Main Street, Suite 200, Fort Worth, Texas 76106-2736, for itself or its successors, and assigns, hereinafter referred to as Lessor, and the UNITED STATES OF AMERICA, represented by the Federal Aviation Administration, hereinafter referred to as the Government, WITNESSETH, That: WHEREAS, on October 1, 1998 the parties hereto entered into Lease No. DTFA07- 99-L-01079 as for the consideration and purposes more particularly stated in said lease; and, WHEREAS, the Government has an operational need to acquire approximately 0.09 acre (4,000 square feet) of additional land area, adjacent to the existing Remote Transmitter/Receiver (RTC-C) site located at Fort Worth Meacham International Airport; and, WHEREAS, the Government proposes to utilize the land to install a 60-foot freestanding antenna tower for the RTR-C facility; and, WHEREAS, the parties hereto mutually desire to incorporate the legal description and drawing for the required land area for the antenna tower site into this lease. NOW, THEREFORE, effective October 1, 2005, the parties mutually agree to amend the basic lease in the following particularly only, VIZ: The following shall be included in Article l: ADD: REMOTE TRANSMITTER/RECEIVER(RTR) ANTENNA TOWER Beginning at the southwest of existing Meacham RTR-C property, being the point of beginning: thence south 87° 27' east 50 feet along the RTR-C south property line to a point: thence south 02° 35' west 80 feet to a point: thence 87° 25' west 50 feet to a point: thence north 02° 35' east 80 feet to the point of beginning, containing 4,000 square feet of 1 _ 148 10 Supplemental Agreement No. 1 Lease No. DTFA07-99-L-01079 Remote Transmitter/Receiver Site Fort Worth Meacham International Airport Fort Worth, TX .09 acres, containing 0.09 acre of land, more or less (4,000 square feet) and more particularly shown on Drawing No. FTW-D-RTR-0001, dated July 29, 2005, identified as Exhibit `B," attached hereto and made a part hereof. ALL OTHER TERMS AND CONDITIONS of the basic lease are hereby ratified and except as amended above shall be and remain the same. DISCUSSION: On August 11, 1998, City Council authorized the execution of CSC No. 24179, an Unimproved Ground Lease Agreement for 16,000 square feet of unimproved ground with the Department of Transportation, Federal Aviation Administration for property located at Fort Worth Meacham International Airport.The original term of the lease was for 20 years with automatic annual renewals until September 30, 2018. The FAA proposes to lease the additional unimproved ground to install a 60-foot freestanding antenna tower for the Remote Transmitter/Receiver (RTR-C) Facility at Meacham International Airport, adjacent to the existing RTR-C site. The City and the FAA agree that no rental payments are required due to the mutual benefit provided by the RTR-C to the flying public. This lease may be terminated by either party by giving 30-days written notice. All other terms and conditions of the lease agreement will be in accordance with standard City and Aviation Department polices. The property is located in COUNCIL DISTRICT 2.
