement shall lie exclusively in state courts located in Tarrant County, Texas or the United States District Court for the Northern District of Texas—Fort Worth Division. 4.5. Entirety of Agreement. This written instrument contains the entire understanding and agreement between the City and the County as to the matters contained herein. Adopt the attached supplemental appropriation ordinance increasing appropriations in the General Fund by $68,000 and decreasing the unreserved, undesignated fund balance by the same amount for the 2001 Summer Works program; and 2. Authorize the City Manager to execute a contract with Tarrant County for the administration of the 2001 Summer Works program for the period of May 1, 2001, through August 31, 2001, at a cost not to exceed $68,000. DISCUSSION: In 1995, the City's former Employment and Training Department conducted the Fort Worth Summer Works program, a public/private sector initiative for 16-21 year old youth. The program matched youth seeking jobs with employers seeking summer workers. The City employed temporary staff to perform recruitment and job matching tasks. The program enrollment was open to the general public on a first- come, first-serve basis, regardless of the applicants' economic condition. The program was not bound by federal rules. Starting in 1996, the former Employment and Training Department took the lead in a collaborative effort with Tarrant County and the City of Arlington to provide a county-wide summer work experience program for youth. During the FY1999-2000 budget process, the City Council approved financial support in the amount of $68,580 for the Summer Works 2000 program. A total of 985 youth, 725 of whom were from Fort Worth, were provided jobs for an average wage between $5.15 to $10.00 per hour. The Employment and Training Department functions were transferred to Tarrant County effective September 1, 2000. Although the Employment and Training Department no longer exists, due to the importance and success of the program, the City has committed to continue to support the Summer Works program. It is anticipated that 1,100 youth will be placed in summer jobs.
