COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth ("City") and Bell Helicopter Textron, Inc,
("Developer"), entered into an Enhanced Community Facilities Agreement, City Secretary
Contract No. 46479 ("ECFA") wherein Developer is to make certain improvements within the
City of Fort Worth, Texas, including reconstructing Norwood Drive between Trinity Boulevard
and State Highway 10("Project")with City Participation in an amount not to exeed$1,770,000.00;
and
WHEREAS, on February 17, 2015, through M&C C-27187, the City Council amended
M&C C-26027 to revise the scope and increase the City Participation in the ECFA by$450,000.00
for a total City Participation amount of$2,395,000.00,and to extend the completion deadline from
September 30, 2015 to December 30, 2015; and
WHEREAS, on September 9, 2015, through M&C C-27479, the City Council authorized
execution of an Interlocal Agreement with Tarrant County,Texas to accept$628,434.40 of County
funding for the Project; and
WHEREAS, on August 30, 2016, through M&C C-27887, the City Council authorized
Amendment No. 1 to the ECFA to extend the Completion Deadline for the reconstruction of
Norwood Drive to December 30, 2016; and
WHEREAS, on September 28, 2017, the City received the funds from Tarrant County,
Texas pursuant to the Interlocal Agreement approved by the City Council on September 9, 2015
through M&C C-27479; and
WHEREAS, on February 13, 2018, through M&C C-28575, the City Council authorized
execution of Amendment Number 2 to the ECFA to increase City Participation by an additional
$628,434.40 to authorize payment by the City to the Developer of the funds received by the City
from Tarrant County.

authorized representatives, enter into the following agreement, which amends the ECFA:

Trinity Boulevard and State Highway 10 (COUNCIL DISTRICT 5)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment 2 to the Enhanced
Community Facilities Agreement with Bell Helicopter Textron, Inc., City Secretary Contract No. 46479 for
the reconstruction of Norwood Drive between Trinity Boulevard and State Highway 10 to increase the City
participation by an additional $628,434.40, from funds received from Tarrant County, for a total revised
City participation of up to $3,023,434.40.
DISCUSSION:
On December 18, 2012, (M&C C-26027) City Council approved execution of an Enhanced Community
Facilities Agreement (ECFA) with Bell Helicopter for reimbursement in an amount up to $1,770,000.00 of
the actual expenditures for the Project, including any curb, gutter, valley gutter, and sidewalk. Funding for
that reimbursement was to be $1,000,000.00 from the 2007 Critical Capital Program ECFA Funds and
$770,000.00 from the Service Area M revenues of the Transportation Impact Fee Funds.
The City participation was increased by $175,000.00 and $450,000.00 (M&C C-26761) and (M&C C-
27187), respectively, to increase the project scope and costs to account for additional improvements. The
ECFA was executed on February 27, 2015 as City Secretary Contract No. 46479 with a total City
participation amount of$2,395,000.00.
On September 9, 2015, (M&C C-27479) City Council authorized execution of an Interlocal Agreement with
Tarrant County, to accept $628,434.40 of County funding for the Project and appropriated those funds
within the Project. Tarrant County's funds were received and deposited into the TPW Community
Facilities Agreement Fund (30109) of the Norwood Drive project (CO2180) on September 28, 2017.
This Mayor and Council Communication authorizes the increase of City participation in the Project by the
$628,434.40 to account for Tarrant County's funds, for a total City Participation in an amount up to
$3,023,434.40.
A Form 1295 disclosure form is not required for this amendment under Section 2252.908(c), Texas
Government Code, because Bell Helicopter is a subsidiary of Textron, Inc., a publicly traded company.
This project is located in COUNCIL DISTRICT 5.

The Director of Finance certifies that appropriations are available in the current capital budget, as
appropriated, of the TPW Community Facility Agreement Fund. Prior to an expense / expenditure being
incurred, the participating department has the responsibility to validate the availability of funds.
