HomeMy WebLinkAboutContract 27046 AMENDMENT NO. 2 STATE OF TEXAS $ CITY SECRETARY CONTRACT NO., (No M&C Needed) COUNTY OF TARRANT $ WHEREAS, the City of Fort Worth (City) and RJN Group, Inc. , (Engineer) made and entered into City Secretary Contract No. 24246, (the Contract) which was authorized by the City Council by M&C 16981 on the 8th day of September 1998 and subsequently revised by one previous amendment; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of the Clear Fork Parallel Relief Sanitary Sewer. WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated July 20, 2001, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $14,080.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $330,253.00. As the design and construction of the wastewater collection system improvements for the project have proceeded, it has been necessary to revise the scope of the engineering services provided to the City of Fort Worth by RJN Group, Inc. (RJN). Amendment no. 2 includes compensation for additional engineering fees to revise the plans and specifications to allow alternative construction materials and methods for bid procurement, increased costs in preparing the plans for bid solicitation, and delays which have pushed the design duration beyond that originally anticipated for the project. The cost for preparation of the final plans and contract documents was higher than anticipated because the project was bid to allow several alternatives for the type of pipe to be used, and methods to install the pipe systems, in an effort to make the bidding more competitive, and decrease the overall project cost. The design duration has also been much longer than normal on this project due to the alternative design process, permitting requirements and coordination efforts required with the Union Pacific Railroad. The project was initiated on October 1998 and was originally scheduled for solicitation of bids in August of 1999. Bids were actually received on June 21, 2001. There were also additional costs associated with the procurement of bids on the project, including additional pre-bid conferences, coordination meetings, printing costs for reproduction of the contract documents & specifications, and the associated engineering costs. PS46- 070460140250 The proposed amendment will reimburse RJN Group, Inc. for the following additional services they provided on the project as requested by the City: 1. The revision of the plans and specifications to allow for alternate construction ma- terials and methods for bid procurement. 2. Additional printing cost involved with the alternate construction materials and methods. 3. Additional coordination involved with the alternate construction materials and methods. RJN Group, Inc., has requested reimbursement in the amount of$14,080.00 for the addi- tional services, thereby increasing the contract fee from $316,173.00 to $330,253.00. 1 believe this fee is fair and reasonable for additional services that were provided.
